WHEREAS, Alfred H. Schroeder, City Architect, having requested
the City Council to hold a public hearing to consider any complaints
about the expense incurred by the City of Saint Paul in removing
a dangerous structure at 794 Case Street, more particularly
described as Lot 6, Block 21, Arlington Hills Addition, the City
Council held a public hearing on April 10, 1956 to consider the
expense and to confirm the amount thereof, and
WHEREAS, it appears that the City Council, pursuant to
Council File No. 173458, approved June 7, 1955, published
June 11, 1955, set a public hearing to consider removing the
dangerous structure, and the City Council by Council File
No. 173917, approved June 29, 1955, published July 2, 1955,
ordered the wrecking by and at the separate cost and expense
of the owner, occupant, or other person in control thereof,
and the City Council by Council File No. 174290, approved July
22, 1955, published July 3o, 1955, directed the Commissioner
of Parks, Playgrounds and Public Buildings to enter upon the
premises and wreckand remove the building thereon and do any
and all things therein necessary for the protection of life,
limb and adjoining property, and that the City of Saint Paul
has incurred the expense of $806.67 in removing said structure,
and

WHEREAS, it appears that John F. and Rose M. Wiplinge t. 81dg.
are the owners of the premises; be it Paul,

RESOLVED, that we, the City Council of the City of
Saint Paul, do hereby confirm the amount of $808.67 to be the
fair, true, and reasonable amount for such services incurred in
removing the dangerous structure, and be it
FURTHER RESOLVED, that the City Clerk be directed to file
in the office of the Register of Deeds for the County of Ramsey
a statement of expense incurred by the City for the purpose of
securing a lien on the property, pursuant to the Building Code.-

Gentlemen:
A statement of expense has been filed with the City Clerk on
this date for the purpose of creating a lien on the property
known as 794 Case Street, St. Paul 6, Minnesota, on Lot 6,
Block 21, Arlington Hills Addition. This property is listed
in the name of John F. & Rose M. Wiplinger, 794 Case Avenue,
St. Paul 6. These parties are represented by Edward Spring-
er, 1220 Minnesota Building, St. Paul 1.
In this matter, the following resolutions were adopted by the
City Council:
C.F. 173458, adopted June 7, 1955 (published June 11, 1955)
set a hearing at ten A. M. on June 28, 1955.
C.F. 173917, adopted June 29, 1955 (published July 2, 1955)
ordered the wrecking by and at the separate cost and expense
of the owner, occupant, or other person in control thereof.
C.F. 174290, adopted July 22,1955 (published July 30, 1955)
directed the Commissioner of Parks, Playgrounds And Public
Buildings to enter the premises and wreck and remove the two
story four apartment building thereon and do all things there-
in necessary for the protection of life, limb, and adjoining
property.
C.F. 174758, adopted August 26, 1955 (published September 3,
1955) approved the specifications prepared by the City
Architect for the wrecking of this building and authorized
the Purchasing Agent to advertise for bids.
C.F. 175184, adopted September 28, 1955 (published October 1,
1955) approved the award of the contract for wrecking to the
Rose Bros. Lumber & Supply Co. , Inc. , for the sum of $772.00
in accordance with the specifications and formal bid No.
5349.

C.F. 175284, adopted October 5, 1955 (published October 8,
1955) provided that the wrecking expense of $772.00 and
the expenses of the Department of Parks, Playgrounds And
Public Buildings in connection with the condemnation in
the amount of $34.67, making a total of $806.67, be paid
out of General Fund Item 31 G 23, and in the event that
this sum proves collectible from the owner, same is to be
credited to General Fund Item 31 G 23.
This building has been wrecked and Registered Bill No.
4-1450 was mailed to the owner, John F. & Rose M. Wiplinger,
c/o Mr. Edw. Springer, 1220 Minnesota Building, St. Paul 1,
on January 11, 1956.
We are requesting you to hold a public hearing with ten
days notice to consider any complaints about the expenses
incurred and to confirm the amount. The Council resolution
confirming the expenses should end with a directive to the
City Clerk to file a statement of expense for the purpose
of securing a lien on the property.

The expense was incurred by virtue of the wrecking and
removal of the dangerous apartment building therefrom.
