WHEREAS, Chapter�he Saint Paul Legislative Code was enacted to rewlate the subject of
noise in the City of Saint Paul; and
WHEREAS, §293.09 provides for the granting of variances from the sound level limitations
contained in §293.07, upon a finding by the City Council that full compiiance with Chapter 293 would
constitute an unreasonable hardship on the applicant, other persons or on the community; and

WHEREAS, The Ordway Center for the Performing Arts, represented by Randy Ingram,
Production Manager, who has been designated as the responsible person on the application, has applied
for a variance to present amplified music in Landmark Plaza on Market Street between 5` Street W. and
6� Street W.; and
WHEREAS, applicant is seeking a variance for the hours of 530 p.m. to 1030 pm. on June 17 &
24, July 8, 15, 22, & 29, and August 5& 12, 2010; and
WF3EREAS, if applicant is not granted a variance it will not be able to present amplified music in
Landmark Plaza; and
WHEREAS, the Department of Safety and Inspections has reviewed the application and has made
recommendations regarding conditions for the variance; now, therefore, be it
RESOLVED, tl�at the Council of the City of Saint Paul hereby grants a variance to The Ordway
Center for the Performing Arts, subject to the following conditions:
1) The variance shall be for the hours of 5:30 p.m. to 1030 p.m. on June 17 & 24, July 8, 15,
22, & 29, and August 5& 12, 2010; and
2) All electronically powered equipment used in conjunction with the event shall not exceed
85 dBA at 50 feet from the sound source from 530 p.m. until 10:00 p.m., and 75 dBA at 50 feet
from the sound source from 10:00 pm. until 1030 p.m.; and
3) The applicant shall provide personnel and equipment who shall provide continuous sound level
monitoring at all stages and each sound mix during the hours of the variance, to ensure
compliance with Condition #2; and
4) All electronically powered equipment, PA systems, loudspeakers or similaz devices shall be
turned off no later than 10:30 p.m. on June 17 & 24, July 8, 15, 22, & 29, and August 5& 12,

39 FURTHER RESOLVED, t6at any violations of the conditions set forth above on any of the
40 dates may result in revocation of the grant of a variance for the subsequent date(s), in addition to
41 any criminal citation which might issue.
