THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That Ordinance No. 5840, approved July 7, 1922,
as amended, be and the same is hereby further amended so as to rezone
the following described property, located adjacent to a northeast
corner of Birmingham and Minnehaha, from "A" Residence to "Commercial

cation to your honorable body for a permit tooperate a
nursing home at said premises .
That the legal description of the property is :

Desnoyer Park, Ramsey County,
Minnesota, according to the plat
thereof on file and of record in
the office of the Register of
Deeds in and for Ramsey County,
Minnesota.
That said property is located on Marshall Avenue,
on the south side, between Finn and Cretin Avenues .
The said property is being used presently for
residential purposes by applicant and her husband, Ivan M.
Marx and for the care of two elderly persons .
In the event the permit is granted, your petitioner
would use said premises for the care of two additional elderly
persons .
WHEREFORE, Your petitioner prays that this honorable
body issue to her a permit for the operation of a nursing home

Dear Sir:
This is in the matter of the petition of Marion L. Holm to rezone from "A"
residence to "Commercial" the property located adjacent to the northeast corner
of Birmingham and Minnehaha.
This property is described as: lots 3, 4, 5, 6, 7, 8, 9, 10,11 - Block 13 -
Denslow's Rearrangement of lots 5, 6, 7, 8, 9, 10, 11, 12 - Block 2 - Lots 9,
10, 11, 12, 13, 14, 15, 16, 17, 18, 19 - block 3 and lot 11 - block 4 Cruick-
shank's Garden lots. The zoning is "A" residence.
This property has a frontage of 373' on east Minnehaha and extends northerly
a distance of 134.35' on Birmingham. This is approximately 1.15 acres in
area. Basically, the applicant has no immediate plans for the commercial
development of this property. His thoughts on this matter are outlined in
the applicant's letter dated April 17, 1956.
Adjacent land uses are as follows: there is a scattering of single-family homes
to the north and east: on the east are two lots zoned "commercial." There, is
vacant land to the west across Birmingham: there is a drive-in restaurant and
refreshment stand operation diagonally across Birmingham: to the south are
vacant lots and an Erickson filling station across Minnehaha. Field investi-
gation discloses that the first two lots from Birmingham are at the grade of.
east Minnehaha and the rest of the land is about 20' to 30' below the grade
of east Minnehaha.
In view of the existing commercial zoning in the surrounding area and the pre-
ponderance of commercial and vacant land use in the immediate vicinity the
Zoning Board feels this land is properly "commercial" in character and is of
limited value in its present zoning classification.
In consideration of these factors the Zoning Board recommends that this
petition to re-classify the property under consideration from "A"residence
to "Commercial" be granted. r

The owners of property located in Saint Paul, Minnesota, and de-
scribed as Lots three (3), four (4), five (5), six (6), seven (7),

titioned your honorable body for a rezoning of the above pro-
perty from "A" residence to a commercial district.
The property is located on the northerly side of E. Minnehaha
Street between Birmingham and Barclay Streets and includes all
of the lots facing on E. Minnehaha Street between the two cross-
streets, except Lots 1 and 2 which two lots are already zoned
for commercial use.
The above property for which the rezoning is requested is sur-
rounded on two sides by property zoned either commercial or
light industry. As was mentioned above, the two lots directly
adjacent to the east are zoned commercial. Across Barclay
Street to the East are five (5) lots zoned light industry and
three (3) others zoned commercial, all Witting on E. Minnehaha.
AHD& the lots on the South side of E. Minnehaha between Barclay
and Hazelwood are zoned commercial and all of the lots on the
South side of E. Minnehaha between Barclay and Birmingham
are zoned commercial, which lots are directly across the street
from the lots for which rezoning is requested. Also zoned
commercial is a piece of property 110 feet by 123 feet at the
Southwest corner of the intersection of E. Minnehaha and
Birmingham.

The property across E. Minnehaha to the South is used for a
filling station. The property to the East`and to the Southeast
is used for the manufacturing of cement, and concrete blocks,
and the property to the Southwest is used for a drive-in eating
establishment.
We believe that it can be clearly seen from the above that the
property for which rezoning.iss requested is of little value- to
the owners as "A" residence or ally other residence-purposes,
and as the surrounding Zoning exists today it mill never be
used for residenee`"purrposes:.
The property in question is not at the-present time owned
one separate owner but portions of it are owned by three se-
parate parties, all of whom have joined in the rezoning petition.

the State and City Health Departments and of the State Fire Marshal
and the City Fire Prevention Bureau, and subject to payment of any

Dear Sir:
This is in the matter of the appeal of Ellen Marx to establish a nursing home
at 2150 Marshall. This property is adjacent to the south side of Marshall between
Finn and Cretin. The property is described as lot 8 - block 50 - Desnoyer Park.
The zoning is "C" residence.
This property is presently used for single-family homes: it is proposed that this
use will continue and that rest home facilities for four persons will be established.
The property has a frontage of 40' on Marshall and extends to a depth of 120' .
The applicants have submitted a petition signed by 24 persons within a radius of
200' of this property signifying their approval of this project. The attached
reports of the State and City Health Departments and the State and City Fire agen-
cies and the City Building Department indicate no objection to this proposal and
establish the necessary conditions that must be met to ensure compliance with all
existing ordinances.
Adjacent land uses are primarily single-family homes: there is a filling station
at the west end of the block.
The Zoning Board feels that the conversion of larger single-family homes such as
this to accommodate a relatively small number of aged or nursing-care patients
will have no detrimental effect on the adjacent neighborhood and does provide a
resource for meeting what is a growing social problem in our community.
The Zoning Board recommends, therefore, that this appeal be granted subject to the
condition that there be no more than four patients admitted for care in this home,
and subject to all of the regulations of all of the public agencies involved.'
