A public hearing having been had upon the above improvement upon due notice, and the Council having
heard all persons, objections and recommendations relative thereto, and having fully considered the same;
therefore, be it
RESOLVED, By the Council of the City of Saint Paul that the precise nature, extent and kind of im-
provement to be made by the said City is
condemning and taking an easement in the land necessary for
slopes, cuts and fills in the grading of Birmingham Street frail Margaret Street
to Minnehaha Avenue.
and the Council hereby orders said improvements to be made.
RESOLVED FURTHER, that the following land, lands or easements therein be and the same are
hereby ordered to be taken, appropriated and condemned for the purpose of making said improvements, viz.:
For slopes, cuts and fills in the grading of Birmingham Street frcaa< Margaret
Street to Minnehaha Avenue, to the extent shown on the plan on file in the
office of the Ccaaissioner of Public Works.
RESOLVED FURTHER, That the Commissioner of Public Works be and is hereby instructed and
directed to prepare plans and specifications for said improvement, and the proper city officials are hereby
authorized and directed to proceed wilt'.the making of said improvement in accordance therewith.

Council, known as Council File No. 176966 _approved March 1 19 56, relative to

SPECIAL PETITION
We, the undersigned owners of property abutting the improvement herein described,
respectfully petition your Honorable Body to make the following improvement:
Grade Birmingham Street from Margaret Street to Minnehaha Avenue.
For and in consideration of the above improvement we hereby agree to waive
any defense or right of appeal from the assessment therefor to be levied by the
Commissioner of Finance and ratified by the City Council, or litigate the equity
of the assessment as levied and ratified. This agreement is made in full recog-
nition of the fact that the assessment to be levied and ratified may be dispro-
portionate with the benefits conferred upon abutting property; and we further agree
that this agreement is to run with the land and shall be binding on the undersigned
as owners of abutting property, their heirs, successors and assigns.
