176512 Oriffiasl to City Clerk » ` ORDINANCE COUNCIL FILE NO. bite N� n k dia lfo,: PRESENTED BY An ordinance forbidding the salelf, giving' r having in possession any knife, dagger, stiletto- or other similar device of the type commonly known as a switch blade knife, spring blade knife, or push-button knife; providing for seizure and destruction thereof; and prescribing penalties for violations. This is an emergency ordinance rendered necessarf'for the preserva- tion of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. It shall be unlawful within the corporate limits of the City of Saint Paul for any person to sell, offer or expose for sale, give away, or have in possession any knife, dagger, stiletto or other similar device of the type commonly known as a switch blade knife, spring blade knife, or push-button knife. Section 2. Possession of any one of the types of knives, daggers or stilettos defined by Section 1 of this ordinance shall be prima facie evidence that such possession is unlawful, and that such possession is had for the purpose and with intent to violate this ordinance. Section 3 It is hereby made the duty of every police officer of the City of Saint Paul to enforce this ordinance. Section 4. Upon complaint before a judge of the municipal court of the City of Saint Paul, charging any person with' selling or keeping, or having in possession for sale, or having in posses- sion in any place or on any premises, any knife, dagger, stiletto or other similar device of the type commonly known as a switch blade knife, spring blade knife, or push-button knife, and. particu- larly describing the premises or place to be searched, and the things to be seized, the ,judge, in addition to issuing a warrant for the arrest of such person, shall also issue a search warrant, commanding an officer to search such premises or place, and seize and hold, subject to the order of the court, any and all of the aforesaid devices found therein, and make an inventory of the same, and serve a copy thereof, forthwith, on the defendant or person in charge of the premises; provided, however, that the failure to make, file or serve any such inventory shall not invalidate or in any way affect the legality of any search or seizure or proceeding or prose- cution made or had under the provisions of this ordinance. Section 5. If the defendant in any such criminal action, pro- ceeding, prosecution or trial shall be found guilty of violating this ordinance, all of the aforesaid devices shall be destroyed by the Chief of Police of the City of Saint Paul, or under his direc- tion; such destruction to be by burning with acetylene torch, or other method which shall insure the complete destruction of such devices. No search warrant for the search of a dwelling house, solely occupied as such, shall issue except upon oath or affirmation charging that the particular premises described in such search warrant are being used for the purpose of having or keeping in possession any of the things forbidden by Section 1 of this ordinance. Section 7. The term "person," as used in this ordinance, shall mean and include individuals, partnerships, associations, corporations, trustees or receivers. Section 8. Every person who, directly or indirectly, aids, abets, counsels, encourages, hires, commands, induces or other- wise procures another to violate any of the provisions of this ordinance, shall .be deemed guilty of a violation thereof. Section 9. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this ordinance is committed, continued or permitted; and upon conviction of any such violation, such person shall be punishable by a fine bf not more than One Hundred Dollars ($100.00) , or by imprisonment for not more than ninety (90) days, sawiteQ& for each such offense. Section 10. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 11.
