1 WHEREAS, Bin Wine ��I.0 dlb(a Bin Wine Baz, located at 400 Sibley Street, Suite 150 in
2 Saint Paul, has requested approval of a liquor outdoor service azea (sidewalk cafe) license; and
4 WHEREAS, the Council fmds that issuance of the license will not interfere with the reasonable use
5 and enjoyment of neighboring property and residences and will not bear adversely on the health, safety,
6 morals and general welfare of the community, provided that certain license conditions are imposed; and

8 WHEREAS, the Council finds that the application is in order and there are no grounds for denial of
9 the license; now, therefore, be it,

11 RESOLVED, that a liquor outdoor service area (sidewalk cafe) license is issued to Bin Wine Bar
12 LLC d/b/a Bin Wine Bar, located at 400 Sibley Street, Suite 150 in Saint Paul, subject to the following
13 license conditions:

1. Per City of Saint Paul Legislative Code 411.02, the definition of Entertainment A is,
"Amplified or non-amplified music and/or singing by performers without limitation as to
number, and group singing participated in by patrons of the establishment." (includes
karaoke). Entertainment A license does not allow for patron and/or performance dances.
Conditions 2 thru 10 added for Liquor Sidewalk Cafe
2. Licensee is hereby notified that the table and seating arrangement approved far this liquar
sidewalk cafe license are subject to change, pending City Ordinance changes being
considered for side walk cafes. The ordinance changes may require a reduction in the
nusnbex of tableslchairs and/or further restrict the permitted location for placement of
tables/chairs.
3. The sidewalk cafe remains an extension of the restaurant operation onto a part of the public
sidewalk which immediately adjoins the licensed premises.
4. No sidewalk cafe sha11 be permitted in any portion of the public sidewalk where normal
pedestrian traffic flow is obstructed. A minimum cleazance width, as shown on approve site
plan for this license(dated 4/28/10), must be maintained on the public sidewalk at all times.
5. Only tables, chairs (11 tables/22chairs), wait station cart and fencing, as shown on the
approved site plan, may be located on the public sidewalk. No additional tables, chairs,
other furnishings, heating or cooking equipment shall be placed on the public sidewalk
without the prior approval of the Dept. of Safety and Inspections.
6. The outdoor dining area, as well as the tables and chairs shall be kept in a clean, sanitary
condition.
7. T'he use of a portion of the public sidewalk as a sidewalk cafe shall not be an exclusive use.
All public improvements, including but not limited to trees, light poles, traffic signals, pull
boxes or manholes, or any public-uutiated maintenance procedures, shall take precedence
over said use of the public sidewalk at all times.
8. If plant tubs are included in a sidewalk cafe, it shall be the duty of the licensed food
establishment to maintain each plant tub at all times in a safe condition at its proper location
and to inspect each such hzb periodically in order that it may be properly maintained. Trees

or plants and their tubs shall at all times be kept in a neat, clean and presentable condition.
No advertising matter or sign or writing of any kind shall be displayed upon any tree or
plant or its tub.
Plant tubs, tables, chairs, and/or fencing may not be left out over night, without first
obtaining a Public Warks Obstruction Permit. (Ca11 6 5 1-487-725Q to obtain this permit)).
No food and/or beverage preparation is allowed on a public sidewalk without prior approval
and additional licensing from DSI.
