1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one story, wood frame, single family house located on property hereinafter
4 referred to as the "Subject Property" and commonly known as 79 LAWSON AVENUE WEST.
5 This property is legally described as follows, to wit:

9 WHEREAS, based upon the recards in the Ramsey County Recorder's Office and
10 information obtained by Department of Safety and Inspections on or before January 11, 2010,
11 the following aze the now known interested or responsible parties for the Subject Property: Pepe

WHEREAS, Department of Safety and InspecYions has notified the known interested or
responsible parties of the "Order to Abate Nuisance Building(s)" dated January 25, 2010 as
provided for in Chapter 45 of the Saint Paul Legislative Code; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the SubjecY Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by March 3, 2010; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, April 13 and April 27, 2010 to hear testimony and evidence, and
after receiving testimony and evidence, made the recommendation to approve the request to

order the interested or responsible parties to make the Subject Property safe and not detrimental
to the public peace, health, safety and welfare and remove its blighting influence on the
community by demolishing and removing the structure in accordance with all applicable codes
and ordinances. The demolition of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, May
5, 2010 and the testimony and evidence including the action taken by the Legislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 79 LAWSON AVENUE WEST.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
That the deficiencies causing this nuisance condition have not been conected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fizlfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfaze and xemove iYs

blighting influence on the community b� demolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition and removal of the
structure must be completed within fifteen (15) days after the date of the Council
Hearing.
2. If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.

The Department of Safety and Inspecuons has declared this building(s) to constitute a"nuisance"
as defined by Legislative Code, Chapter 45. The Department of Safety and Inspections has
issued an order to the then known responsible parties to eliminate thas nuisance condition by
correcting the deficiencies or by razing and removing this building(s).
The property was re-inspected on March 3, 2010. There was no compliance and the nuisance
condition remains unabated, the community continaes to suffer the blighting influence of this
property. It is the recommendaCion of the Department of Safety and Inspections that the City
Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove this buflding in a timely manner, and failing that, authorize the Department of Safety and
Inspections to proceed to deinolition and xemoval, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taxes.

The building is a one story, wood frame, singie-family dwelling on a lot of 4,972 square feet.
According to our files, it has been a vacant building since 7u1y 7, 2009.
The current property owner is Pepe Malo Babadjide, per AMANDA and Ramsey County
Property records.
The city has had to board this building to secure it from trespass.
There have been two (2) SUMMARY ABATEMENT NOTICES since 200R.
There have been six (6) WORK ORDBR(S) issued for:

- Improperly sCOred sefuse, garbage and misc debris

structures must be in sound condition and secure from unauthorized entry Repair or
replace any missing doors, windows, or hardware for same.
2. Due to the number of deficiencies, a Code Compliance Tnspection will be reqtured
before a Placard Lift will be issued.
3. The eaves and soffits are in a state of disrepair or deterioration. Repair all defects,
holes, breaks, loose or rotting boards, to a professional state of mamtenance. Pennit
may be required.
4. Lack of Electricity. Immediately restore electrical service. Failure to provide proper
electrica] service will result in these premises being declared Unfit for Human
Habitation and ordered vacated for lack of this basic facility. lise of candles, fue]

5. The exterior wa11s and/or trim of the house and/or garage has defective, peeled,
flaked, scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint to

broken window glass. Make all necessary repairs to frames, sashes, hardware and
associated trim in a professional manner. Permit may be required.
9s owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resultin� nuisance condirion is not corrected by March 3, 2010 the Department of Safety and
Inspections, Division of Code Enforcement, wi11 begin a substantial abatement process to
demolish and remove the buildin�(s). The costs of this action, including admmistrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance withlaw.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-89$9. Tlus
inspection will identify specific defects, necessary repairs and Iegal requirements to correcY this
nuisance condition.
If this 6uilding is iocated in a historic district or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms are avai]able from the Department of Safety
and Inspections web site (see letterhead) and from the HPC staf£ \ro permits will be issued
withouf HPC review and approvaL APC staff also can be reached by calling 651-266-9078.
As an owner or responsible party, you are required by law to provide fuil and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. The pxoperty shall not be sold, transfened ar conveyed in any manner
until the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placard on this property which declares ii
to be a"nuisance condition", subject to demolition and removal by the City. This placard sha11
not be removed wifhout the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" wifh the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatemenY action is necessary. The City C1erk wi11 then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Councii will adopt a resolution statin�
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City Co take the
abatement action or fix a time within which this nuisance must be abated in accordance wttl� the
provisions of Chapter 33 of the Saint Pau1 Legislative Code and provide that if coiYective action
is not taken within the specified time, the City sha11 abate this nuisance. The costs of this
action, iucluding administrative costs will be assessed against the property as a special
assessment in accordance with law.

Ordering the owner to remove or repair the building(s) at 79 Lawson Avenue West within
fifreen (15) days from adoption of resolution.
The property owner of record, Pepe Malo Babadjide, did not appear. No other parties of interest
appeared.
Mr. Magner stated the building was a one story, wood frame, single-family dwelling on a lot of
4,972 square feet and had been vacant since 3uly 7, 2009. A code compliance inspection had not
been done, the vacant building registration fee in the amount of $1,000 went to assessment on
September 3, 2009, and the $5,000 performance bond had not been posted. On December 15, 2009,
an inspection of the building was done and a list of deficiencies which constitute a nuisance
condition was developed. An order to abate a nuisance building was posted on January 25, 2010
with a compliance date of Mazch 3, 2010. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the
market value of the land to be appmxnnately $17,30Q and the building to be $31,80Q. Rea1 estate
taxes were current. Code Enforcement estimates the cost to repair the building to be approximately
$50,000 to $60,000. The cost for demolition was estimated to be approximately $8,000 to $9,000.
There had also been two summary abatements issued to this properiy since 2009, six of which went
to work order: to secure the building and the City had to board the building to secure it from
trespass, remove improperly stored refuse and debris, cut tall grass and weeds, and remove snow
and ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr.
Magner presented photographs of the property.
Ms. Moermond asked for a report from Ms. Boulwaze. Ms. Boulware stated that this building pre-
dated building permits so it likely was built before 1883. The property was located near the
Oakland Cemetery which was identified as a historical resource; it had not been inventoried and
was not located near any potential historic district. Tbe integriry of the exteriox of the building was
in good to fair condition and the block face was intact. Given the continuity of the neighborhood,
she encouraged rehabilitation of the building. She also noted that the HPC had discussed the lack of
survey work done on the properties in this area and expressed concern that properties with historical
significance had not been identified.
Ms. Moermond recommended continuing the hearing to Apri127 to obtain interiar photos of the
property indicating the conditions found.

Mr. Magner stated that he and Inspector Yannarelly inspected the building on April 14 and
photographed the interior. They found the following: gross unsanitary conditions throughout; lazge
amounts of rodent feces, strong urine smell; garbage/rubbish strewn about; evidence of improper
wiring; damaged outlets; open gas line connection; defunct fumace; deteriorating walls/paint; large
amounts of mold; broken windows; broken doors and associated hazdwaze; missing railings; no
smoke detectors; open electrical box; water heater improperly installed; materia] endangerment
hazard from excessive storage and clutter throughout.
Kerry Antrim, District 6 Planning Council, stated that the planning council had looked at this
property and would like it demolished tomorrow; however, they would agree that the building be
removed within 15 days. She cautioned that the rodent infestation be abated prior to the demolition
of the building so that neighboring properties did not experience rodent issues once the building was
removed. Mr. Magner assured that the building would be bated as many times as it would take to
kill any rodents prior to the demolition of the building.
After reviewing the interior photographs of Yhe property, Ms. Moermond recommended the building
be removed within 15 days with no option for repait.
