WHEREAS, the City of Saint Paul has no interest in the
award from the State Highway Department for the tract of land
known as Parcel 41D, described as
The West Two Hundred Feet (W.200) of North One Hundred
(N.100) feet of Lot G of Vadnais Lake Villas,
which is being condemned by the State Highway Department,
now therefore be it
RESOLVED, that the Commissioner of FinanceTMs hereby
authorized and directed to endorse said check upon its presen-
tation to him by the law firm of Tracy, Sinclair and Rowland.

Gentlemen:
I have received a communication from Mr. Frank W.
Gallagher, Superintendent of of Water Supply, with regard
to the Water Board's interest in Parcel 41D, described as
'West 200 feet of North 100 feet of Lot G of
Vadnais Lake Villas ,
which is being taken by the State Highway Department by dondem-
nation for S.P. 6236-10 (10-62) 902. The only interest of the
City in this property is that which came down from the Saint
Paul Water Company in 1882 because of a flowage right conveyed
to that company by 103 Deeds 38, viz: the right to flow Lot 1
and other lands in Section 31, T.30, R.22, to the heights
which water could be raised by a certain dam. The lands
comprised in mentioned parcel 41D are at such elevation that
they would not be affected by mentioned flowage rights.
Therefore, in my opinion, the City has no monetary interest
in the award for this land and I recommend to the Council that
they pass a Resolution authorizing the Commissioner of Finance
to endorse the check which has been issued on this piece of
property, said check being in the possession of the law firm
of Tracy, Sinclair and Rowland, and being made payable to their
client and the City of Saint Paul, jointly.
