Presented by
BE IT RESOLVED, that, upon the petition of Rose and Michael Dorer ("Petitioners") as
documented in Office of Financial Services Vacation File Number 03-2009, the public property
described in the attached E�ibit A is hereby vacated and discontinued as public property and, subject
to the following conditions, the easements within said public property aze hereby released:
Any future excavation within the vacated area, including removal and/or replacement of the
garage and retaining walls, sha11 be reviewed and approved in advance by the City of Saint
Paul, Department of Public Works in order to determine impacts on the adjacent Doswell
Avenue right-of-way. If any undermining of said right-of-way occurs due to improvements or
modifications made by the petitioners within the vacated azea, the petitioners, their successors
and assigns, shall be responsible for all costs and repazations that may be necessary to correct
such undermining.
2. This vacation shall be subject to the terms and conditions of Chapter 130, codified March 1,
1981, of the Saint Paul Legislative Code as amended.
3. The petitioners, their successors and assigns shall pay $600.00 to the City of Saint Paul as an
administrative fee for this vacation which is due and payable within 60 days of the effecfive
date of this resolution.
4. The petitioners, their successors and assigns shall, within 60 days of the effective date of this
resolution, file with the Office of Financial Services-Real Estate Section, an acceptance in
writing of the conditions of this resolution and shall, within the period specified in the terms
and conditions of this resolution, comply in all respects with these terms and conditions.

5. The petitioners, their successors and assigns agree to indemnify, defend and save harmless the
City of Saint Paul, its officers and employees from all suits, actions or claims of any chazacter
brought as a result of injuries or damages received or sustained by any person, persons or
properiy on account of this vacation, or the petitioners' use of this property, including but not
limited to, a claim brought because of any act of omission, neglect, or misconduct of said
petitioners or because of any claims or liability arising from any violation of any law or
regulation made in accordance with the law, whether by the petitioners or any of theu agents
or employees.

WHEREAS, the Ciry Council adopted Council File No. 10-229, dated March 3, 2010, said council file
being the Final Order approving construction of the 2010 Residential Street Vitality Pro}ect, specifically referencing
the portion identified as the Front-Victoria area (File #19080); and
WHEREA5, more than 70% of the property owners containing street frontage on Kilbum Street between
Orchard Avenue and the railroad right-of-way have signed a petition requesting to opt out of said project; and
WHEREAS, the District 6 Planning Council supports the opt out decision made by the property owners
along said portion of Kilbum Srteet; and
WFIEREAS, the Council of the City of Saint Pau] has conducted a public hearing upon the above petition,
due notice thereof having been given as prescribed by the City Charter; and
WHEREAS, the Council has heasd all persons, objecrions and recoaunendations pertaining to said petition
and has fully considered the same; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul does hereby order that Kilburn Street, between
Orchard Avenue and the railroad right-of-way, be deleted from the 2010 Residential Street Vitality Project, a�d that
all other portions of said Counci] File No. 10-229 remain in full force and effect.
