This property is described as all of lot 3 - block 1 - Roger & Hendrick's Acre Lots No. 2 except the northerly 160' thereof along Barclay. The zoning is "Comm- .' ercial" and has been since 1922. This appeal is occasioned by the application of the Socony Mobile Oil Company to establish a new filling station on this site. This filling station 'proposal is treated in a separate letter accompany- ing this report. The applicant's appeal would have the effect of clarifying what is presently an ambiguous situation in reference to the building. line. Within the frame of reference to the assumption that a filling station is a permitted use at this point and that the filling station permit would be granted, he Zoning Board finds that the applicant' s request for a 17' set-back on Barclay and a 10' set- back on Prosperity Avenue is a reasonable one and recommends that this 'appeal be granted in accordance with the applicant's plans . . received in the Zoning Board office February 17, 1956. Joseph Dillon c, Major of the City of St. Paul and The City Council City Hall St. Paul, Minnesota Gentlemen: PETITION TO ESTABLISH A BUILDING LINE In regard to a request for a permit to erect a service station at the inter- section of Prosperity and Barclay Avenue, in the City of St. Paul, County of Ramsey, State of Minnesota, we request that a building line be established on this property to conform with our plot plan and layout which shows a set back on Barclay Avenue to a depth of 17 feet, and on Prosperity Avenue a set back request by a building line of 10 feet. Both streets measured at right angles to the nearest corner of the building. This will establish building lines for our proposed service station at this location. The legal description of the property in question is as follows: The following described lands in the County of Ramsey, State of Minnesota, to wit: All of Lot Three (3), Block One (1) Rogers and Hendrickts Acre Lots #2 according to the plot thereof on file and of record in the Office of the Register of Deeds in and for said county and state except the northerly one hundred and sixty feet (1601) thereof along Barclay Avenue.
