This is in the matter of the appeal of Gregory and Rosemary Plante to establish a new building line affecting the property adjacent to the southeast corner of Humboldt and Sidney. The property is des- cribed as lots 12, 13 and 14 - Lawton's re-arrangement of block 149 and parcel "E" of West St. Paul Proper. The zoning is "B" residence. The property is presently vacant. It has a frontage of 140' on Sidney and 120' on Humboldt. The applicant is proposing to divide the pro- perty into two 70' lots which will front on Sidney. To accomplish this, it is necessary to re-orient the frontage of these lots which under the present Zoning Ordinance, require a set-back of 28' from Humboldt and 5' from Sidney. The applicant is requesting that he be allowed to establish a building line of 4' along Humboldt and a 24' building line adjacent to Sidney. There is a single-family home to the south set back approximately 6' . from Humboldt which is the nearest property which would be affected by this change. There are single-family homes across a 20' alley to the east which face on Gorman which would not be affected by this proposed change inasmuch as they are set back 7' from Sidney. The land is vacant across Sidney to the north: there are four single-family homes across Humboldt to the west. Three of the owners of property adjoining the premises under consideration have acquiesced to this proposed building line change. Field investigation discloses no objection from the standpoint of this intent and purpose of the Ordinance or its affect on adjacent \) land use. Therefore the Zoning Board recommends that this appeal be granted °. to establish a 24' building line on Sidney St. for all of lot 14 and a 4' building line along Humboldt for all of lot 14 and the north 20' of lot 13. These lots are situated at the Southeast corner of the intersection of Humboldt Avenue and Sidney Street. The plat of Lawton's Re-arrangement. shows that each of the three lots faces in a Westerly direction on Humboldt Avenue, with each of them having a frontage of 40 feet and a depth of 140 feet. Lot 14 is the most Northerly of the three lots. Plans are now being made for the improvement of those three lots by the construction of two dwellings, each of which would face in a Northerly direction on Sidney Street, with one of them being situated on the East one- half of the property and the other on the West one-half. We understand that the building zone ordinance contains provisions under which the set-back line on Humboldt Avenue as applied to the three lots is 28 feet Easterly of Humboldt Avenue, and that the set-back line on the Sidney Street frontage of the property is 5 feet. Those provisions of the building zoning ordinance make it a practical impossibility to develop the property along the lines contemplated. To make such development possible, it is respectfully requested that you adopt whatever resolution or enact whatever ordinance may be necessary to change the building set-back line on the Humboldt Avenue frontage from 28 feet to 4 feet, and changing the building set-back line applicable to Lot 14 on the Sidney Street frontage to 24 feet. We believe that the granting of this application will be entirely consistent with the developments which have already taken place in the immediate area, and that none of the surrounding properties will be adversely affected by the granting of the petition and the development of the property along the contemplated lines.
