Presented by
1 WHEREAS, ROLU LLC d/b/a Mi Linda Tierra, located at 585 University Avenue in Saint Paul,
2 has applied for a 3.2 Malt Liquor Off Sale license that is within 300 feet of another such license; and
4 WHEREAS, § 410.03(�(1) of the Saint Paul Legislative Code prohibits issuance of a 3.2 Malt
5 Liquor Off Sale license within 300 feet of another such license; and
7 WHEREAS, ROLU LLC d/b/a Mi Linda Tierra requests waiver of the provisions of § 410.03( fl(1);
8 and
lo WHEREAS, the District 7 Planning Council supports the waiver of the 300 feet prohibition; and

t2 WHEREAS, § 410.03(fl allows waiver of the 300 feet prohibition if the Council finds that the
13 license is not inconsistent with the health, safety, morals and general welfaze ofthe adjoining neighbors
14 and community; now therefore be it

16 RESOLVED, that the Council finds that issuance of the requested license is not inconsistent with
17 the health, safery, morals and general welfare of the adjoining neighbors and community; and be it also
18
19 RESOLVED, that the 300 foot restriction of § 410.03 ( fl of the Saint Paul Legislative Code is
20 hereby waived and the 3.2 percent Malt Liquor Off Sale license is granted to ROLU LLC d/b/a Mi Linda
21 Tierra, located at 585 University Avenue in Saint Paul.
