WHEREAS, the Honorable Carlton F. McNally, one of the
Judges of the District Court, has ordered that the appeal from the
condemnation of the structure at 740-742 Rondo Street by City
Council resolution C. F. No. 176940, approved February 29, 1956, be
remanded to the City Council for its further consideration; and
WHEREAS, the contract purchaser, James Phelps, has removed
the brick work on said structure, eliminating the dangers to the
public using the public sidewalks adjacent to said structure; and
WHEREAS, said James Phelps has filed with the City of Saint
Paul a surety bond conditioned on the restoration of said structure
or the razing of same if it is not rehabilitated; now, therefore, be it
RESOLVED, that on the recommendation of the Commissioner of
Parks, Playgrounds and Public Buildings, said condemnation ordered by
this Council is hereby rescinded and said James Phelps is given 60
days from the 6th day of June, 1956, in which to proceed with substantial
work toward the rehabilitation of this structure, and if he fails in
this regard, further condemnation action may be considered by this
Council.
