WHEREAS, The Wine Thief d/b/a The wine Thief, located at 1787 St. Clair Avenue in Saint Paul, has
requested a waiver of the 4�-day notice requirement for an extension of their liquor off sale license into the adjacent
space at 1781 St. Clair Avenue.; and
WIIEREAS, the Macalester Groveland Community Council has agreed to the waiver of the notice
requirements; and

WHEREAS, the Counci] finds that the application is in order and that with the additional conditions, there
aze no grounds for denial of the license and that the failure to grant the waiver and the consequent delay in approving
the license would cause exceptional and unusual hardship to the license applicant; and
WHEREAS, the lice�see agrees that in the event a complaint is received prior to the expiration of the 45-day
period and the complaint provides a basis for adverse action against the license, that the Department of Safety and
Inspections may direct the licensee to immediately discontinue all operations until a public hearing is scheduled, and
that the ]icensee shall comply with said directive; now, therefore, be it,
RESOLVED, that the 45 day notice requirements of § 409.06 of the 5ai�t Paul Legislative Code are hereby
waived and an extension of the off sale liquor license area into a space (addressed as 1781 St. Clair Avenue) adjacent
to the existing retail space araa for The W ine Thief d/bla the W ine Thief, located at 1787 St. Clair Avenue in Saint
Paul, subject to the agreement stated above and the following license conditions:
1. Delivery trucks will deliver no more than three (3) times per day and no more than twenty (20) times per
week.
2. If use of the alley is required for deliveries, delivery vehicles shall park in the alley only for the time
necessary to load or unload merchandise and shall maintain at least a ten (10) foot maneuvering lane to
provide through access for the alley.
3. Exterior storage of trash and recyclable materials must be placed in covered containers.
4. Lice�see shall work with neighboring proper[y to mitigaYe concems regarding the use of the rear parking
lot area.

Dear Christine:
The Housing & Land Use Committee of the Macalester-Groveland Community Counci4 met in response to the request by
the Wine Thief for expansion and to waive the 45 day notification period on Wednesday, March 24` The committee
passed the following resolution:
The Macalester-Groveland Community Council supports the 45 day waiver contingent upon successful resolution
of neighbor concerns, particularly regarding a privacy fence issue.
Community feedback submitted to the council prior to the public meeting included support for the expansion, as well as
concerns regarding delivery trucks blocking the alley 6ehind the business, and cardboard boxes not properly placed in a
recycling bin littering the alley (and the potentiaf forthese issues to lncrease as a result of the expansion). A resident in
attendance at the meeting expressed concern regarding the need for a privacy fence between the proposed expansion
and 1781 �azge+7tAvenue.
