WHEREAS, Department of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a one story wood frame house in the rear/south side of the lot, located on
property hereinafter referred to as the "Subject Properry" and commonly known as 396'/:
SHERBURNE AVENUE. This properiy is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before October 5, 2010, the
following are the now known interested or responsible parties for the Subject Property:
Community Resource Bank, 1501 County Road C West, Roseville, MN 55113; David Merrick,
PO Box 10908, White Bear Lake, MN SS ll 0; Stein & Moore, PA, First National Bank Building,

WHEREAS, Department of Safety and Inspections has notified the known interested or
responsible parties of the "Order to Abate I�uisance Building(s)" dated February 11, 2010 as
provided for in Chapter 45 of the Saint Paul Legislative Code; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by March 15, 2010; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to consritute a nuisance condition; subject to demolitaon; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Heazing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREA5, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, April 27, 2010 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfaze and remove its blighting influence on the community by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
demolition of the structure to be completed within fifteen (15) days after the date of the Council
Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, May
19, 2010 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 396'/: SHERBURNE AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safery and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fizlfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Properry
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition and removal of the
structure must be completed within fifteen (15) days after the date of the Council
Hearing.
2. If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible pariies by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of Yhe Saint Paul LegislaYive Code.

issued an order to the then lmown responsible parties to eliminate this nuisance condition by

The property was re-inspected on March 15, 2010. There was no compliance and the nuisance
condition remains unabated, the community continues to suffer the blighting inAuence of this
property. It is the recommendarion of the Department of Safety and Inspections that the City
Council pass a resolurion ordering the responsible parties to either repair, or demolish and
remove this building in a tunely manner, aad failing that, authorize the Department of Safety and
Inspections to proceed to demolirion and removal, and to assess the costs incuned against the
real estate as a special assessment to be collected in the same manner as taxes.

The building is a one story, wood frame, single-family dwelling in the rear on a lot of 4,792 square
feet.
According to our files, it has been a vacant building since February 19, 2004.
The current property owner is Community Resource Bank, per AMANDA and Ramsey County
Property records.
There have been eighteen (18) SUMMARY ABATEMENT NOTICES since 2004.
There have been five (5) WORK ORDER(S) issued for:
- Improperly stored refuse, garbage and misc debris
- Removal of tall grass and weeds
On Febxuary 2, 2010, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on February 11, 2010 with a compliance date of
March 15, 2010. As of this date this property remains in a condition which comprises a nuisance as
defined by the legislative code.
The Vacant Building registration fees are paid. (Paid by assessment on 3-8-10)

ORDER:
Repair the structure to habitable condition
This structure is a registered vacant buildino that must have a Code Compliance Certificate
before the structure may be occupied.
Obta�n a Code Compliance Certificate from the Depaitment of Safety and Inspections. You
may contact Jim Seeger at 651-266-8989 far a code compliance inspecvon, permits. and
itisua�ce of the Code Compliance Certificate.
Under Chapter 33.03 of the Saint Paul Legislative Code, failure to obtain a Code Compliance
Certificate before occupying the structure may result in issuance of criminal summonses.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resutting nuisance condi[ion is not correcYed by March 15, 2010 the Department of Safety and
]nspections, Division of Code Enforcement, will begin a substantial abatement process to
demoiish and remove the building(s). The costs of this act�on, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Reporr must be obtained from the
Quilding Inspection and Desig� Section, 375 7ackson Street, Suite 220, (65])266-8989. Th�s
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition.
lf this bullding is located in a hfstoric district or site (noted above, just be]ow the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms are available from the Department of Safety
und Inspections web site (see letterhead) and from the HPC staff. No permits wi11 be issued
without HPC review and approval. HPC staff also can be reached by calling 651-266-9073
As an owner or responsible party, yon are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. The property shall not be sold, transfeaed or conveyed m any manner
until the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has baen issued.
The Enforcement Officei �s required by law to post a piaeard on this piopesty which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard sha11
not be removed without the written authoriry of the Department of Safety and Inspections,
Division of Code Enforcement The department is further required to file a copy of th�s "Order
to Abate" with the City Cierk's Office.
]f corrective action is not taken within the time specified i� this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Cletk will then
schedule dates foi Pu61ic Hearings before the City Council at which time testimony will be
heard from interested parties. Afrer this hearing the City Council will adopt a resolution sta[ing
what acuon if any, it deems appropriate.
If the resolution calls for abatement acrion the Council may either order the City to take the

The following is the Code Compliance report you requested on March 04, 2010.
Please be advised that this report is accurate and correct as of the date March 19, 2010. All
deficiencies identified by the City after this date must also be corrected and all codes and
ordinances must be complied with. This report is valid for 365 days fiom March 19, 2010.
This report may be used in lieu of a Truth in Housing Report required in St Paul Legislative
Code 189. This building must be properly secured and the property maintained at all times.

• Install floor covering in bathroom and kitchen that is impervious to water
• Repair walls, ceiling and floors throughout, as necessary
• Prepare and paint interior and exterior as necessary. Observe necessary abatement
procedure if lead base paint is present (See 5t Paul Legislative Code, Chap. 34 for
additional information).
• Any framing members that do not meet code (where wali and ceiling covering is
removed, members that are over-spanned, not being carried properly, door and window
openings that are not adequately supported, etc.) are to be reconstructed in an approved

• Habitable rooms with new usage and replaced windows shall have glass area equal to 8%

6. Ordering the owner to remove or repair the building(s) at 396-1/2 Sherburne Avenue within
fifteen (15) days from adoption of resolution.
The property owner of record, Community Resource Bank, did not appeaz. No other parties of
interest appeazed.
Mr. Magner stated the building was located at the reaz of the lot and was a one-story, wood frame,
single-family dwelling on a lot of 4,792 square feet and had been vacant since February 19, 2004.
A code compliance inspection had been done on March 1 Q 2010, the vacant building registration
fees in the amount of $1,100 went to assessment on March 8, 2010, and the $5,000 performance
bond had not been posted. On February 2, 20l �, an inspection of the building was done and a list of
deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance
building was posted on Februazy 11, 2010 with a compliance date of March 15, 2010. To date, the
property remained in a condition which comprised a nuisance as defined by the Legislative Code.
Ramsey County Taxation estimated the mazket value of the land Yo be approximately $17,300 and
the building to be $3Q,600. Real estate taxes were current. Code Enforcament estimates the cost to
repair the building to exceed $75,000. The cost for demolition was estimated to be approximately
$8,000 to $10,400. There had also been 18 summary abatements issued to this property since 2004,
five of which went to work order: remove improperly stored refuse and debris and cut tall grass and
weeds. Code Enforcement recommends the building be repaired or removed within 15 days. Mr.
Magner presented photographs of the property.
Ms. Moermond asked for a repoft from Ms. 5pong. Ms. Spong stated that the original building
permit was missing but believed the building was built around 1880. The exterior lacked integrity
as the porch had been removed and the building had been stuccoed. This property was unique to the
Frogtown neighborhood as it was uncommon to find two houses built on one lot. However, she did
not believe demolition would have an adverse effect on the neighborhood.
Ms. Moermond recommended the building be removed within 15 days with no option for repair.
