WHEREAS, the City of Saint Paul entered into an agreement
on April 1, 1930, with the Chicago, Milwaukee, St. Paul &
Pacific Railroad Company for the construction of a spur track
to serve the municipal grain terminal, said agreement being
designated as Contract No. Q-2541; and
WHEREAS, under the terms of this contract, the City agreed
to various maintenance, up-keep and other miscellaneous duties,
making it desirable for the City '. cancel said contract; and
WHEREAS, the railroad company has offered to cancel said
agreement with the City on the conditions that said company be
permitted to salvage the tracks which will have to be taken up
for the extension of Shepard Road; and
WHEREAS, Mr. George M. Shepard, Chief Engineer in the
Department of Public Works of the City of Saint Paul, has
recommended cancellation of the said original agreement, freeing
the City from all present claims due to maintenance or other
costs, and that the railroad company be granted permission
to remove the track and appurtenances at the expense of said
railroad company, with the City to make repairs, where necessary,
to the street area after the track is removed; now therefore be
it
RESOLVED, that the proper city officers be and are hereby
authorized and directed to enter into an agreement cancelling
the aforementioned contract under the terms and conditions set
forth in this Resolution.
