Leonard, Esq., on behalf of Alliance Bank (`Bank"), 55 East 2 Fifth Street, Saint Paul, MN, duly filed an appeal (DSI Zoning File No. 10-124051) from a decision of the 3 Zoning Administrator ("ZA") dated March 10, 2010, which ordered the removal of an abandoned business 4 sign pursuant to Leg. Code § 64.205, which was located on property commonly known as 414 7th Street 5 West, [PIN No. 012823410140] and legally described as Samuel Leeches Addition Lots 2& 3& Ex St 6 Lots 4& Lot 5 Blk 9,; and 7 8 WHEREAS, on April 5, 2010, the Boazd of Zoning Appeals (`BZA") duly conducted a public hearing on 9 the said appeal pursuant to Leg. Code § 61.701 where all persons interested were afforded the opportunity 10 to be heard; and 11 12 WHEREAS, at the close of the said hearing, the BZA, based upon all the files, records, and testimony 13 presented at the public hearing, as substantially reflected in its hearing minutes, determined that there was 14 no error on the part of the ZA when it determined that the subject property had been vacant for more than IS one year and that the business signs for the former business that had occupied the subject site must be 16 removed pursuant to Leg. Code § 64.205 and, accordingly, duly moved to deny the Bank's appeal based 17 upon the following findings of fact, as set forth in BZA Resolution No. 10-124051: 18 19 l. This property was occupied by Northwestern Tire Conipany until July 2008, and has 20 been vacant since then. In December of 2009, a zoning inspector from the Department 21 of Safety and Inspections (DSI) in response to a complaint issued an order to the 22 property owner to remove the abandoned signs on the properry. Subsequently the 23 property owner requested a 90-day extension on the order stating that they had a 24 potential purchaser for the property. That request was granted and the property owner 25 was given until March 24, 2010, to remove the signs. That purchase agreement fell 26 through and the property owner was again reminded that the signs must be removed no 27 later than March 24, 2010. The applicant is now appealing that order stating that they 28 need a reasonable amount of time to resell the property and that the removal of the signs 29 would inhibit their ability to do so. 30 31 2. The code allows a vacant property one year to become reoccupied before requiring that 32 all signs for the discontinued business be removed. This property was vacant for at least 33 a yeaz- and a-half before orders were issued to remove the signs and a further 90-day 34 extension was granted on top of that. That is almost twice the time allotted by the code 35 and is a more than reasonable amount of time to reoccupy the property. 36 37 3. The certificate of occupancy for this building was revoked on July 16, 2008, and the 38 building has been vacant since that time. Section 64.205 of the zoning code is clear and 39 unambiguous. Any signs pertaining to a business no longer in existence must be 40 removed within one yeaz. The Zoning Administrator did not error in the interpretation 41 of the code. Alliance Bank acquired this property in 2008 and has had adequate time to 42 resell or reoccupy the building. \ C�-- Co05 43 44 WHEREAS, Pursuant to Leg. Code § 61.702(a), the Bank, on April 14, 2010, duly filed an appeal (DSI 45 Zoning File No. 10-307183) from the decision of the BZA and requested a hearing before the City Council 46 for the purpose of considering the actions taken by the BZA; and 47 48 WHEREAS, The City Council, pursuant to Leg. The building was originally conshucted with a loan from Commercial State Bank, the predecessor of Alliance Bank. The sign which serves tfie property has been in existence in its present struchue and size for over 20 yeazs and possibly as long as 40 years, and no complaints from neighbors have ever been made to Commercial State Bank or Alliance Bank regarding the sign. The Bank had made loans to the business over the course of many years. Unfortunately, the business failed and the Bank was required to take back the property and attempt to sell it to recoup a portion of its loss. The current recession has been an extremely difficult environment in which to sell commercial real estate. Tha Bank has worked very hard and diligently to find a buyer who would occupy the property with an operating business, bring stable and decent paying jobs to St. Paul, and preserve its tasable property value. The Bank has worked with the Fire Marshall to correct any occupancy license deficiencies. The Bank also visually inspects the exterior of the buildittg on a daily basis. A removal of the sign placards would haue amounted to an advertisement that the building was empty. In December, 2009, a Purchase Agreement was signed, and due diligence was performed by the buyer, but unfortunately, that deal fell apart. However, the Bank and the same buyer signed a new Purchase Agreement on Mazch 26, 2010, and the buyer is very arixious to close on the transaction, get the properry occupied, and bring 10-20 paying jobs into that business. The buyer will operate the same type of business that has operated at that location for 20 plus yeazs. The . new Purchase AgreemenYs only contingency is the Euyer's receipt of satisfactory assurance that the sign will remain. The title issues have a11 been resolved. The Buyer and his agent aze expected to be present and are willing to speak at the hearing on tYus matter. A lazge element of value in the property is the sign that has existed for 20 plus yeazs on the property. The sign is essential for attracting customers. The buyer has informed us that he will not proceed to closing unless the property can retain the sign in its present structure and height. The current buyer is the only parry who has expressed an interest in purchasing the property over the many months it has been on the mazket. Unfortunately, we sincerely believe that if the sale is not closed with the present buyer, the properiy will remain empty for many months and could become a blight on the neighborhood. In fact, if the sign is required to be removed, the value of the pmperty will be greatly diminished and the taY revenues generated from the property will likewise be substantially reduced. Any business sig� which advertises, identifies or pertains to an activity no longer in existence shall be removed by the owner of the property within thirty (30) days from the time the activity ceases existence by removing the sign face, painting the sign face a neutral color or installing blank sign face panels. This provision does not apply to seasonal activities during the regular periods in which they aze closed. If the sign face is not re-used within one (1) year, the remaining sign structure must be removed unless the zoning administrator grants an extension subject to the owner submitting a statement of intent and a reasonable time line for re-use of the sign structure. E. FINDINGS: 1. This property was occupied by Northwestern Tire Company until July 2008, and has been vacant since then. In December of 2009, a zoning inspector from the Department of Safety and Tnspections (DS� in response to a complaint issued an order to the property owner to remove the abandoned signs on the property. Subsequently the properky owner requested a 90-day extension on the order stating � that they had a potential purchaser for the property. That request was granted and the property owner was given until March 24, 2010, to remove the signs. That purchase agreement fell through and the properiy owner was again reminded that the signs must be removed no later than March 24, 2010. The applicant is now appealing that order stating that they need a reasonable amount of time to resell the property and that the removal of the signs would inhibit their ability to do so. 2. The code allows a vacant property one year to become reoccupied before requiring that ali signs for the discontinued business be removed. This property was vacant for at least a year- and a-half before orders were issued to remove the signs and a further 90-day extension was granted on top of that. That is almost twice the time allotted by the code and is a more than reasonable amount of time to reoccupy the property. 3. The certificate of occupancy for this building was revoked on July 16, 2008, and the building has been vacant since that time. Section 64.205 of the zoning code is clear and unambiguous. Any signs pertaining to a business no longer in existence must be removed within one year. The Zoning Administrator did not error in the interpretation of the code. Alliance Bank acquired this property in 2008 and has had adequate time to resell or reoccupy the building. E. It has also recently become a pigeon roost since the Peregrine Falcon boxes on the Xcel smoke stack were removed prior to its demoGrioa Our neia�borhood is now becoming populated by these vetmin who live and breed atop tlils sign. � In addition, the size and scale of this si� is out of character with the ongoing attempts to renovate and stabilize the lristoric character of what is one of the oldest, intact communities of the State's Temtoriai era. As you can see by the attached photographs, the property of 414 7`� St. W, adjoins one of the oldest stone houses in St Paul, at 445 N. Smith Avenue, wluch is currenfly under renovation. (See attached photographs) In addition to the sign, there has been the issue of ovetsized semi-trucks that used the a11ey to exit Armstrong 1"ves when it was in business. There is a record of complaints with the Fort Road Federation of these trucks neazly hitting the stone house, and of the bollazds protecting the gas line being lut as well. So, there aze more than a few concems with 414 W. 7'� St. as a commerciai neighbor on tlris historically sensitive sheet. We are hoping the new use is more fitting and appropriate for the block iYs on, and that it respects the setting its in, wluch is lazgely residential. Alliance Bank may not be aware of these concems so I state them here iu hopes that they get a sense of possibilities for the property beyond the most obvious use as a tire sales wazehouse. They could get creative and could in fact, work with the community through the Fort Road Federarion if that would help facilitate an appropriate use for fhe property. Since we renovated our property at 436 Smith Avenue, the value has increased significantly, with properiy taxes of over $6,000 in 2009. So, we pay a good shaze of taxes in this city and believe it's inherently an issue of faimess as to whose ptoperty is more affected by the presence of the siga. Alliance Bank claims it will be hazder to sell the properly if the sign. is removed, and I and other neighbots azgue that it will be bazder to sell our properties in this neighborhood if the sign remains. The sign is inconsistent with the aspuations and plans for the area. I can say this wi[h certainty as I worked on the committee to develop the District 9 azea wide plan to the City Plan. That request was granted and the properiy owner was given until Mazch 24, 2010, to remove the signs. That purchase agreement fell through and the property owner was again reminded that the signs must be removed no later than Mazch 24, 2010. The applicant is now appealing that order stating that they need a reasonable amount of time to resell the properry and that the removal of the signs would inhibit their ability to do so. 2. The code allows a vacant property one year to become reoccupied before requiring that all signs for the discontinued business be removed. This property was vacant far at least a year- and a-half before orders were issued to remove the signs and a fiu 90-day extension was granted on top of that. That is almost twice the time allotted by the code and is a more than reasonable amount of time to reoccupy the property. 3. The certificate of occupancy for this building was revoked on July 16, 2008, and the building has been vacant since that time. Section 64.2Q5 of the zoning code is clear and unambiguous. Any signs pertaining to a business no longer in existence must be removed within one year. The Zoning Administrator did not enor in the interpretation of the code. The reason that we are here is that this property was for many decades occupied by a family business which ran an automotive retail repair store in that property. Unfortunately that business failed and Alliance Bank was forced to take back that property and has been very hard at work trying to market that property ever since. He thinks that we all realize that the last three and a half years have been difficult years for people trying to sell both residential and commercial real estate. We have been in communication with Mr. Hardwick for the ]ast several weeks and he would like to respectfully differ with Mr. Hardwick's opinion and conclusion that the time that the Bank has had to mazket the property has been adequate, with no results. We are in an unprecedented real estate depression and it has been well known for the last 36 months of so, so the usual rules and time frames probably dodt apply. But with that he would state that it was true that in December of 2009 a purchase agreement was signed with a perspective owner who had the intent of occupying the building and reestablishing an automotive repair shop of the same nature and of the same business that had been there for 20 plus years. Unfortunatel� due to negotiating points the parties were not able to come together it did fall apart. However, within the last ten days a new purchase agreement has been signed with the same prospective owner who is very familiax with the property and has spent some time and resources inspecting and doing due diligence on the property. That owner has told us that he wants to close on the sale of this proper[y within a week. That sign has been in existence in its present state for 20 plus years, it is a valuable feature of the properry and he thinks the realtor is prepared to testify to that effect. In fact if the sign comes dowo not only would he say not on]y would the sale of the properry be inhibited bat it might very well make it impossible to sell that property and put it to its highest and best use. Which is the same use that property has been devoted to for the last 20 plus years. We all know that an empty building sooner or later is a blighted building and is a determent to tbe neighborhood. We now have a buyer who is wi]ling to come forward and tell the commissioners that he would like to close on this building and get it occupied and get decently paid employees in there and support its property value which of course will support the property values of all the surrounding businesses and properties as welL That sign and its existence and retention is crucial of anyone to sel] that property. So we are here this afternoon stating our opinion that the sale of that property is crucial, a solution to the present is really necessary before that sale can occur. It is a problem that cries out for a solution because the alternative is an empty building and continued potential blight in that part of the city. We think that the sale of that building and getting it reoccupied is in the interest of the CiTy, that should trump all other concerns. So we are here asking the Board to not allow that sign to be taken down and destroyed. That sign has been there for 20 plus years it hasdt hurt anybody, no one has complained about it in 20 years, he could understand if it were a new sign that was going up for the very first time, but since it has been there for 20 years it is a vital part of the value of the buildi�g. It really does need to stay. Mr. Tumer is a consultant in the sign industry and is working for the potential buyer and he has asked that he sit up because he can answer technical questions regarding the sign far better than he can. If the buyer gets enough assurance that sign can stay, the buyer has told him and his representatives are here, he is prepared to file with DSI all the necessary applications for permits, for licenses, for any thing else that is needed under the ordinances of the City to be perm'rtted to operate the retail business he intends to put in there. So the buyer is ready to go, we want to get that building occupied. Alliance Bank, does not want to own it any more. It is no secret that with any taken back bui]ding the bank is not coming out ahead here. We don't want to have to pay to have that sign taken down and the superstructure that supports that sign taken down and somehow comeback when we find a different buyer at a different time and apply for permission to re-erect the sign. That would simply be money wasted that simply shouldn't occur. Because we are ready to go, the buyer is ready to go we simply ask that this Board determine that the sign be allowed to stay so we can get that building reoccupied. Ms. Morton asked if Mr. Turner had anything he wished to say? Mr. Turner replied yes. First of all there are a couple of issues with the removal of the sign because of the way it was manufactured some 20 years ago the removal and then reinstalling of the sign at the time of the purchase agreement being executed would be very costly. There are also two matters kind of like the previous case that you heard, that there is not just one thing going on. There is also the issue of the new, although he does not know how new, but there is now a heighY restriction of 37S feet for a free standing sign in that B2 district ThaY would also cause a bit of an issue. First the value of the building is there because it was already there and has been configured for an automotive service. Being that it would be either a Firestone or a Tires Plus that would bring a lot of value to the neighborhood. The signage that is proposed there as we1L There are really three things that are going on. One is a sense of advertizing, two for identification and three far direction. He submitted photos to the Board. When you are seven to ten blocks away obviously it acts like very good advertisement bringing good value to doing good business and commerce. However, when you get to two to three blocks away it becomes a directional sign Yo be able to help people find their way to that business. By lowering that sign to 37.5 feet with the mature trees it would be below the tree line as you are driving from eiYher the east or the west. WhaY is interesting about that is now we have only two things that are going on. One about the sign coming down and back up when in actuality the best thing, he believes, for the community, for businesses, Fi1e #10-124051 Minutes April 5, 2010 Page Three AA-ADA-EEO Employer 10-605 for restaurants, what have you that would enjoy the opportunity to have more patrons there as they aze having their cars worked on and going now and being able to share that kind of tra�c and those customers. This particular sign, as Mr. Leonard has stated, has not had any problems for the last 20 years. So we are asking that it continue to be grandfathered not only at the height that it is at but because the sale is so close that there is no reason to take it down and put it back up. lt would be extremely costly because of the way it was originally manufactured. However, if it would please the Board he thinks that there can definitely be a suggestion made, upon your approval, to remove the sign faces, so as to do what should have been done months ago, to show there is not a business that is currently occupying that location. So that the sig� faces would then be removed, they would then proceed with submitting all the things with the conditional use permit, The business licenses, the what have you and at that time the new sign faces would be installed. Again here we have done a rendering of what those might look like under the Firestone licensing which is a very well established automotive service. He asked the Board to take that into consideration and he knows that there may be some additional paperwork done as far as the signed variance but it would be a very time e�cient to look at both of those issues both the height of the sign and also to remain at its current height so we can proceed with this business. As Mr. Leonard said this business because it was set up for automotive it would be very difficult to be reconfigured for a different type of business and what ever the business would be they would obviously be able to benefit greaHy from that type of sign that is a major part of the va]ue of the business. Mr. Ward questioned Mr. Leonard who mentioned that this purchase agreement is on the table right now imminent to closing. How imminent is this closing7 Mr. Leonard stated we have it scheduled for one week from today April 12`�. The only condition on closing is that the buyer needs assurance that the sign is going to be ok for him to use when he buys the building. Mr. Ward stated so based on what he is hearing, the only thing that would stop a closing is that the sign would be more or less a deal killer. All of the due diligence had been done on the buyer's part and on the Bank's side of things underwriting is complete, title work is completed, and you are ready to go to the cbsing. Mr. Leonard replied that is correct. This question is for Mr. Turner, you mentioned that removal of the sign would be very costly, and in allowing the sign to stay this sign adds considerable value to the properry. Mr. Turner replied correct. Mc Ward continued what basis do you have that states that? Was there an appraisal done, was there an evaluation done on removal or replacement of the present sign to a sign that would be equal in size and heighY, because it came down you would have to get additional variances, etc. Mr. Turner replied yes, those are a number of the factors, first of a11 because of the way the footings are done, they are not done how they would normally be done today with gusset plates and mounted in the way that it could be removed and bolted in place. These are actually submerged in concrete so to cut those off, all the re-engineering would have to be done, everything would have to be redone to put that back up even to put it up at 37 feet. Because of the way the structure was built years ago, today's signs would not be built that way. So that would be the Yhousands and thousands of dollars not only in administrative costs but also in construction costs and what have you_ Some of the construction material might be able to be reused, but there is a considerable amount of cost as far as being able to take that down and put it back up. Which brings up the second issue which is the height, when your looking at real estate it is location, location, location, and in business it is timing, timing, timing, as Mr. Leonard stated the state of our economy the time is tough to be abie Yo sell any commercial or residential type business. This type of business that comes along with a good name like Tires Plus or Firestone he thinks adds a lot to the File #10-124051 Minutes April 5, 2010 Page Four AA-ADA-EEO Employer 10-605 community number one and secondly those rypes of organizations require a certain amount of visibiliTy and signage for them to be able to occupy a location, Because of that being done already with the different franchises either Firestone or Tires Plus this would be an approved location for them to occupy. If this was to come down that would be a costly unfortunate s9tuation. But to not allow it to go back up to the 55 foot height would be a deal breaker. Now we have 20 people who will not be employed and all the other things that come along with not having that business. Mr. Ward stated that we all understand that. Mr. Courtney stated that it has not been spelled out to him but his assumption is that if these signs come down they probably are not going to go back up? It is going to be a battle. Mc Leonard replied he thinks that is correct. If they have to come down that is a lot of money and to put it up might be an awful lot more money as was stated earlier, the use of that building may only iend itself to an automotive caze facility. If that sign comes down he does not know who is going to want to invest the money to put it back up and do something else with the properiy. Mr. Courtney does not know if this has been spelled out, but he assumes that the law has somehow been changed and you are not going to be able to build the signs that high once they are taken down. Mr. Leonard replied without a vaxiance that is correct. Mr. Courtney stated it looks like today you have a lot of opposition because he is sure people do not ]ike these high signs. If you had until the end of the month you would be happy with that7 Mc Leonard asked what? Mc Courtnay stated adequate time to sell, until April 3Q 2010. Mr. Leonard stated that would be helpful but he thinks that Mr. Hardwick's office need to process licenses and permits and all that sort of stuff as well. Mr. Cow asked for the sign? Mr. Leonard replied yes. Ms. Bogen requested that Mr. Leonard cite your research that lead you to make the conclusion that no one has complained about this sign for the last 20 years? Mt. Leonard stated that he has not done any research, the bank has not received any complaints about it unti] the complaint was filed in December, they were not aware of any complaints. Ms. Bogen further questioned you are not aware of any complaints made over the past 20 years to the City or to District Council? Mr. Leonard replied that is correct. Mr. Ward asked Mr. L,eonard at the time that the bank received the property back and it is now a REO commercial properry and having dealt with a lot of these properties before and the Ciry requiring that Yhe signage be removed, why wasdt there an attempt to remove the panals or at least try to cover them with a tarp or something else and then just leave this in the present condition for another year, what happened there. Mr. Leonard stated that the banks marketing efforts were such that they felt with the sign fascia being shown it was more marketable that way than if the panels had been removed with a blank sign. To be more to the point the bank did not have the awareness that there were those sorts of deadlines for removing the panel and he also thought that the bank thought if you remove the panels and have a blank sign there that is an advertisement that Chis property is blighted and it does not do the neighborhood any good. Mr. Ward stated but here we sit Mr. Leonard said with a buyer, hopefully. Mr. V✓ard stated that is the caveat, hopefully. Mr. Leonard stated all we can do is try to sell it to the hest of our ability and we have been doing our damedest to do that. File #10-124051 Minutes April 5, 2010 Page Five Jim Callahan, 1700 Livingston Avenue, stated that he is a real estate broker representing Mr. Larry Dimmen who has a purchase agreement on this properry, as a contingent on that purchase agreement the sign is a vital issue. If the sign goes the purchase agreement goes. He contended that any time something is foreclosed it takes months and sometimes a year for that foreclosing agency to take the property back. AA-ADA-EEO Employer 10-605 He is not defending the bank but he is hying to state some rules that everybody should know. So it says in the complaint that it has been vacant for three and a half years, in affect the bank hasn't taken possession, maybe in the last year or year and a half. So the timing is certainly longer than it should be but it wasn't three and a half years. Mr. Dimmen, the buyer, has eleven Tire's Plus stores in Minnesota and W isconsin he runs a very good operation. He is talking about a major investment in bringing this property back up to code. Mc Ward stated that he wanted to hear from Mr. Callahan not from the bank, but from him because he has a fiduciary responsibility to his client, what is your certainTy that should this be granted that your dient can perform on this purchase agreement? Mr. Callahan stated he can perform, he is pre-approved. There was opposition present at the hearing. Becky Yust, 256 Goodrich Avenue, stated that she has lived in her home since 1974 and she thinks that the sign never should have gone up in the first place. She submitted photos to the Board pointing out that the photos of the sign were taken from her childreds bedroom showing the Michelin sign towering over the two-story house to the north of them. She is concerned with the notion that this sign is either going to make or break a business in the community. She understands that it can make or break the sale but it does not make or break a business. This business was not doing very well for many years and just across the street is Bonfe's Auto service, does not have a sign that towers over the neighborhood and Bonfe's was just voted in the top ten nation wide of such service facilities. That is a successful business, this one could be too without a sign that doesn't belong on West 7'" . She is also concerned with the notion that because of the economy the City should change it's rules, is not fair to all of us that abide by the rules in good times and bad times and yes it is diff'icult right now but if this sign is the only thing Chat is going to make a business, she has her doubts that the new business will survive anyway. If the buyer is going to invest thousands of dollars to bring the property up to code it seems to her that some of those thousands could be by taking down the sign and bringing it up to the code of aesthetics within the community. Jeannie Wiegum, 1647 Laurel Avenue, stated that she is one of the citizens that worked with the City staff and other members of the community to actually make the law that required certain limitations on these abandoned signs. First off she wanted to thank staff for enforcing, it is pretty easy to do nothing and she appreciates that they have not taken that course and have really tried to enforce Ciry ]aws against clear scoff laws. She thinks it is pratty ridiculous to have people sit here and say we didn't have the opportunity or know that for over Three years that we should have covered that sign. We should think about Lloyd's Garage on Grand Avenue which is a highly profitable business, very intaresting, fits in with the neighborhood, does not have an enormous sign like this, and does not need it, they get business because they do good wark, that is what draws people in. Signs can be helpful, can be attractive, and can contribute to the appearance and vitality of the community. This sign does none of those things, it File #1Q-124Q51 Minutes April 5, 2010 Page Six certainly has not been helpful, it is anything but amactive, and it decreases the appearance and the vitality of this neighborhood. It is overly huge for this sight, it is out of character with the neighborhood and it diminishes our community. She wishes to support the staff recommendation. Jim Sazevich, 454 Smith Avenue North, sYated that he lives within a block of this sign and has for 25 years. The height he wanted Yo show the Soard is probably his height directly across the street is Degidio's AA-ADA-EEO Employer 10-605 restaurant that has been doing a booming business since the 1930s they have no problem with their signage and again it is probably as high as he is directly across from this monstrous sign in our neighborhood. Just to give a little bit of history about that sight, Northwestem Tice and talking about a good neighbor, there were four single frame houses before Northwest Tire and a three unit framed row house that some of his relatives actually lived in, where that sign sits today in the 400 block of West 7`" Street. He showed the Board an old photo of the row house. This is a story of loss not an addition, something that added and contributed to ouc neighborhood it is a story of ]oss. Once that sign went up, once Northwest Tire built their main building there in 1966 every property around it was devalued and within a block we have probably 10 of the oldest standing structures within the entire city of St. Paul. Three of the oldest stone structures, limestone structures, the entire district has been looked at for years as our next historic district in the City of St. Paul having the greatest concentration of pre-civil war housing. Becky who just spoke talked about looking from her window, what she diddt tell you is a beautiful restored house from the late 1870s that she and her husband invested in 30 years ago in that neighborhood. Their investing in the neighborhood attracted dozens of others and we are all here contributing to this neighborhood and we have a realtor and a supposed new property owner that haven't communicated with any of us, their immediate direct neighbors. Coming in the neighborhood and saying that they do not know anybody who is objecting to this sign, we don't know of anyone who has ever opposed this sign. Is that a good neighbor, is that what a new neighbor should be doing? A neighbor or anybody who is actually interested in the community that they are going to invest in talks to the neighbors, and lets them know what they intend to do with that sight that has been setting vacant all these years. We aze just asking you to do what is right, do what the law says. This is an abandoned sign that should have been dealt with a long time ago. He for 25 years has been picking up the property there along West 7'", picking up trash from that properry, This sign is an eye sore, it is blight, it was a loss to our community when it was erected and you can really help us as a community by getting rid of it. Paulette Myers-Rich, 436 Smith Avenue North, stated she lives directly across the street from Northwest Tire, the side of their building. She had submitted photos showing the views from inside of her home, her patio she wants to speak on the historic character of this neighborhood. She and her husband moved into this community and purchased a blighted building eight years ago, it was the Catholic Charities Furniture Warehouse, it was all boarded up and it was a former auto garage. We now live and work in this building and we received the Heritage Preservation awud for that work. We were attracted to the neighborhood because of the work of people like Jim, John and Becky Yust and many other people that aze not here today but have also sent letters. It is a community full of people who care very deeply about the historic part of the ciry, it is a vibrant lively neighborhood there is a deep commitment to turning this neighborhood around and restoring its character. That is undenuay despite the fact that we are in a tough time. A recently moved and restored home in our neighborhood just sold very quickly despite the fact that homes are not selling because of the quality of the housing and the potential for that neighborhood. File #10-124051 Minutes April 5, 2010 Page Seven We can see that sign everywhere and it is not an asset to our communiTy, it is blight, it devalues our properry and it takas away from the character of one of the stone houses that is curcently being restored by a Historic Preservation minded neighbor who lives in the neighborhood and has purchased that home to restore it. That sign towers over that stone home she hates to think of what its going to mean to the community if we become a Historic Preservation District and yet we have this huge sign which she believes diminishes the value of her property which actually she has put a building back on the tax roles and has increased the value of her neighbors properties and this new neighbor who's moving in with Tires Plus or a tire facility will in fact diminish our value. ln addition when Northwest Tires was their semi-trucks were AA-ADA-EEO Employer 10-605 using that alley, they could barely fit through that narrow space and were often jeopardizing vehic3es on ihe street and the stone structure. They were leaving piles of tires in the alley, a lot of garbage if they really were not a good neighbor at all. As far as that place being only used as an auto p{ace, that is really showing a lack of imagination, she lives in a former auto garage herself and many of the restored bui]dings on Grand Avenue are adaptive reuse buildings that were auto dealerships and auto garages, and as you know in downtown St. Paul a number of adaptive reuse projects that were once warehouses that are now lovely reuses and West 7`" could easily take on another restaurant, garden supply center, any number of reuses for that sight other than an auto use. She just thinks it is the most expeditious thing for the realtor and the bank right now but in the long term use of the community and the character of the neighborhood and the direction that we are trying to move the neighborhood another use would be even more suited. If this tire place does go in she would ask that some restrictions about semi-truck traffic in that alley and tire storage should be put in place because those were huge issues and there are complaints on recoxd with the Fort Road Federation over years about those problems. She requested that the Board hold to the removal of this over sized sign. Andres Hine, 757 Armstrong Avenue, stated he lives about one mi]e from the site. Alliance Bank has been a member of the community for a long time and it hurts him to hear them come up here and act like they are a victim. When the nature of banking is to invest in proper[ies that you think will succeed and you take your changes whether you are going to make money, just as he does when he invests his money. We all have to assume a risk and Tires Plus we are also familiar with them and just because they are a successful business does not mean that they are more important than we are. He personally will not go back to Tires Plus because he had a bad experience, so he can tell you that they are not model citizens. The law is the law and as far as he understands non-conforming means it does not conform. There is a lot of momentum on West 7`" Street without a tire place. His neighbors behind him and many more have done a lot of work to make West 7`" Street what they have over the years and as Paulette said if you think you need a 55 foot sign to be successful your not being very creative. There are other tire shops that manage to succeed as the banker himself said, without signs like these, so presumably they can make a go of it with a legal sign. They clearly knew that tliey needed to take the sign down and they just blatantly ignored the concerns of the neighbors for their own selfish reasons, he finds that really offensive. Value means a lot more to us in the neighborhood than money, and certainly a bank's money. The Fire Station number 1 will be empTy this month and it will be knocked down and he thinks people will be clamoring for an empry lot there, so he suspects that they are a little nervous about having a Iittle competition in the neighborhood. That properry is super valuable whether there is a sign on it or not. One thing that hasn't been said is how much the sale price is, another thing that hasn't been mentio�ed is how much it costs to remove this sign, which is Yhe law they have to remove it. The good File #]0-124051 Minutes April 5, 2070 Page Eight news for the buyers is that when the sign is taken down, presuma6ly the seller wi11 reduce the price by the price of the sign removal that seems fair to him. John Manilo, 1335 Beachwood Place, he is a commercial real estate broker and he chairs Scenic Saint Paul, and he is thinking that when the bank made this loan and doing its due diligence had to be aware of restrictions and risks in making that loan and understanding if they got the properry back and it sat vacant for a while the sign would be affected(?) particularly if the sign is as important to the property as they claim, he has a problem with thaY, his bigger problem he thinks would be the president that would be set. It sounds like to him that it comes dovm to money. The argument is that it is alright to understand the non- conforming use laws in this city and adhere to them unless it means someone can make or benefit AA-ADA-EEO Employer 10-605 financially from not having to worry about that law and that would set an awful precedence for the city so he requested that we adhere to the rules that are set out, people that ]ive in the city have to abide with those. They make those investments understanding that the City is going to enforce and that is what we would ask of Si. Pau3 as well. Mr. Leonard stated that the Bank has great respect for all the parties here and sometimes these issues when they do impact where we ]ive and our perceived pocket books those issues are very important to people and we don't intend to minimize the importance of those issues at al] but he will make a couple of comments. One of the speakers indicated that the West 7`" Street azea where this properry is located is vital and vibrant even with that sign being there and having been there for 20 plus years. Some times the discussion by the commentators sort of drifted into being concerned that they are in a residential area that is adjacent to a area that is zoned for business and that has an impact on their residential area. This has been a B2 area for a long time and that sign has been there for a vary long time. With respect to the ability to sell thaY property there have been no offers made on that property other than by Mr. Dimmen in the eighteen months that properry has been for sale. He thinks that the market place talks to us and it is saying that without that sign there, and Mr. Dimmen has made it clear he needs and wants that sign or there is no deal. That properry unfortunately the value is going to plummet greatly and it may stay vacant for a very bng time and that isn't in anybody's interest. Lastly he is going to state that he thinks that they have a safety issue here because of the trees tbat are on the site, will block the sign if it is at the new ordinance level of only 37.5 feet, so people looking for the business won't be able to see the sign, they will be driving down West 7`" Street which is a busy street looking around trying to find and locate the business they are going to that sign Yhey wop't be able to see it and he thinks that could cause a traffie hazard. He thinks that the best outcome for the City of St. Paul and that neighborhood as a whole is to get a vibrant business in there occupying it and get that building back spiffed up so it does not become a further blight on the neighborhood. Hearing no further testimony, Ms. Morton closed the public portion of the meeting. Mr. Courtney asked Mr. Hardwiek is that correct is that what the new law is 37 feet7 Mr. Hardwick replied yes, the new code allows a sign that is 37S feet. Ms. Bogen stated that the law is pretty clear here the building has been vacant for about 20 months and about 19 months ago those signs should have been covered up and a month ago this should have been File #10-124051 Minutes April 5, 2Q1Q Page Nine down and bank has gotten a three months extension on the orders that he got from the CiTy earlier this year. She thinks that the ability of tha bank to sell that property if it is dependent on that sign it is too bad. She is tired of people coming in here and saying I didn't lrnow I couldn't build that garage before getting permits, oh fine you can keep your garage. I didn't know I had to take that sign down, fine you ca� keep your tall sign. She moved that the zoning administrator did not error in determining that the property has been vacant for more than a year and the signs must be removed and she also advises the zoning administrator not to give the owner any further extensions. Mr. Courtney stated that he has to agree with Mr. Leo�ard, this is a different time and it is tough to se11 the properry and if we were talking about the difference between a sign that is 55 and a sign that is 20 feet or something like that he is not convinced Yhat 18 feet is such a blight that the sign has to go down. AA-ADA-EEO Employer 10-605 Admittedly he does not live in the area, he has been by there a million times and he has never noticed it to be such a blight that it needed to be removed. Accordingly he will oppose the motion. Mc Ward stated that he would like to add fufther comment to the si� issue, even if the sign was ordered to come down, there are rules and guidelines that the bank is going to have to go through in order to get bids and time to respond to those bids it could be the end of the months before the sign actually comes down and the broker as wel] as the banker said the sale is imminent and it could close by the end of the month. So what if it closes by the end of month and the sign is ordered to come down aze we now affecting the sale and are we putting ourselves in jeopardy of a possible suit? Mr. Warner stated that every application that comes before this board and you make a decision on, if there is opposition to it there is always risk that there might be potential litigation so what you need to do is make a decision whether it is in favor of something or opposed to something always provide a factual basis for that decision. In this particular appeal there is a factual basis laid out Yhat supports the zoning administrators decision ifyou disagree, ]ay out some factual reasons why it is wrong. If you agree with it you need to approve it. Ms. Bogen stated that she wanted to comment on Mr. Ward's comment, they say they have a buyer and that closing is immine�t and if this is the same buyer that they were going to be imminently selling to in January and that fell through, she does not think that there is any guaranCee that it is not going to fall through now. They haue had this on the market for 18 months, during that 18 months they should have both shrouded and taken down the sign, they have done none of that and she thinks that they have been keeping that sign up in bad faith and it needs to come down. Whzther it affects their sale or not that is not our problem, our problem is that this sign was supposed to be taken down that is what the law says, the zoning administrator gave them some additional time but now it is time for it to come down. Mr. W ilson stated that the comments made about destroying the foundation looking at the sign they only need to cut off the poles and take it down, it doesn't have to come down to the Foundation just the sign, cut the poles off. Mr. Hardwick commented first off the code says the entire structure has to be removed right down to the ground. You can't cut it off at 37.5 £eet. Mr. Wilson asked what if he sells it tomorrow? In addition to that the ]icenses, it will require a general repair garage license that also requires notification to the neighborhood and City Council approval, so it is presumptuous of this Board or by anybody, first of all that the Planning Commission is going to approve any automotive use for that properry and secondly that the City Council is going to grant any licenses for that particular use. So regardless of whether you give them more time or not the City Council may deny it anyway. Mr. Courtney stated that he just cannoY imagine that it could have been less of a blight if it had somehow been covered up for what ever period of time. Merely looking at the Michelin or whatever it is he does not think that in itself makes it a blight. He thinks it is unfair to characterize the actions of Alliance as bad faith somehow, they want to sell the property, that is what they are here for. He does not see that as bad faith. He also asked Mr. Leonard specifically if we gave him another 30 days if he would live with that and he thinks he said yes, if he doesn't get it done that it is his problem. We were ordered to "remove the sign or bring it to a state where it would not be considered abandoned" within 30 days. Since we had a potentiai buyer far the property, we requested and received an estension through March 24�', and another 30-day eactension through Apri124�', (Attachment A) which was approved by Yaya Diatta, Zoning Inspector. Ailiance Bank had a signed purchase agreement and clasing date scheduled for Aprit 5, 2010. Meanwhile, on March 10�`, we received a notice from the City stating that all signs on the property assocsated with the discontinued business needed to be removed by March 24`�` (Attachment B). Tf the original ea�tension to April 24�' would have been upheld, the property would have been sold and akeady occupied. (See timeline, Attachment C). Alliance Bank has been working diligentiy to sell the property. The original purchase agreement was dated December 23, 2009 and during negotiations it was revised and signed on March 26, 2410. (Attachment D). The only contingency in the revised purchase agreement is Yhat the transaction is subject to the buyer obtaining satisfactory assurances from the City of St. Panl that removal of the sign wiil not be required. The buyer plans to operate an automotive and tire service similar to the business that was conducted at that location for the past 40 yeazs. Therefore, at this juncture, it makes sense to retain this sign for the new owner. Once the sale is completed, the sign will be "brought to a state where it wIll not be considered abandoned" as originally requested by the City. Furthermore, in July 2009, Aliiance Bank reoccupied the space and was issued a Certificate of Occupancy (Attachment E). According to the City of St. Paul's vacant building list (Attachment F), as of 4/23I1 Q the property in question is not listed as a vacated property. Alliance Bank will continue to use the space until the time that it is sold. The site currently is an income producing property. Since the property is occupied, this is not an abandoned sign. If Alliance Bank is forced to remove the sigtt the pending sale will be canceled and the property will remain vacant for an indefinite period. If the City Council allows the sign to remain, however, the property will be occupied by a viabie business, bring an immediate 18 paying jobs to the community, create greater customer traffic to the area, and generate tax revenue for the City. In addition, the new owner will be making enhancements to the property which will support construction jobs and will beautify the neighborhood. 10-605 On behalf of Ailiance Bank, I request that you reconsider the demand for removai of the sign. TITLE, TAXES, CLOSING COSTS 4.1 Seller has fumished Buyer with a commitment (the "Title Commitment") for an Owner's Policy of Title Insurance for the Property (the "Title Policy") issued by Land Title, Inc., for itself and as agent for Chicago Title Insurance Company ("Title") in an amount equal to or greater than the Purchase Price naming Buyer as proposed insured and insuring that fee simple title to the Property is vested in Seller, subject only to Permitted Exceptions (as defined in Paragraph 43(iii) below). Buyer shall have until noon of the 14�' day after the Effective Date to advise Seller in writing of any objections to marketability of title. Buyer shall be deemed to have waived any title objections not made within the period specified above. As a resident of this neighborhood I have found this sign to be inhusive and an eyesore. My concerns are outlined below. ♦ The sign is excessively tall and better suited for a business along a freeway than a city street. I have tried to find compazable signs in our azea, and the oniy sign that seem truly similar is the Sears sign posted on Interstate 94. Located along West 7 street and as part of a residential area, there should not be a reason for a freeway-style sign at a business in this neighborhood. ♦ This sign is excessive when compared to the signs of other businesses along West 7�' street. I would like to see this�roperty held to the same standards for signage as all other businesses along West 7 street. ♦ I live more than one block away and am able to see this sign from my 2nd floor windows and sometunes from my backyazd. This is intrusive aud it is unnecessary for any business to have signage that is so prominent. I hope that this property is sold and becomes an asset to the community. However, a business should be able to be successful in our area without having this lazge and intrusive sign. I also understand that Alliance Bank is the owner and has requested that the sign remain standing so it will be available to a new business when the property is sold. As a long-term area business owner, I support the retention of the sign. It has been in place for at least the past 20 years if not much longer, and is needed to bring visibility for any basiness that plans on operating at that location. If the sign is removed, it will cause Alliance Bank an unnecessary expense and may potentially inhibit the sale of the property. Alliance Bank has been a supporter of Saint Paul for generations. Their contribution has led to the creation and ex�ansion of many local businesses, which has improved the vitality of the City. In fact, Alliance Bank just received a"Celebrate Business Success" award from the Saint Paul Area Chamber of Commerce eazlier this year for their contribution to Saint Paul. Alliance Bank's intent has always been, and continues to be, to help the City remain economically viable. T request that you reconsider your demand for removal of the sign. Not only will it lead to an unneeded expense, it will cause the property to become less desirable. In this economie downturn the property cauld remain vacant indefinitely, which would have a direct negarive impact on my business. As council members here to serve the City, I'm sure you would agree that the entire neighborhood is best served by having the property occupied.
