Gentlemen:
This office , as well as the Health Department, has had
considerable correspondence with Louis and Florence
Akim, 322 Atwater Street, with reference to the unsani-
tary condition of this building.
This is a frame duplex , 1V stories high, approximately
26 by 18 by 16 feet. It is located on Lot 3, Block 2,
Pacific Addition. Our inspector reports that the first
floor sink, bathtub and water closet are run into a cess-
pool. There are no stacks on the vents or any of the
fixtures. No traps on bath waste and cement joints are
used on the soil pipe. Second floor is provided with a
chemical toilet. There is a dewer in the street.
The building has been placarded as unfit for human habi-
tation and should be repaired immediately or wrecked and
removed from the premises.
The last known record owner is Louis and Florence K. Akim,
322 Atwater Street. A Danger Notice has been posted.
Kindly institute condemnation action in accordance with
Section 107.2 of the building code, by setting a public
hearing date.

Dear Mr . Sheehan:
Your letter dated May 29 , 1956 , concerning the
condemnation of a, building at 322 Atwater Street arrived
here on May 31st . Since your letter further stated that
the matter had been laid over by the City Council for
further hearing on June 6 ,1956 ,wc have not had a sufficient
time in which to carry on an adequate investigation into
all of the circumstances .
The property in question has been owned free and
clear of encumbrance by Mr . Akim until the early part of
this year when he deeded the property to the John Adams
Funeral Parlor on rice Street in exchange for a guarantee
of proper burial services . Evidently Mr . Akim had owned
this property for several years beginning in about 1944 .
Apparently he lost it on a tax forfeiture proceedings
because in 1952 he bought the property back from the State
of Minnesota . Meanwhile he had constructed this old shack
that stands on the property at the present time . He occupies
one room for himself , and he also has tenants who occupy
another portion of the house and pay him 442 . 50 a month
rent . As far as we know Mr. Akim' s only other income is
from Old Age and Survivors Insurance of 551 . 50 per month .
With this combined income he would not be eligible for
Public Assistance from the Pamsey County Welfare Board.
Mr . Akim' s wife does not live with him and has not
lived with him for some 20 odd years . They were divorced in
1934 , and she apparently is living somewhere in Oregon at the
present time . When he was interviewed this date , he said
that she was expected to visit him within the next day o
so . However further questioning brought out that he h i t 1\; C.)
been in touch with her since last August . He also stated

that he had telephoned to a daughter living in Hammond,
Indiana , and had urged her to come and pay him a. visit .
This was later verified at the Zandel Drug Store where
he evidently leaves papers for safekeeping. He said
further that Zandel' s had , a copy of the deed which he
had transferred on the property to the Adams . Funeral
Parlor and also that they had a list of the names and
addresses of his children . This proved to be untrue .
Mr . Akira was said to have a housekeeper , a Mrs .
Florence Cocaen , for some time until about a year ago .
Evidently she was known as Mrs. Akim, but she no longer
lives there . At one time she held a mortgage on the
property next door and foreclosed when Mr . Akim was unable
to make payments .
We have tried on several occasions to contact
the pastor of St . Mary' s Romanian Orthodox Church at 854
Woodbridge but have so far been unable to reach him. Mr .
Walsh at the Zandel Pharmacy on Rice Street was .contacted ,
and he stated that he did have certain papers for safe-
keeping that belong to Mr . Akim. He stated further that
he had been a witness at - the time Mr . Akim transferred the
deed to. his property to the Adams Funeral Parlor . This
deed is not recorded at the present time . The papers that
Mr. Akim had left with Mr . Walsh for safekeeping were viewed,
and they consisted of one expired fire insurance policy ,
one active policy , and the deed to the property when Mr .
Akim purchased it back from the State of Minnesota in 1952 .
Mr . Walsh felt that Mr . Akim is afraid that the Health
Department wishes to force him to connect to the sewer
and because of his inability to do so :oould then condemn
the property , and he would be forced to go to dome institu-
tion .
Mr .Akim, as the members of the Council probably
know, has very strong feelings about the order which has
been issued for him to connect to the city sewer system.
He is a difficult man to interview because of the language
difficulty and his excitability . He seems to wander from
one subject to another although at times is very lucid.
Neighbors complained strongly of his leaving garbage on the
front of his lot , where he has what might be called a small
garden . They also stated that he drank excessively. His

tenant also complained of his drinking .
It is our opinion that regardless of what is
done with this property Mr . Akim is going .to require some
kind of supervision or institutionalization for his own
protection. We believe that every effort should be made
to contact his children and to insist that they make
some arrangements for their father , either to get this
sewer connected up so he can remain where he is or
otherwise as may best be indicated.
We would recommend that this matter be laid over
for at least a two-week period during which time we would
be pleased to make every effort to contact his children and
his wife to see what can be done in the way of getting their
- help in providing proper care for Mr . Akim. It may also be
possible that with the deed transferred to another party
that Mr . Akim himself is no longer responsible for making
the necessary sewer connection . This , however , is of course
a question for the legal deptrtment to consider .

Gentlemen:
In addition to the requirements as outlined in Mr.
Sheahants letter relative to the matter at 322 Atwater Street,
St. Paul, Minnesota, owned by Louis and Florence Akim, the
following will be necessary in order to make this comply with
minimum requirements of our Building Code:
Remove the existing and install anew complete
plumbing system, together with the proper venting and air
relief. All toilets shall have proper flushing devices and
shall be installed to meet Code requirements. All waste piping
shall be properly trapped and vented, and if a toilet is re-
quired on the second floor, the chemical toilet shall be re-
moved and proper toilets installed.
Investigations reveal that this house is below the
sewer level. It will be necessary that a sump pump with a
lift be installed in order that this may be discharged into
the public sewer line.
All gas burning devices shall be properly connected
and all hose connections shall be eliminated.

To the Council
Gentlemen:
The undersigned herewith submit their report to your Honorable
Body pursuant to your request through the medium of the City
Clerk concerning the premises designated as 322 Atwater Street,
in the City of Saint Paul, particularly concerning the alleged
unlawful and insanitary conditions on said premises attributable
to the use of a cess pool thereon for the disposition of sewage
from the dwelling on said premises instead of the conduct of such
sewage therefrom to the public sewer in said Atwater Street upon
which said premises abutt.
The alleged conditions have been verified by investigation by
the Bureau of Health under the supervision and direction of the
Commissioner of Public Safety. It is the finding of said Bureau
of Health, based upon said investigation, that public health and
safety are endangered by the aforesaid conditions on said premises
and that the same necessitate in the public interest that the
practice of .maintaining said cesspool for said purpose forth-
with cease and that a sewer connection for the discharge of sewage
therefrom be constructed and maintained for said purpose under
the Ordinances of the City of Saint Paul with said public sewer
in Atwater Street.
In such matter the attention of the Council is directed to the
following pertinent portion of Ordinance No. 201, approved
March 23, 1880, as amended, to wit:
"The Commissioner of Public Works, under the direction
of the board of health, shall have power in all cases
where there is a public sewer in any street or highway,
to cause every owner of land upon or adjoining such
street or highway, his agent or tenant, to make a suffi-
cient drain from his or her house, yard, or lot, whenever
in their opinion the same may be necessary, and they shall
thereupon give such owner, or agent, or tenant, notice in
writing, spedifying the time when such drain must be com-
pleted; and if the said owner, agent or tenant neglects
to complete the same within the time specified, and in
addition to the penalties imposed for a violation of any
of the provisions of this ordinance, the Commissioner oft; q`

of Public Works shall cause it to be done, and shall
recover the whole amount of the expense thereof, to-
gether with ten ( 10) per cent damages, by an action
in the name of the City of St. Paul before any court
proper to try the same."
The undersigned recommend that the notice provided for in said
quoted portion of said ordinance be directed by the said Commis-
sioner to the owner of said premises requiring said owner to
discontinue the use of said cess pool and to cause to be installed
a proper sewer connection connecting said premises with said public
sewer for the discharge and conduct of sewage from said premises,
within the period of thirty days next after this date.
