State specificall� what is being appealed and why: Clark Equities, LLC appeals: 1) the Revocation of Fire Certificate of Occupancy dated February 18, 2010; and 2) Designation of Vacant Building Status, Category 2. Clark Equities did not receive notice concerning the Revocation or the Designation of Vacant Building Statns, Category 2 until Friday, February 26, 2010 when the above mentioned letters (Ex. 1 and 2 hereto) were personally handed to him at a meeting with City Licensing and Inspection. Further, the RevocaCion letter was addressed to Steve Trumble, deceased. As such, Clarl< Entities requests an extension of the 10 day requirement to appeal pursuant to Sec. 18.02 of the Saint Pau] Legislative Code due to lack of notice. In addition, Pub East does not fit the deftnition of a Category II Vacant Building pursuant to section 43.02(7) of the Saint Paul City Ordinance and Clark Entities seeks to change Yhis classification. Pu6 East is not a condemned property, does not have multipie building code violations and it is not illegally occupied. Finally, Clark Entities seeks a stay of the vacant building registration and fees pursuant fo Chapter 43 of the Saint Paul City Ordinance pending this appeal. Appeal ofMichael Bader, attorney representing Pub East, to a Vacant Building Registration Notice and Fee and Revocation of the Certificate of Occupancy for property at 1180-1184 Seventh Street East. Michael Bader, attorney, appeared with his client Gerry Clark, Clark Equities, the property owner. Mr. Singerhouse stated that he inspected the property on February 17, 2010 and found the building to be secured other than by normal means; the side door was boazded, the front, north side windows were boarded. He also found the stairway in the back to have rotted, unpainted wooden surfaces and approximately 10 to 15 percent of the siding, brick, on the top east side of the building was missing. The chimney also needed tuck pointing. At that time, he opened a category 2 vacant building file. Mr. Urmann stated that the C of 0 is automatically revoked when a building is found to be vacant. In this case, the building was found to be vacant and they revoked the C of O as being unoccupied and a vacant structure. Ms. Moermond asked about the ownership of the property. Mr. Clark stated that this originally was a contract for deed and he, Clark Equities, was listed as the fee owner. Ms. Moermond asked what they were appealing. Mr. Bader responded that the building was unoccupied; however, was not vacant and should not be classified a category 2 vacant building. He brought up the issue of notice of the orders. The letters from Fire C of O and the vacant building registration notice and fee were sent to Steve Trumble, who was now deceased, and to Cindy Trumble. He said Gerry Clark had a lease agreement with Cindy Trumble to operate a business, Pub East. Cindy Trumble was also the license holder known as Diamond Deweys. The first letter Clark Equities received from Fire was dated March 3, 2010. Mr. Urmann clarified that the letter from Fire dated Februuy 18, 2010 revoking the C of O was sent to Steve Trumble who was listed as the owner with Ramsey County Taxation as they had no knowledge of any other owner at that time. Mr. Singerhouse stated that the notice he sent dated February 18, 2010 went to Steve Trumble on Winthrop and at 1180 Seventh Street East as well as to Clark Equiries in Minneapolis. Mr. Clark stated that he had been in the commercial real estate business for over 25 years and owned several properties throughout the Twin Cities. This particular property was an investment property as the Trumbles needed a mortgage after suffering financial difficulties. This had occurred approximately three and one-half years ago. Ms. Trumble had been making payments and then stopped. In February 2010, he came to an agreement with Ms. Trumble that she turn management of the property over to him and she turned the license over to him as well. It was at that time, he became aware that the property was not operating as it should. He then received calls from vendors that Ms. Trumble had not paid them who then threatened to steal property out of the baz. He resulted to changing the locks and boarding up points of entry to prevent potential break-ins. He said the orders were confusing as the letter from Fire indicated that the building was unoccupied and then he received a letter from V acant Buildings that it was a category 2 vacant building. He said he had met with I{ris Schweinler, DSI, to review the license process and was aware that there was a business across the street, the Moonshine Saloon, who had interest in his property. There was also some other neighborhood interest in operating a business in the building. He had put together Mazch 23, 2010 Property Code Minutes 10-463 Page 5 plans to improve the property and had put that on hold because of the vacant building status. He presented plans for Ms. Moermond's review. Ms. Moermond asked how the status of the rea stered vacant building would change his plans to improve the property. Mr. Bader responded that Mr. Clark received a notice to revoke the license on the basis of the building being vacant. He said he had talked to Vir�inia Palmer, City Attomey's Office, and if the building were just unoccupied, the license would not be revoked. He said Mr. Clark had since removed the boards from the door and windows and he believed the only difference between vacant and unoccupied was that it would be considered vacant category 2 only after it is boarded for more than 30 days. He said he had talked to Inspector Chapdelaine who indicated to him that he thought the building wasn't declazed vacant until February 23 and he said he thought it was stran�e as he had never inspected the interior. He thought the building should be classified a category 1; however, more appropriately, unoccupied. He compared it to another of Mr. Clark's properties, the Smyth Building, which had been unoccupied and a category 1 since November 1, 2009 and was close to being re-occupied. He asked who made the determination on a property being unoccupied and the category status of a building as it was his understanding from Inspector Chapdelaine that it was Fire's deCermination. Mr. Singerhouse responded that it could be either Fire or Vacant Building's determination. In this particular case, they received a complaint that the building was boarded. He was instnzcted to inspect the property and make a determination. When he inspected the building, he found it unoccupied and boarded with multiple exterior deficiencies. Mr. Bader responded that his understanding was that a building could be boarded if it were boarded for less than 30 days. Ms. Moermond responded that she was unaware of any provision in the code that specified the length of time a building could be boarded. Mr. Bader again argued that the building should not be classified a category 2 and reviewed the sections of the code which he believed applied. Ms. Moermond reviewed the code and asked Mr. Singerhouse whether the building being unoccupied with multiple exterior violations was how he came to the determination to categorize the building as a category 2 vacant building. Mr. Singerhouse responded that this was correct and re-iterated the exterior violations that were observed when he inspected the property. Ms. Moermond asked when the last C of O inspection had been conducted. Mr. Urmann responded that the building was last certified in March 2009. Karin DuPaul, Dayton's Bluff Community Council, appeared and stated that the neighborhood will be happy to lmow there will be new management of fhe bar. As the bar had currently been managed, the clientele during the day was different from that at night when it became frightening to be in or around the bar. Mr. Clark stated that he had heard about the problems going on at the bar after he had talked to the beat officers, which was why he changed the locks and shut down the business as it was currently being operated. Ms. DuPaul asked why he was opposed to the building being a category 2 vacant building and having to go through the process of having an inspection and everything brought up to code. She believed it would be beneficial for the property to have a fiill inspection. Ms. Moermond stated that she understood there were issues concerning the license which was separate from the issue of the vacant building status. Mr. Clark stated that if the building is a category 2 vacant building, the Mazch 23, 2010 Property Code Minutes 10-463 Page 6 license could be revoked for 15 years. He said he had no interest in continuing to operate the business as it had been operated in the past and it was his intention to find a good management company, such as the Moonshine Saloon, to operate their business in this building. Mr. Bader arwed that this was a due process issue as the categorization of a vacant building status was subjective and not administered uniformly. He believed it was inconsistent as the letters from one department indicate the building as unoccupied and another department indicates the building is a category 2 vacant building. Ms. Moermond responded that she didn't believe it was inconsistent as the building was found to be vacant and was then referred to Fire as the C of O being revoked. She said it may be redundant; however, she did not believe it was conflicting. She asked Mr. Clazk what timeline he was looking at for opening the business under a new management agreement. Mr. Clark responded that he would like to have a new business operating within 30 to 60 days. He understood he needed to make repairs to the property prior to re-occupancy of the building. Ms. Moermond stated that she needed to consult with the City Attorney's Office, in addition to city staff, conceming the licensing issue before making a determination. She recommended waiving the vacant building fee for 30 days and that they must apply for a Team Inspection of the property. Appeal ofMichael Bader, attorney representing Pub East, to a Vacant Building Registration Notice and Fee and Revocation of the Certificate of Occupancy for property at 1180-1184 Seventh Street East. Michael Bader, attorney, appeared with his client Gerry Clark, Clark Equities, the property owner. Mr. Singerhouse stated that he inspected the property on February 17, 2010 and found the building to be secured other than by normal means; the side door was boazded, the front, north side windows were boarded. He also found the stairway in the back to have rotted, unpainted wooden surfaces and approximately 10 to 15 percent of the siding, brick, on the top east side of the building was missing. The chimney also needed tuck pointing. At that time, he opened a category 2 vacant building file. Mr. Urmann stated that the C of 0 is automatically revoked when a building is found to be vacant. In this case, the building was found to be vacant and they revoked the C of O as being unoccupied and a vacant structure. Ms. Moermond asked about the ownership of the property. Mr. Clark stated that this originally was a contract for deed and he, Clark Equities, was listed as the fee owner. Ms. Moermond asked what they were appealing. Mr. Bader responded that the building was unoccupied; however, was not vacant and should not be classified a category 2 vacant building. He brought up the issue of notice of the orders. The letters from Fire C of O and the vacant building registration notice and fee were sent to Steve Trumble, who was now deceased, and to Cindy Trumble. He said Gerry Clark had a lease agreement with Cindy Trumble to operate a business, Pub East. Cindy Trumble was also the license holder known as Diamond Deweys. The first letter Clark Equities received from Fire was dated March 3, 2010. Mr. Urmann clarified that the letter from Fire dated Februuy 18, 2010 revoking the C of O was sent to Steve Trumble who was listed as the owner with Ramsey County Taxation as they had no knowledge of any other owner at that time. Mr. Singerhouse stated that the notice he sent dated February 18, 2010 went to Steve Trumble on Winthrop and at 1180 Seventh Street East as well as to Clark Equiries in Minneapolis. Mr. Clark stated that he had been in the commercial real estate business for over 25 years and owned several properties throughout the Twin Cities. This particular property was an investment property as the Trumbles needed a mortgage after suffering financial difficulties. This had occurred approximately three and one-half years ago. Ms. Trumble had been making payments and then stopped. In February 2010, he came to an agreement with Ms. Trumble that she turn management of the property over to him and she turned the license over to him as well. It was at that time, he became aware that the property was not operating as it should. He then received calls from vendors that Ms. Trumble had not paid them who then threatened to steal property out of the baz. He resulted to changing the locks and boarding up points of entry to prevent potential break-ins. He said the orders were confusing as the letter from Fire indicated that the building was unoccupied and then he received a letter from V acant Buildings that it was a category 2 vacant building. He said he had met with I{ris Schweinler, DSI, to review the license process and was aware that there was a business across the street, the Moonshine Saloon, who had interest in his property. There was also some other neighborhood interest in operating a business in the building. He had put together Mazch 23, 2010 Property Code Minutes 10-463 Page 5 plans to improve the property and had put that on hold because of the vacant building status. He presented plans for Ms. Moermond's review. Ms. Moermond asked how the status of the rea stered vacant building would change his plans to improve the property. Mr. Bader responded that Mr. Clark received a notice to revoke the license on the basis of the building being vacant. He said he had talked to Vir�inia Palmer, City Attomey's Office, and if the building were just unoccupied, the license would not be revoked. He said Mr. Clark had since removed the boards from the door and windows and he believed the only difference between vacant and unoccupied was that it would be considered vacant category 2 only after it is boarded for more than 30 days. He said he had talked to Inspector Chapdelaine who indicated to him that he thought the building wasn't declazed vacant until February 23 and he said he thought it was stran�e as he had never inspected the interior. He thought the building should be classified a category 1; however, more appropriately, unoccupied. He compared it to another of Mr. Clark's properties, the Smyth Building, which had been unoccupied and a category 1 since November 1, 2009 and was close to being re-occupied. He asked who made the determination on a property being unoccupied and the category status of a building as it was his understanding from Inspector Chapdelaine that it was Fire's deCermination. Mr. Singerhouse responded that it could be either Fire or Vacant Building's determination. In this particular case, they received a complaint that the building was boarded. He was instnzcted to inspect the property and make a determination. When he inspected the building, he found it unoccupied and boarded with multiple exterior deficiencies. Mr. Bader responded that his understanding was that a building could be boarded if it were boarded for less than 30 days. Ms. Moermond responded that she was unaware of any provision in the code that specified the length of time a building could be boarded. Mr. Bader again argued that the building should not be classified a category 2 and reviewed the sections of the code which he believed applied. Ms. Moermond reviewed the code and asked Mr. Singerhouse whether the building being unoccupied with multiple exterior violations was how he came to the determination to categorize the building as a category 2 vacant building. Mr. Singerhouse responded that this was correct and re-iterated the exterior violations that were observed when he inspected the property. Ms. Moermond asked when the last C of O inspection had been conducted. Mr. Urmann responded that the building was last certified in March 2009. Karin DuPaul, Dayton's Bluff Community Council, appeared and stated that the neighborhood will be happy to lmow there will be new management of fhe bar. As the bar had currently been managed, the clientele during the day was different from that at night when it became frightening to be in or around the bar. Mr. Clark stated that he had heard about the problems going on at the bar after he had talked to the beat officers, which was why he changed the locks and shut down the business as it was currently being operated. Ms. DuPaul asked why he was opposed to the building being a category 2 vacant building and having to go through the process of having an inspection and everything brought up to code. She believed it would be beneficial for the property to have a fiill inspection. Ms. Moermond stated that she understood there were issues concerning the license which was separate from the issue of the vacant building status. Mr. Clark stated that if the building is a category 2 vacant building, the Mazch 23, 2010 Property Code Minutes 10-463 Page 6 license could be revoked for 15 years. He said he had no interest in continuing to operate the business as it had been operated in the past and it was his intention to find a good management company, such as the Moonshine Saloon, to operate their business in this building. Mr. Bader arwed that this was a due process issue as the categorization of a vacant building status was subjective and not administered uniformly. He believed it was inconsistent as the letters from one department indicate the building as unoccupied and another department indicates the building is a category 2 vacant building. Ms. Moermond responded that she didn't believe it was inconsistent as the building was found to be vacant and was then referred to Fire as the C of O being revoked. She said it may be redundant; however, she did not believe it was conflicting. She asked Mr. Clazk what timeline he was looking at for opening the business under a new management agreement. Mr. Clark responded that he would like to have a new business operating within 30 to 60 days. He understood he needed to make repairs to the property prior to re-occupancy of the building. Ms. Moermond stated that she needed to consult with the City Attorney's Office, in addition to city staff, conceming the licensing issue before making a determination. She recommended waiving the vacant building fee for 30 days and that they must apply for a Team Inspection of the property. This includes demolition of the parapet wall, back up parapet wall, loose exterior face brick within rebuilding area, rebuilding of the parapet back up wail, exterior face brick and the installation of a new pre-finished sheet metal parapet cap. This proposal is based on our initial grade level observations with the collapsed area covered as is and does not include back up wall repairs or rebuilding with exception to the parapet wall. We have listed an alternate option for rebuiiding the back up wall in the collapsed area with new concrete block should the back up walf befow the parapet consist of solid masonry. Appeal ofMichael Bader, attorney representing Pub East, to a Vacant Building Registration Notice and Fee and Revocation of the Certificate of Occupancy for property at 1180-1184 Seventh Street East. Michael Bader, attorney, appeared with his client Gerry Clark, Clark Equities, the property owner. Mr. Singerhouse stated that he inspected the property on February 17, 2010 and found the building to be secured other than by normal means; the side door was boazded, the front, north side windows were boarded. He also found the stairway in the back to have rotted, unpainted wooden surfaces and approximately 10 to 15 percent of the siding, brick, on the top east side of the building was missing. The chimney also needed tuck pointing. At that time, he opened a category 2 vacant building file. Mr. Urmann stated that the C of 0 is automatically revoked when a building is found to be vacant. In this case, the building was found to be vacant and they revoked the C of O as being unoccupied and a vacant structure. Ms. Moermond asked about the ownership of the property. Mr. Clark stated that this originally was a contract for deed and he, Clark Equities, was listed as the fee owner. Ms. Moermond asked what they were appealing. Mr. Bader responded that the building was unoccupied; however, was not vacant and should not be classified a category 2 vacant building. He brought up the issue of notice of the orders. The letters from Fire C of O and the vacant building registration notice and fee were sent to Steve Trumble, who was now deceased, and to Cindy Trumble. He said Gerry Clark had a lease agreement with Cindy Trumble to operate a business, Pub East. Cindy Trumble was also the license holder known as Diamond Deweys. The first letter Clark Equities received from Fire was dated March 3, 2010. Mr. Urmann clarified that the letter from Fire dated Februuy 18, 2010 revoking the C of O was sent to Steve Trumble who was listed as the owner with Ramsey County Taxation as they had no knowledge of any other owner at that time. Mr. Singerhouse stated that the notice he sent dated February 18, 2010 went to Steve Trumble on Winthrop and at 1180 Seventh Street East as well as to Clark Equiries in Minneapolis. Mr. Clark stated that he had been in the commercial real estate business for over 25 years and owned several properties throughout the Twin Cities. This particular property was an investment property as the Trumbles needed a mortgage after suffering financial difficulties. This had occurred approximately three and one-half years ago. Ms. Trumble had been making payments and then stopped. In February 2010, he came to an agreement with Ms. Trumble that she turn management of the property over to him and she turned the license over to him as well. It was at that time, he became aware that the property was not operating as it should. He then received calls from vendors that Ms. Trumble had not paid them who then threatened to steal property out of the baz. He resulted to changing the locks and boarding up points of entry to prevent potential break-ins. He said the orders were confusing as the letter from Fire indicated that the building was unoccupied and then he received a letter from V acant Buildings that it was a category 2 vacant building. He said he had met with I{ris Schweinler, DSI, to review the license process and was aware that there was a business across the street, the Moonshine Saloon, who had interest in his property. There was also some other neighborhood interest in operating a business in the building. He had put together Mazch 23, 2010 Property Code Minutes 10-463 Page 5 plans to improve the property and had put that on hold because of the vacant building status. He presented plans for Ms. Moermond's review. Ms. Moermond asked how the status of the rea stered vacant building would change his plans to improve the property. Mr. Bader responded that Mr. Clark received a notice to revoke the license on the basis of the building being vacant. He said he had talked to Vir�inia Palmer, City Attomey's Office, and if the building were just unoccupied, the license would not be revoked. He said Mr. Clark had since removed the boards from the door and windows and he believed the only difference between vacant and unoccupied was that it would be considered vacant category 2 only after it is boarded for more than 30 days. He said he had talked to Inspector Chapdelaine who indicated to him that he thought the building wasn't declazed vacant until February 23 and he said he thought it was stran�e as he had never inspected the interior. He thought the building should be classified a category 1; however, more appropriately, unoccupied. He compared it to another of Mr. Clark's properties, the Smyth Building, which had been unoccupied and a category 1 since November 1, 2009 and was close to being re-occupied. He asked who made the determination on a property being unoccupied and the category status of a building as it was his understanding from Inspector Chapdelaine that it was Fire's deCermination. Mr. Singerhouse responded that it could be either Fire or Vacant Building's determination. In this particular case, they received a complaint that the building was boarded. He was instnzcted to inspect the property and make a determination. When he inspected the building, he found it unoccupied and boarded with multiple exterior deficiencies. Mr. Bader responded that his understanding was that a building could be boarded if it were boarded for less than 30 days. Ms. Moermond responded that she was unaware of any provision in the code that specified the length of time a building could be boarded. Mr. Bader again argued that the building should not be classified a category 2 and reviewed the sections of the code which he believed applied. Ms. Moermond reviewed the code and asked Mr. Singerhouse whether the building being unoccupied with multiple exterior violations was how he came to the determination to categorize the building as a category 2 vacant building. Mr. Singerhouse responded that this was correct and re-iterated the exterior violations that were observed when he inspected the property. Ms. Moermond asked when the last C of O inspection had been conducted. Mr. Urmann responded that the building was last certified in March 2009. Karin DuPaul, Dayton's Bluff Community Council, appeared and stated that the neighborhood will be happy to lmow there will be new management of fhe bar. As the bar had currently been managed, the clientele during the day was different from that at night when it became frightening to be in or around the bar. Mr. Clark stated that he had heard about the problems going on at the bar after he had talked to the beat officers, which was why he changed the locks and shut down the business as it was currently being operated. Ms. DuPaul asked why he was opposed to the building being a category 2 vacant building and having to go through the process of having an inspection and everything brought up to code. She believed it would be beneficial for the property to have a fiill inspection. Ms. Moermond stated that she understood there were issues concerning the license which was separate from the issue of the vacant building status. Mr. Clark stated that if the building is a category 2 vacant building, the Mazch 23, 2010 Property Code Minutes 10-463 Page 6 license could be revoked for 15 years. He said he had no interest in continuing to operate the business as it had been operated in the past and it was his intention to find a good management company, such as the Moonshine Saloon, to operate their business in this building. Mr. Bader arwed that this was a due process issue as the categorization of a vacant building status was subjective and not administered uniformly. He believed it was inconsistent as the letters from one department indicate the building as unoccupied and another department indicates the building is a category 2 vacant building. Ms. Moermond responded that she didn't believe it was inconsistent as the building was found to be vacant and was then referred to Fire as the C of O being revoked. She said it may be redundant; however, she did not believe it was conflicting. She asked Mr. Clazk what timeline he was looking at for opening the business under a new management agreement. Mr. Clark responded that he would like to have a new business operating within 30 to 60 days. He understood he needed to make repairs to the property prior to re-occupancy of the building. Ms. Moermond stated that she needed to consult with the City Attorney's Office, in addition to city staff, conceming the licensing issue before making a determination. She recommended waiving the vacant building fee for 30 days and that they must apply for a Team Inspection of the property. Additional loose masonry areas will be cut out and rebuilt to secure the exterior brick to the back up wall. 10-463 Scaffolding wiff be erected in this area to access the elevation. Mortarjoinfs have deteriorated and tailed throughout the east elevation facade. E�erior masonry +s pulling away from the back up wa41, the lack of sealant on the vvindow perimeter is allowing water 40 infittrate inio ihe interior of the wall, which is accelerating the deterioration of the masonry. We have listed a unit price for sealant replacement. � This crack runs the height of the wall.
