Schroeder, City Architect, having requested the City Council to hold a public hearing to consider any complaints about the expense incurred by the City of Saint Paul in removing a dangerous structure at 691 Butternut Street, more particularly described as Lot 19, Block 1, Stewart Avenue Addition to the City of St. Paul, Ramsey County, Minnesota, the City Council held a public hearing on April 10, 1956, to consider the expense and to confirm the amount thereof, and WHEREAS, it appears that the City Council, pursuant to Council File No. 173106, approved May 12, 1955, published May 14, 1955, set a public hearing to consider removing the dangerous structure, and the City Council by Council File No. 173617, approved June 15, 1955, published June 18, 1955, ordered the wrecking by and at the separate cost and expense of the owner, occupant, or other person in control thereof, and the City Council by Council File No. 174867, approved September 2, 1955, published September 10, 1955, directed the Commissioner. of Parks, Playgrounds and Public Buildings to enter upon thy '` premises and wreck and remove the building thereon and do any aid all things therein necessary for the protection of life, limb and adjoining property, and that the City of Saint Paul has incurred the expense of $398.91 in removing said structure, and WHEREAS,it appears that Ace Packing Materials Company, 691 Butternut Street, Saint Paul 1 Minnesota, is the owner , of the premises; be it ):( RESOLVED, that we, the City Council of the City of Saint Paul do hereby confirm the amount of $398.91 to be the fair, true and reasonable amount for such services incurred in removing the dangerous structure; and be it FURTHER RESOLVED, that the City Clerk be directed to file in the office of the Register of Deeds for the County of Ramsey a statement of expense incurred by the City for the purpose of securing a lien on the property, pursuant to the Building Code. This has reference to the condemned structure at 691 Butternut Street, owned by Ace Packing Materials Company, whose last known address is 691 Butternut Street, St. Paul 1, Minnesota. As you will note, the final paragraph directs the City Clerk to file in the office of the Register of Deeds a statement of expense incurred for the purpose of securing a lien on the property. Council C.F. 175889, adopted by the Council November 29, 1955 (pub- lished December 3, 1955) provided that the wrecking expense of $350.00 and the expenses of the Department of Parks, Playgrounds And Public Buildings in connection with the condemnation in the amount of $48.91, making a total of $398.91, be paid out of General Fund Item 31 G 23, and in the event that the sum proves collectible from the own- er, same is to be credited to General Fund Item 31 G 23. The building was wrecked December 15, 1955 and Register- ed Bill No. 4-1449, dated January 11, 1956, was mailed to the owner at his last known address, Ace Packing Materials Co., 691 Butternut Street, St. Paul 1. We are requesting you to hold a public hearing with ten days notice to consider any complaints about the expenses incurred and to confirm the amount.
