10-715Suspension 7/07/2010 Amended Council File � io-� 15 Green Sheet # 31 15339 RESOLUTION Presented by OF SAINT PAUL, MINNESOTA 1 WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of 2 noise in the City of Saint Paul; and 4 6 7 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 WHEREAS, §293.09 provides for the granting of variances from the sound level ]imitations contained in §293.07, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hazdship on the applicant, other persons or on the community; and WHEREAS, Red Bull North America, represented by Xan Guzik, Jam Entertainment and Creative Services, Producer/Authorized Agent, who has been designated as the responsible person on the application, has applied for a variance to provide amplified speakers at Harriet Island; and WHEREAS, applicant is seeking a vaziance for the hours of 10 a.m. to 8:00 p.m. on July 22 & 23, and from 10:00 a.m. to 4:00 p.m. on July 24, 2010; and WHEREAS, if applicant is not granted a variance it will not be able to provide amplified speakers at Haniet Island; and WHEREAS, the Department of Safety and Inspections has reviewed the application and has made recommendations regazding conditions for the variance; now, therefore, be it RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Red Bull North America, subject to the following conditions: 1) The variance shall be for the hours of 10:00 a.m. to 8:00 p.m. on July 22 & 23, and from 10:00 a.m. to 4:00 p.m. on July 24, 2010. 2) All electronically powered equipment used in conjunction with the event shall not exceed as follows for each location: A: On Harriet Island, the limit shall be 94 dBA as measured at the berm along the southeast side of the park. B: At the upper landing across the river the limit shall be 83 75 dBA as measured at the middle of the park area to tbe northwest of the river bank. (The applicant has requested a sound level of 94 dBA at the described location B.) 3) The applicant shall provide personnel and equipment who shall provide continuous sound level monitoring at all stages and each sound mix during the hours of the variance. 4) All electronically powered equipment, PA systems, loudspeakers or similar devices shall be turned off no later than 8:00 p.m. on July 22 & 23, and 4:00 p.m. on July 24, 2010. 38 5) Only flown (hangingZpeakers may be used at the Target Sta¢e. S�eakers on the Upper 39 Landing area shall not be located anv closer than 500 feet from the nearest residential unit and 40 cannot be pointed towards the residential buildinQS. 10-715 39 F URTHER RESOLVED, that any violations of the conditions set forth above on any of the dates 40 may result in revocation of the grant of a variance for the subsequent date(s), in addirion to any criminal 41 citation which might issue.
