This properiy is legally described as follows, to wit: 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 Syndicate No 4 Addition Lots 6 And Lot 7 Blk 1 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or before October 5, 2009, the following are the now known interested or responsible parties for the Subject Property: Benjamin Shamrokh, 710 N. 4 St, Unit 301, Minneapolis, MN 55401; Benjamin Shamrokh, 1300 Hennepin Ave, #330, Minneapolis, MN 55403; TCF National Bank , Consumer Lending Dept, 801 Mazquette Avenue, Minneapolis, MN 55402; Thomas-Dale/Dist. 7 Planning Council; and WHEREAS, Department of Safety and Inspections has notified the known interested or responsible parties of the "Ordez to Abate Nuisance Building(s)" dated February 11, 2010 as provided for in Chapter 45 of the Saint Paul Legisiative Code; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHBREAS, this ordec informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by March 15, 2010; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declazing this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public heazings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, April 27 and May 11, 2010 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the 10-530 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 interested or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safery and welfare and remove its blighting influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, May 19, 2010 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 640 MIPiNEHAHA AVENUE WEST. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. That the costs of demolition and removal of this building(s) is estimated to exceed fivethousand dollars($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the 5ubject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies ar to demolish and remove the building(s). Q 7 That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitared by Department of 5afety and Inspections, Vacant/Nuisance Buildings. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ORDER The Saint Paul City Council hereby makes the following order: 10-530 84 I. 85 86 87 88 89 90 91 92 93 2. 44 95 96 97 98 99 3. 100 101 102 103 104 105 4. 106 The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure and correcting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitarion or demolition and removal of the structure must be completed within r.rn����c� one hundred-eightv (180) days after the date of the Council Hearing. If the above corrective action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. Ordering the owner to remove or repair the building(s) at 640 Minnehaha Avenue West within fifteen (15) days from adoption of resolution. Benjamin Shamrokh, property owner, appeared with his father, Shiree Shamrokh. Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a one and one-half story, wood frame, duplex with a detached two-stall garage on a lot of 10,019 square feet and had been vacant since October 21, 2003. A code compliance inspection had been done on April 6, 2010, the vacant building registration fees in the amount of $1,000 went to assessment on December 4, 2009, and the $5,000 perfozmance bond was posted on Mazch 15, 2010. On December 2, 2009, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on Februazy 1 l, 2010 with a compliance date of March 15, 2010. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Rasnsey County Taxation estimated the mazket value of the land to be approximately $26,SOQ and the building to be $26,100. Real estate taxes for 2004-2007 were delinquent in the amount of $10,832.95, plus penalty and interest. Code Enforcement estimates the cost to repair the building to exceed $75,000. The cost for demolition was estimated to exceed $10,000. There had also been 17 summary abatements issued to this property since 2003, five of which went to work order: remove improperly stored refuse and debris and cut tall grass and weeds. DSI recommends the building be repaired or removed within I S days and he indicated that this property previously had a code compliance inspection and permits pulled and the owner failed to complete the rehab of the property. He presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1889 to 1890 and was a worker's cottage-style building. The building had not been surveyed and was located outside of the potential Frogtown historic district. There was a loss of context in the neighborhood; there also was no potential for local historic designation or national registration. She did not believe demolition would have an adverse effect on the neighborhood. Mr. Shamrokh stated that he had worked in real estate and when the economy tumed, he did not haue the financial ability to complete the repairs to the building. He said he ended up forfeiting the bond in the process of not being able to complete the repairs. He said he now had the financial ability to make all of the repairs and he, along with his father, intended to live at the property. He said he had obtained a bid in the amount of $34, 000 from a contractor, who was a friend, who had agreed to allow him to pay 10 percent down and then agreed he would do the work on a two year payment plan. He had also talked to Ramsey County on working out a payment plan to pay the outstanding property taxes. He submitted a work plan and bid from his contractor for Ms. Moermond's review. Ms. Moermond stated that the following conditions must be met by May 10 in order to receive a grant of time: 1) submit a more detailed work plan from the contractor with timelines for completing the work; 2) provide a copy of a contract with the contractor on the financial detaiis for financing the rehab; 3) obtain a written agreement with Ramse� County on a payment plan to pay the delinquent property taxes; and 4) the property must be maintained. She recommended continuing the hearing to May 11. 10-530 May 11, 2010 Legislative Hearing Minutes Page 3 2. (Continued from April 27) Benjamin Shamrokh, property owner, appeazed. Mr. Magner read Ms. Vang's letter dated April 29, 2010 into the record regazding the list of conditions which needed to be met. Prior to the hearing, Mr. Shamrokh had submitted a copy of the following: confession of judgment with Ramsey County for payment of the delinquent property tases; a contract agreement with AA Contracting; and a detailed contractor's invoice. Mr. Shamrokh explained that he had worked out an agreement with Ramsey County to pay back the delinquent property taxes over a period of 10 yeazs on the condition he remain current on his property t�es or the aa eement would be null and void. The first year's payment was $1,083 and additional payments would be in the amount of $1,003. In his contract with AA, the agreement was he would pay, up front, 10 percent of the total amount of the cost of the project which was $36,850. He would then have to pay equal monthly installments of $2,070 until the last payment was due in the amount of $8,280. Ms. Moermond asked how he was going to finance the work. Mr. Shamrokh responded that he had full time employment, which included bonus pay, in addition to his part-time realtor job. He had money invested in a business and had cash reserves he could utilize. Ms. Moermond questioned the timelines for completing the work. Mr. Shamrokh responded that he believed it would take two months-time each to complete the electrical, plumbing and heating. Ms. Moermond responded that she needed to see a more specific timeline for completing each item and gave him a sample work plan to complete. Mr. Magner stated that he would also need to provide separate bids for each of the subcontractors assuming AA was only the general for the project. He also expressed concern that the total amount of the estimate was approximately $37,000 which was half of what the city had estimated the cost of the work to be. He asked Mr. 5hamrokh whether he planned to do any of the work himself. Mr. Shamrokh responded that he had friends who would help with the interior painting; however, the exterior painting was going to be done by AA. Mr. Magner responded that he would need to see the estimate of the work he planned to do as part of the overall work plan. He asked Mr. Shamrokh what would happen if he didn't make the payments. Mr. Shasnrokh responded that he had an additional year to pay off the contract which he believed he would be able to do. Mr. Magner responded that he did not want to see the project half finished due to nonpayment and suggested a clause be added in the contract with AA guaranteeing completion of the project. If Mr. Shamrokh should default on payments, AA could pursue a separate legal action against him. Ms. Moermond stated that she would require a 40 day inspection to determine the progress on the project. If approximately 40 to SQ percent of the work had not been completed within that timeframe, she suggested another heazing be held. She stated that the following conditions must be met by the end of business on May 1 �: 1) revise the work plan to include timelines for completing the items and to include the property owner's sweat equity in project; 2) submit subcontractor bids; and 3) amend the contract with the contractor to provide for the completion of the project if the property owner fails to make the required payments.
