Rutchick, its General Counsel, has made an offer by letter, copy of which is hereto attached and made a part hereof by reference, to be hereafter filed in the office of the City Clerk as a permanent record therein, to settle a lien against the property known as 209-217 Grove Street, which lien was filed with the Register of Deeds pursuant to resolution, C. F. No. 159875, arising out of the wrecking of structures on said property; and WHEREAS, the proposal outlined by the Housing and Redevelopment Authority is that the City accept 75% of its lien in the amount of $1,233.42, or an amount of $925.07; now, therefore, be it RESOLVED, that the Council of the City of Saint Paul authorizes the proper City officers to accept the sum of 025.07 in settlement of said lien and directs the proper officers of the City, upon receipt of said sum, to satisfy said lien-of record. Lots 15, 16 and 17, McCloud's Subdivision of Block No. 2 of Vanden- burgh' s Addition to Saint Paul. Gentlemen: This is to advise that on July 2, 1955 the Housing and Redevelopment Au- thority of the City of Saint Paul obtained an option to purchase the above referred to property from Martin J. Marrinan and James W. Marrinan, the fee owners. In said option the fee owner; agreed to convey a good and marketable title to said property to the Housing Authority for a total purchase price of $2,100.00. On examination of the title it was determined that there eisted. an encum- brance against the title in the sum of 9$1,233.42, being a lien, document No. 323499, running in favor of the City of Saint Paul for wrecking the premises at 209-217 Grove Street, which premises were condemned. as unsafe by the City of Saint Paul in 1952. It was also determined that there existed encumbrance against the title by reason of delinquent taxes for the years 1950, 1951, 1952, 1953 and 1954 in total, sum of x'1,286.04. On behalf of the Housing Authority there was filed with the County Auditor, Ramsey County, a petition for abatement addressed to the Commissioner of Taxation, State of Minnesota, for abatement of the real estate taxes for the year 1955 in the sum of $154.14. The petition as to the 1955 taxes was based on condemnation proceed- ings commenced by the Housing Authority on December 29, 1955, and now is in the hands of the Commissioner of Taxation, State of Minnesota, for final approval. There was also filed with the County Auditor, Ramsey County, a. petition wherein the above facts were recited requesting the settlement on the basis of 75% of delinquent taxes, and that the sum of $964.53 be accepted. by the County of Ramsey, State of Minnesota, in settlement of delinquent taxes totalling 9=1,286.04.. The settlement on that basis has now been approved by the Board. of Abatement, the County Auditor, Ramsey County, and the City Council of the City of Saint Paul, and has been forwarded. to the Commissioner of Taxation, State of Minnesota, for his approval. The Housing and Redevelopment Authority of the City of Saint Paul requests that the City of Saint Paul accept the sum of $925.07, being 75% of its total claim in the sum of $1,233.42 by reason of the above referred. to lien in full settlement thereof. The purpose of this request is to enable the Housing Authority to obtain an unencumbered title to this property and facilitate a closing with the recorded owners. 75% of the total encumbrances would equal $1,889.60, with $964.53 to be paid to the County of Ramsey for delinquent taxes, and the sum of $925.07 to be paid to the City of Saint Paul, and the balance between the total of those sums and the $2,100.00 to be paid to the recorded owners. Will appreciate your reviewing this matter and preparing necessary resolution for submission to the City Council of the City of Saint Paul for approval of this proposed settlement.
