I WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one and one-half story wood frame single-family home located on property
4 hereinafter refened to as the "Subject Property" and commonly known as 562 SHERBURNE
5 AVENUE. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before Novemer 16, 2009,
the following are the now known interested or responsible parties for the Subject Property:
Deutsche Bank Nat Trust/Co Citi Residential Lending, 6801 Colwell Blvd, Irving TX 75039-
3198; Deutsche Bank Nat Trust, c/o Multi Distressed Fund, LLC, 44 Wall Street, 2 Floor, New
York, NY 10005; Sundiata Menelik, 1507 Pinetree Tr, Eagan MN 55122-3724; Sundiata
Menelik, 1507 Pinetree Tr, St Paul MN 55122-3724; Shapiro, Nordmeyer & Zielke, 12550 W.
Frontage Rd, Ste. 200, Burnsville, MN 55337; Thomas-Dale/Dist. 7 Planning Council; and
WHEREAS, Department of Safety and Inspections has notified the lrnown interested or
responsible parties of the "Order to Abate Nuisance Building(s)" dated February 11, 2010 as
provided for in Chapter 45 of the Saint Paul Legislative Code; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible par[ies that they must repair
or demolish the structure located on the Subject Property by March 15, 2010; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Heazing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been sexved notice in accoidance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, �f the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, Apri127, 2010 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by rehabilitating
this structure in accordance with all applicable codes and ordinances, or in the alternative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the struchue to be completed within fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, May
19, 2010 and the testimony and evidence including the action taken by the Legislative Heazing
Officer was considered by the Council; now therefore
SE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order conceming the Subject Property at 562 SHERBURNE AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
Z. That the costs of demolition and removal of this building(s) is estimaYed to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:

The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicabie codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
£fteen (15) days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps aze necessazy to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one and one-half story, wood frame, single-family dwelling on a lot of 2,178
square feet.
According to our files, it has been a vacant building since December 30, 2008.
The city has had to board this building to secure it from trespass.
The cunent property owner is Deutsche Bank Nat TrusUCo Citi Residential Lend?ng, per
AMANDA and Ramsey County Property records.
There have been nine (9) SUMMARY ABATEMENT NOTICES since 2008.
There have been fifteen (15) WORK ORDER(S) issued for:
- Improperly stored refuse, garbage and misc debris
- Removal of tall grass and weeds
- Boarding/Securing
- Removal of snow and ice
On January 27, 2010, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photogaphs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on February ll, 2010 with a compliance date of
March 15, 2010. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are paid. (Paid by assessment on 2-11-IO)
Taxation has placed an estimated market value of $11,700 on the land and $15,500 on the
building.
As of April 22, 2010, a Code Compliance Inspecrion has not been completed.
As of April 22, 2010, the $5,000.00 performance bond has not been posted.

Inspections, Division of Code Enforcement, hereby declares the premises docated at:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On January 27, 2010, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. This
building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall
not again be used for occupancy until such time as a Certificate of Complizanee or a
Certificate of Occupancy has been issued. All repairs must be in accore3aaxca wzth
appropriate codes. Changes or additions ta the electrical system, �e�l �gst�z�, ar
the plumbing system may necessitate updating or upgrading the systems fisav�lve�.
This is a one and one-half story wood frame single-family home.

1. The bathroom floor covering is deteriorated or inadequate. Provide floor covering
which is impervious to water and easily cleanable throughout the bathroom and seai
around the edges and fixtures.
Z. FliRNACE: Have a licensed heating contractor service and clean the furnace or boiler
and make any necessary repairs. Perform a GO test on the heating plant. Then, send
the attached form back to the Inspector. Repair of gas fired appliances requires a permit.
3. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit Vlay Be
Required.
4. The interior ceilings are defective. Repair all ceiling defects ar.3 finish ir. a professional
manner.
5. The interior walls are defective. Repair all wall defects and finish in a professional
manner.
6. Smoke Detector: Lack of properly installed and operable smoke detector. Provide
functioning smoke detectors in accordance with the attached requirement, within 24
hours.
7. Lack of Water Service. Immediately restore water service. Failure to provide water
service will result in these premises being declared Unfit for Human Habitation and
ordered vacated for lack of this basic facility.

10. The chimney is defective, deteriorated or in a state of disrepair. Replace all missing ox
defective bricks, tuckpoint as needed to restore the chimney to a professional state of
maintenance and repair. Permit may be required.
l l. The exterior walls andlor trim of the house andlor garage has defective, peeled, flaked,
scaled or chalking paint ar has unpainted wood surfaces. Scrape and repaint fo effect a
sound condition in a professional manner.
12. The foundation is deteriorated, defective or in a state of disrepair. Repair all foundation
defects in a professional manner to a weather-tight, water-tight and rodent-proof
condition. Permit may be required.
13. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace the roof
covering to a sound, tight and water impervious condition. Permit may be required.
14. The exterior walls of the house and/or garage are defective. Repair all holes, breaks,
loose ar rotting siding, to a professional state of maintenance.
15. The window and/or door screens are missing, defective or in a state of disrepair.
Provide proper window and door screens for all openable windows and doors. Screens
must be tight-fitting and securely fastened to the frames.

16. The windows andlor storm windows are in a state of disrepair. Replace all missing or
broken window glass. Make all necessary repairs to frames, sashes, hardware and
associated trim in a professional manner. Permit may be required.
This buiiding(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall
not again be used for occupancy until such time as a Certificate of Compliance or a Certificate
of Occupancy has been issued.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by March 15, 2010 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-8989. This
inspection will identify specific defects, necessary repairs and legal requireme�its to correct this
nuisance condition.
If this building is located in a historic district or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your propos�l for
the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms are available from the Department of Safety
and Inspections web site (see letterhead) and from the HPC staff. No permits will be issued
without HPC review and approval. HPC staff also can be reached by calling 651-266-9078.
As an owner or responsible party, you aze required by law to provide full and complete
disclosure of this "Order to Abate° to all interested parties, all present or subsequent renters and
any subsequent owners. The property shall not be sold, transfened or conveyed 'an any manner
until the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time speci$ed in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk wili then
schedule dates for Public Hearings before the City Council at whieh time testimony wi11 be
heard from interested parties. After this hearing the City Council wi11 aclopt a resolut?on sta�ing
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City sha11 abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

7. Ordering the owner to remove or repair the building(s) at 562 Sherbume Avenue within
fifteen (I S) days from adoption of resolution.
The property owner of record, Deutsche Bank National Trust c/o Citi Residential Lending, did not
appeaz. No other parties of interest appeared.
Mr. Magner stated the building was a one and one-half story, wood frame, single-family dwelling
on a lot of 2,178 squaze feet and had been vacant since December 30, 2008. A code compliance
inspection had not been done, the vacant building registration fees in the amount of $1,100 went to
assessment on February 11, 2010, and the $5,000 performance bond had not been posted. On
January 27, 2010, an inspection of the building was done and a list of deficiencies which constitute
a nuisance condition was developed. An order to abate a nuisance building was posted on February
11, 2010 with a compliance date of Mazch 15, 2010. To date, the property remained in a condition
which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation
estimated the mazket value of the land to be approximately $11,700 and the building to be $15,500.
Real estate taxes for 2008-2009 were delinquent in the amount of $2,767.25, plus penalty and
interest and the property was subject to tax forfeiture on July 31, 2010. Code Enforcement
estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for
demolition was estimated to be approximately $8,000 to $10,000. There had also been nine
suminary abatements issued to this property since 2008, I S of which went to work order: to secure
the building and the City had to boazd the building to secure it from trespass, remove improperly
stored refuse and debris, boazding/securing, cut tall grass and weeds, and remove snow and ice.
Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1889 and was a worker's cottage-style building. Originally, there were two houses located on this
one lot with one house facing Kent Street and this being on the corner of Sherburne; however, the
lot had been split. The exterior of the building had good integrity with the porch being original and
included original spindle railings. It was located within the potential Frogtown historic district and
believed it was a contributing resource to the Frogtown neighborhood. She encouraged rehab of the
building.
Ms. Moermond recommended laying this over to the May ll hearing. She requested a letter be sent
to the Frogtown CDC and HRA to see if they had any interest in saving this property.

Mr. Magner read an email received from Patty Lammers, Greater Frogtown CDC, who indicated
that they had looked at the property and believed it was not a candidate for rehabilitation. Said
email is attached and made a part of this record.
Ms. Boulware stated that this property had potential as an historic resource and the HPC would like
to see this property saved.
Ms. Moermond noted that the property taxes for 2008-2009 were delinquent and since this was in
an ISP azea, it likely would go tax forfeit in August. She requested a letter be sent to Sheri
Pemberton to see if the HRA was interested in purchasing and rehabbing the property. She also
requested a letter be sent to Kris Kujala, Ramsey County, regarding pending tax forfeiture. She
recommended continuing the public hearing to June 2.
