Dillon President of the City Council City of Saint Paul St. Paul 2, Minnesota Dear Sir: In accordance with M. S. A. 1953 Section 375.10 you are hereby notified that a vacancy exists on the Ramsey County Board of County Commissioners. This vacancy arose by the resignation of Mrs. Donald M. DeCourcy, and it becomes effective on June 5, 1956. M. S. A. 1953 Section 375.10 reads in part as follows: "If such commission district is wholly within the limits of a city or village, such vacancy shall be filled by the Council of such municipality". Mrs. Donald M. DeCourcy wa, elected from Commissioner District #1, which is comprised of the City of Saint Paul. Reference is further made to an opinion given by the Ramsey County Attorney's office, Mr. Robert G. Flynn rendering: "* * * * * * * the person elected to fill such vacancy will hold office until the first Monday in January, 1957. Mrs. DeCourcy's term would not normally expire until the first Monday in January, 1959. Hence there will be an election at the next General Election in 1956 for a two-year term, expiring on the first Monday in January, 1959." Y• - very rely, ENE A.
