10-442Council File # lq k4 Z Green Sheet #'� !� b 1 WHEREAS, City Council authorized issuance of a permit to the Toni Company, to construct a tunnel 2 under and across Broadway Street, approximately 117 feet north of the north line of Fourth Street under 3 Ordinance 10525 adopted in 1955; and 4 5 WIIEREAS, Properry records indicate that Diamond Products Company is the current holder of the rights 6 and obligations granted under said permit; and 7 8 WHEREAS, the Ordinance which authorized the granting of this permit states thaf the permit may be 9 revoked by the Council at any time, and thereupon pernnittee shall remove said tunnel; and 10 11 WHEREAS, it is necessary to xemove the tunnel due to urility relocation woxk related the to Central 12 Cozridor Light Rail Transit project; 13 14 NOW, THEREFORE, BE IT RESOLVED, that the Saint Paul City Council revokes the permit authorized 15 under Ordinance 10525 and permittee shall remove said tunnel by June 4, 2010; and 16 17 18 19 20 21 BE IT FINALLY RESOLVED, that if the tunnel is not removed by June 4, 2010 the Department of Public Works is hereby authorized to take whateve�* steps necessary to remove the tunnel structure and complete any related public right of way restoration at the expense of the permittee.
