An ordinance amending Ordinance No. 5840, entitled:
"An ordinance for the purpose of promoting the
public health, safety, order, convenience, pros-
perity and general welfare by providing for the
classification, regulation and restriction of the
location of trades and industries, and of buildings
used for human habitation and for specified purposes,
and the height and bulk of buildings hereafter
erected or altered; and regulating and determining
the minimum size of lot line courts and other open
spaces, and establishing the boundaries of districts

This is in the matter of the petition of Edward T. Heaton on behalf of
Remington Rand Univac Inc. to re-zone from "i" residence to "light
industry" and to classify from "unassigned" to."light industry" certain
property.which is bounded by Dayern on the west, Stewart on the north,
the center line of Snelling Avenue extended on the east and the north
line of the proposed Mississippi River Parkway on the south.
This is an elongated tract which extends approximately 1460' on Stewart
and 521' on Davern. The width of the tract from the south line of Stewart
south to the north line of the proposed Mississippi River Parkway is approxi-
mately 310' . The zoning classification is as follows: there is a strip
approximately 127' wide parallel to and adjacent to Stewart Avenue which •
is zoned "B" residence. The balance of the tract is now unclassified under
the Zoning Ordinance. Therefore, there are two petitions pending before
the Council - one, a conventional re-zoning petition to re-classify the
northerly portion of the tract from "B" residence to "light industry" and
the other, a petition to request the.Council place the unassigned portion
of the tract in a light industrial classification.
Mr. Edward Heaton, the present owner, has this property under option to
Remington Rand. The applicant, Mr. Heaton, and Mr. Knight Pryor, on
behalf of Remington Rand Univac have each filed letters under the date of
January 9 documenting the intentions as to the proposed use of this property.
In brief, Remington Rand Univac has no immediate development plans for this
property other than parking. Because of the size and scope of the present
operation west of Davern, ,it is their intent to acquire this land and hold
it in reserve against future expansion requirements.
In evaluating the propriety of industrial land use at this point, the
Zoning Board takes note of the adjacent land uses which are as follows:
to the south is the proposed Mississippi River Parkway and the bluff-line
overlooking the Mississippi River: to the east is a mixture of vacant
land and single-family homes interspersed within an area which has never
fully developed because of the difficulty of providing utilities as a
result of underlying rock conditions. To the north adjacent to the easterly
Remington Rand

third of this site is Sibley Manor. To the north adjacent to the westerly two-
thirds of the site is a vacant commercial tract which is used as the site of
the transmitter tower of Radio Station WIAL.
There are single-family homes to the northwest across Davern and north of Stewart:
there is one single-family residence due west of the site adjacent to the south
side of Stewart and the existing Remington Rand development is located west
across Davern. In view of the problems proposed by the underlying rock strata
and the provision of utilities, the Zoning Board is of the opinion this land will
never be developed for single-family home purposes. In view of the commercial
zoning to the north and the industrial zoning to the east, the Zoning Board feels
that the character of development proposed by Remington Rand could properly be
established in this area without adversely affecting adjacent property.
The Zoning Board is of the opinion, therefore, that as a general zoning pro-
position, a light industrial classification would be proper. In making this re-
commendation the Zoning Board recognizes it is not possible at this time to evalu-
ate the quality of the Remington Rand proposal. The details of the ultimate de-
, - " velopmentL .._::. have not as yet been establisbcd.Despite this fact, the Zoning
Board feels it is in the public's interest to re-classify this property at this
time in the interest of assuring that this major element in the community's
economy is provided with needed space to accommodate future expansion.
In coming to this conclusion, the Zoning Board is mindful that the Remington
Rand management has demonstrated competence in developing proposals of a high
character and a cooperative spirit in working out the arrangement of their site
so as to protect':the interests of adjacent property and the community in general.
The Zoning Board recognizes that there are some details as to the arrangement of
a future parking lot or buildings on this site which would be of direct interest
to abutting property owners. The Zoning Board is mindful of the fact, however,
that almost any development which involves parking or off-street loading would
again come before the Zoning Board and Council for review at such times as its
plans are developed.
When the Zoning Board considered this matter at the meeting of January 17,
representatives of the Sibley Manor property to the north appeared before the
Zoning Board and expressed concern over the problem of 1protecting Sibley Manor
from any adverse conditions resulting from excessive traffic or visual nuisances
by virtue of proximity to the parking lot. The representatives of Sibley Manor
requested that the Zoning Board call this problem to the attention of the Council
and recommend that at such time as the site is actually developed, a suitable
buffer be established to protect Sibley Manor. At that time, the representatives
of Sibley Manor were advised by the Zoning Board that any future parking lot on
the property would, under the present building line restrictions, be limited to
a set-back of one-half of the existn building line on the property. A pre-
liminary appraisal of the situatio%wil l have to be formally verified by the
office of the City Architect in its capacity as the enforcing agency, indicates
that the present building line on this property as it relates to Stewart Avenue
is 33' along Stewart. If this is the case, under the terms of the Zoning Ordinance,
a parking lot would by definition have to be set back one-half this distance or
162', a dimension eminently suitable for screen-planting or buffering pruposes.

The Zoning Board is of the opinion that this is a problem which can best be
solved at such time as the explicit nature of the developer's plans are known
and is confident that a solution satisfactory to all concerned can be worked
out.
In consideration of these factors, the Zoning Board recommends these two
petitions to establish the property under consideration in a light industrial
classification be granted.

Gentlemen:
In connection with application for rezoning of the property
we have under option from Mr. Edward Heaton, we suggest that the
rezoning application be made for "light industry". It is the in-
tention of Sperry Rand Corporation eventually to extend the plant
facilities currently being constructed on a plot to the westward
of the optioned property, these facilities to be used for the
following purposes: electronic and electro-mechanical research
and design, construction of electronic data processing systems,
computing machines, communications equipment, magnetic storage
systems, instruments, and similar devices. I have on file a
letter from Mr. Alfred H. Schroeder, City Architect, giving an
opinion that the above use definitely falls into the "light
industry" classification of the St. Paul Zoning Ordinance.
It is not our intention to commence any construction on
this property in the early future. For the time being, we intend
to use the property for extra parking facilities for the plant
now under construction. However, we do not wish to acquire the
property unless and until it is rezoned for the purposes indicated
above.
