1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one and one half story, wood frame duplex located on property hereinafrer
4 referred to as the "Subject Property" and commonly known as 1648 BUSH AVENUE. This
5 property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before November 16, 2009,
the following are the now known interested or responsible parties for the Subject Property:

WHEREAS, Department of Safety and Inspections has notified the known interested or
responsible parties of the "Order to Abate Nuisance Building(s)" dated March 24, 2010 as
provided for in Chapter 45 of the Saint Paul Legislative Code; and
WHEREAS, this order informed Yhe then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by Apri126, 2010; and
WHEREAS, the enfarcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public heazings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interesYed and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, May 25, 2010 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
ninety (90) days after the date of the Council Hearing.
2. If the above conective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessazy to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by tbe City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

This building(s) is a nuisance building(s) as defined in Chapter 45 and a vacant building as defined in Chapter 43 of the Saint Paul
Legislative Code. The owners, interested par[ies and responsible parties known to the Enforcement Officer were given an order to
repair or remove the building at 1648 BUSH AVE by Apri126, 2010, and have failed to comply with ihose orders.

The rehabilitation or demolition of the structure to be completed within ninety (90) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, June
16, 2010 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1648 BUSH AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($S,OOOAO).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolisb and remove the
building(s).

That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and

resolution and that the notification requirements of Chapter 45 have been fulfilled.

issued an order to the then known responsible parties to eliminate Uvs nuisance condition by
correcting the deficiencies or by razing and removing this building(s).
The properly was re-inspected on Apri126, 2010. There was no compliance and the nuisance
condition remains unabated, the cominunity continues to suffer the blighting influence of this
property. It is the recommendarion of the Department of Safety and Inspections thal the City
Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove this building itt a timely manner, and failing that, authorize the Department of Safety and
inspections to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taa�es.

The building is a two-story, wood frame, duplex on a lot of 4,792 square feet.
According to our files, it has been a vacant building since September 12, 2007.
The current property owner is Shinbay Yang, per AMANDA and Ramsey County Property
records.
The city has had to board this building to secure it from trespass.
There have been six (6) SUMMARY ABATEMENT NOTICES since 2007.
There have been seven (7) WORK ORDER(S) issued for:
- Boarding/Securing
- Improperly stored refuse, garbage and misc debris
- Removal of tall grass and weeds
- Removal of snow and ice
On February 17, 2010, an inspecrion of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on March 24, 2010 with a compliance date of
April 26, 2010. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building regisYration fees are paid.
Taxation has placed an estimated market value of $20,400 on the land and $71,800 on the
building.
As of August 6, 2009, a Code Compliance Inspection has been completed.
As of March 15, 2010, the $5,000.00 perfonnance bond has been posted.
Real Estate taxes for the first half of 2010 are delinquent in the amount of $1,826.24, plus
penalty and interest.
Code Enforcement Officers estimate the cost to repair this structure exceeds $35,000.

Inspections, Division of Code Enforcement, hereby deciares the premises located at:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On February 17, 2010, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. This
building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall

not again be used for occupancy unfil such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued. All repairs must be in accordance with
appropriate codes. Changes or additions to the electrical system, mechanical system, or
the plumbing system may necessitate updating or upgrading the systems involved.
This is a one and one half story, wood frame duplex.
BUILDING
• Insure basement cellar floor is even, cleanable and all holes are filled
• Permanently secure top and bottom of support posts in an approved manner
• Cover water meter pit with concrete or decay resistant, screw down cover
• Maintain one hour fire separation between dwelling units and between units and
common azeas
• Relocate 2nd floor electrical panel to 2nd floor unit or to common area; or protect panel
and access corridor leading from common azea to panel with ] hour fire rated enclosure.
• Install handrails and guardrails at all stairways, including basement stairways, and return
handrail ends to the wall or newel post per attachment.
• Strap or support top of stair stringers
• Install tempered or safety glass in window over stair landing to code
• Install tempered or safety glass in window over stairway to code
• Install tempered or safety glass in window over bathtub to code
• Repair or Replace any deteriorated window sash, broken glass, sash holders, re-putty,
etc as necessary
• Provide complete storms and screens, in good repair for all door and window openings
• Provide and operable latching device for all windows
• Provide thumb type deadbolts for all entry doors. Remove any surface bolts
• Repair or replace damaged doors and frames as necessary, including storm doars
• Install floor covering in bathroom and kitchen that is impervious to water
. Repair wa11s, ceiling and floors throughout, as necessary
• Prepare and paint interior and exteriar as necessary. Observe necessary abatement
procedure if lead base paint is present (See St Paul Legislative Code, Chap. 34 for
additional information).
. Any framing members that do not meet code (where wall and ceiling covering is
xe�noved, members that are ovex-spanned, not being carried properly, door and window
openings that are not adequately supported, etc.) are to be reconstructed in an approved
manner
e Where wa11 and ceiling covering is removed install full thickness or code-specified
insulation
. Install attic insulation according to applicable code
• Air-seal and insulate attic access door in an approved manner
• Provide smoke detectors per the MN Building Code and carbon monoxide detectors per
State Law.
• Install water-proof enclosure in shower area
• Provide weather sealed, air sealed and vermin sealed exterior
• Replace or repair landing and stairway per code

• Repair siding, soffit, fascia, trim, etc. as necessary
• Install rain leaders to direct drainage away from foundation.
• Close in open stair risers to maintain an openin� no greater than 4 inches
• A building pernut is required to correct the above deficiencies
• Install risers at front steps, install guardrail and handrail at front steps to code.
• Install green pressure treated blocking at existing front porch footings on top of concrete
footing. Re-level front porch.
• Weather seal azound basement windows, install new windows where boarded over to
meet ventilation requirement.
• Remove carpeting throughout building.
• Replace broken tread at front entry going up to second floor unit.
• Install risers, guazdrail and handrail to code at rear and side entry decks.
• Remove and replace damaged and rotted deck boards, joists and blocking at bottom of
deck columns at side entry deck. Provide green pressure treated lumber under rim joists
to concrete piers. Re-level deck completely.
• Install skirting under all decks and re-install skirting at front porch deck.
• Scrape, prime and paint exterior of house.
• Remove nuisance trees next to house foundation.
• Repair bottom concrete step at front entry stairs at city sidewalk.
ELECTRICAL
• Ground the electrical service to the water service with a copper conductor within 5 feet
of the entrance point of the water service
• Bond around water meter with a copper wire sized for the electrical service per Article
250 of the NEC
• Provide a complete circuit directory at service panel indicating location and use of all
circuits
. Verify that fuse/circuit breaker amperage matches wire size
. Close openings in service panel/junction box with knock out seals, breaker blanks and/or
junction boxes
• Ground bathroom light in basement/first bathroom/second bathroom and disconnect
receptacle on fixture
• Install globe-type enclosed light fixture on all closet lights
o Repair or Replace all broken, missing or loose light fixtures, switches and outlets, covers
and plates
• Check all outlets for proper polarity and verify ground on 3-prong oudets
• Install hard-wired, battery backup smoke detector per bulletin 80-1 and other smoke
detectors as required by the IRC. Also, Install cazbon monoxide detector(s) within 10
feet of all bedrooms
s Remove and or/ re-wire all illegal, improper or hazardous wiring in basemendgarage
• Check building write-up for fire resistance requirements if both panels aze in the
common azea in a basement or move 2nd unit electrical panel board to the second unit
e Insure newer wiring in panels is properly wired. Purchase permit for at least 8 circuits.

a All added receptacles must be grounded, tamper-resistant and be on an Arc-Fault Circuit
Interrupter-protected circuit.
• All electrical work must be done by a Minnesota-licensed electrical contractor under an
electrical permit.
• Any open walls or walls that are opened as part of this project must be wired to the
standards of the 2008 NEC.
• All buildings on the property must meet the St. Paul Property Maintenance Code
(Bulletin 80-1).

As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by April 26, 2010 the Department of Safety and
Inspections, Division of Code Enforoement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651) 266-8989. This
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition. You may also be required to post a five thousand dollaz ($5,000.00)
perforniance bond with the Department of Safety and Inspections before any permits are issued,
except for a demolition permit. Call the Department of Safety and Inspections for more
information at 651-266-8989.
If this building is located in a historic district or site (noted on page I, above, just below the
property address) then you must contact Heritage Preservation (HPC) staff to discuss your
proposal for the repairs required by this order and compliance with preservation guidelines.
Copies of the guidelines and design review application and forms are available from the
Department of Safety and Inspections web site (see letterhead) and from the HPC staff. No
permits will be issued without HPC review and approval. HPC staff also can be reached by
calling 651-266-9078.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, a11 present ar subsequent renters and
any subsequent owners. The property shall not be sold, transferred or conveyed in any manner
until the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is fiuther required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessazy. The City Clerk will then

schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appxopriate.
If the resolution cails for abatement action the Council may either order the City to take the
abatement action or fix a tune within which this nuisance must be abated in accordance w7th the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

Ordering the owner to reznove or repair the building(s) at 1648 Bush Avenue within fifteen
(15) days from adoption of resolution.
Tom Yang appeared on behalf of his son, Shinbay Yang, the property owner.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two-
story, wood frame, duplex on a lot of 4,792 square feet and had been vacant since September 12,
2007. A code compliance inspection had been done on August 6, 2009, the vacant building
registration fees in the amount of $1,000 were paid, and the $5,000 performance bond had been
posted March 15, 2010. On February 17, 2010, an inspection of the building was done and a list of
deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance
building was posted on March 24, 2010 with a compliance date of April 26, 2010. To date, the
property remained in a condition which comprised a nuisance as defined by the Legislative Code.
Ramsey County Taxation estimated the market value of the land to be approximately $20,400 and
the building to be $71,800. Real estate taxes for the first half of 2010 were delinquent in the
amount of $1,826.24, plus penalty and interest. Code Enforcement estimates the cost to repair the
building to exceed $25,000. The cost for demolition was estimated to exceed $10,000. There had
also been six summary abatements issued to this property since 2007, seven of which went to work
order: to secure the building and the City had to board the building to secure it from trespass,
remove improperly stored refuse and debris, boarding/securing, cut tall grass and weeds, and
remove snow and ice. Mr. Magner stated that the property went through the sale review process
and according to notes in STAMP, it was being converted to a single-family dwelling. A building
permit had also been pulled on March 15, 2010, the same day the performance deposit was posted.
He presented photogxaphs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was a built
in 1905 and was a worker's cottage-style building. The house had good integrity with original
siding, an open porch and it appeared the porch columns were also original. It was one of the larger
structures on the two-block faces which had a lot of infill housing. This property had not been
surveyed, was not located in any potential historic district, and thexe was no potential for historic
designation on its own. However, she encouraged rehab.
Mr. Yang stated that his son purchased the property at a foreclosure sale at the end of December
2009. He estimated that they had completed approximately 60 to 65 percent of the work and had
bids from licensed subcontractors for plumbing, heating and electrical. He believed they would
contract to have the plumbing done first with heating and electrical to follow. It was his
understanding that when he posted the performance bond, that he would be given six months to
complete the repairs to the building.
Ms. Moermond stated that the following conditions must be met by the close of business on June 7:
1) submit a work plan to include estimates of the amount of work done by the property owner,
including supplies, put into repair of the building; 2) submit subcontractor bids; 3) submit financial
documentation indicating financing in the amount of $25,000; 4) the delinquent property taxes must
be paid; and 5) the property must be maintained. If the afarementioned conditions are met, she will
recommend granting time to October 1 to complete the rehabilitatlon of the building.
