I WHEREAS, G-8, Inc. d/b/a Dukem Ethiopian Baz & Restaurant (License ID#20050003835)
2 located at 2516 — 7`� Street West in Saint Paul applied for Entertainment A license in July Of 2008; and
3
4 WHEREAS, the license was pending until licensee obtained the necessary parking spaces required
5 by addition of an entertainment license; and
6
7 WFiEREAS, on October 10, 2009, Saint Paul Police went to the licensee's establishment and
8 discovered that the licensee was permitting live dancing, which requires an Entertainment B license; and
9
10 WHEREAS, a Notice of Intent to Deny License dated January 6, 2010, was sent to the applicant,
ll indicating that the Department of Safety and Inspections intended to deny the application for an
12 Bntertainment A license because the parking was still unresolved and further intended to recommend a
13 Five Hundred Dollar ($500 penalty) for allowing dancing without the correct entertainment license; and
14
15 WHEREAS, an attorney for the licensee responded to the Notice of Intent to Deny License
16 indicating that the licensee would likely admit the violation and pay the Pine, but that there was a
17 management agreement in place and he wanted to check with the buyer; and
18
19 WHEREAS, licensee attended a meeting with the Depaztment of Safety and Inspections, the new
20 buyer, and the licensee's attomey attended by phone, and at that meeting it was explained to all parties the
21 requirements to obtain additional parking for any entertainment license, and licensee acknowledged that he
22 did not currently have the necessary parking; and
23
24 WHEREAS, licensee through his attorney has indicated that he wishes to pay the fine and will
25 agree to withdraw his license application, and reapply if and when he has the required parking; now,
26 therefore, be it

28 RESOLVED, that G-8, Inc. d/b/a Dukem Ethiopian Bar & Restaurant (License ID#20050003835)
29 is hereby ordered to pay a fine of $500.00 for providing live dancing without the appropriate
30 Entertainment B license. Payment of such penalty shall be made within thirty days of the date of the
31 adoption of this resolution.

32 FURTHER RESOLVED, that the Entertainment A license application shall be denied, which denial
33 shall be effective within seven (7) days of the passage and approval of this resolution unless the application
34 is withdrawn in writing prior to that time.
