s WHEREAS, the Zoning Committee of the Planning Commission held a public
9 hearing on February 11, 2010, for the purpose of considering the rezoning petition, and

The Planning Commission was correct to recommend denial of the proposed
zoning which is, on balance, not consistent with the Comprehensive Plan.
Although many components of the Comprehensive Plan are supportive of the
rezoning application, the adopted Rice Street Small Area Plan Summary
{2005} policy 4 states: The P/an does not recommend additional industrial
land uses on Rice Street. Due to their unique geography, lack of visibility and
limited access, areas near the railroad tracks are appropriate for existing
industrial uses to remain. Contrary to this policy, rezoning this parcel to 11
would extend the industrial zoning directly to the intersection of Rice and
Sycamore streets, while the current B3 zoning serves as a land use buffer for
the intersection; and
No plan for the proposed reuse of the site has been presented; and
Rezoning the lot to VP Vehicular Parking, an alternative brought up in the
Planning Commission resolution, would permit the applicant to use the lot for
employee and customer parking, the applicanYs stated intended use, until
such time as a new development consistent with the stated goals of the

ADDITION TO THE CITY OF ST. PAUL LOTS 2 THRU LOT 5 BLK 1 and a portion of
302922330241, legally described as GREENS ADDITION TO THE CITY OF ST. PAUL W 25 FT OF
LOTS 16,17,18,19,20 & 21 & ALL OF LOTS 6& LOT 7 BLK 1; and
WHEREAS, the Zoning Committee of fhe Planning Gommission, on February 11, 20'10, held a public
hearing af which all persons present were given an opportunify fo be heard pursuant to said
application in accordance with the requirements of § 61.303 ofi the Saint Paul Legislative Code; and
WHEREAS, fhe Saint Paul Planning Commission, based on the evidence presented to its Zoning
Committee at the public hearing as subsfanfially reflected in the minutes, made the following findings
of fact:
1. The applicant seeks to rezone the parcel formerly occupied by a Dairy Queen restaurant from B3
� fo li. The applicant states that #he purpose of the rezoning is to provide additionai parking fior the
adjacent auto salvage business. In addition, the access drive from Sycamore Street to the auto
parts business is also located in the B3 disfrict, and the rezo�ing of this portion of the'property to 11
is also being requested.
Recent discussions between the applicant a�d staff in the Department of Safety and Inspecfions
clarified that the applicant could nof display cars for sale or use the Dairy Queen site for off-street
parking for the motor vehicle salvage business because the zoning code, in Sec. 63.304(b),
specifies that parking must be locafed in fhe same or a less restrictive district. The Dairy Queen
site is in a more restrictive zoning district (63).
2. The proposed zoning is consistent with the way this area has developed. Sycamore Street in fhis
location acts as a boundary between the predorriinantly industrial uses on the south side and the
residential and p4anned pedestrian-oriented redevelopment on the north side. The properties
proposed for rezoning to 11 are the only ones on the south side of Sycamore that do not have 11
zoning.
3. The proposed zoning is, on balance, nat consistent with the Camprehensive Plan. Although many

4. The proposed parking and driveway access is compatible with ofher adjacent parking and
indusfrial uses. Rezoning fhe access drive fo 11 wilf eliminafe sptit zoning on a parcel. Rezonirtg
the Dairy Queen site to 11 would aliow parking accessory to the mofor vehicle salvage use. It
would also allow auto sales as a permitfed use. An altemative, rezoning the Dairy Queen site to
VP Vehicular Parkirtg, would onty allow off-sfreef perking and would preclude any,other use of the
sife. The property would need an additionai change of zoning before it could accommodate fhe
type of redevelopment envisioned by the eicisfing and proposed Comprehensive Plan.
N.OW, THEREFORE, BE !7 RESOLVED, that fhe Saint Paul Planning Commission recommends to
City Council that the applicafion of DMB, CLC for a rezoning from B3 General Business fo 111ndustrial

Chair ponnelly-Cohen announced that the orange colored papers given to the commissioners aze
the Planning Commission coznmittee assignments, their confidential contact information used for
city staff only and the public contact information which is posted on the web.
Planning Director's Announcements
Donna Drummond reported that on February 10, 2010 the City Council approved the Downtown
Station Area Plan. Also on Febmary 17, 2010 the City Council approved a resolution
recommending/directing establishment of a transpoftation committee of the Planning
Commission. Councilmember Stazk, the author of the resolution, sent out a letter to the Planning
Commission explaining the reasons he proposed it. The resolufion was approved at City Council
unanimously and a copy was distributed to the commissioners today.

Ms. Drummond announced that the Steering Committee met today right before the Planning
Commission meeting and they discussed tYris proposal and how they would start to implement it.
This will require a by-law change by the Planning Commission, which the Steering Committee
will consider at one of its next meetings.

Commissioner Kramer said that the Zoning Committee was split on the proposed rezoning with a
3-3 vote, and therefore has no recommendation for the Planning Commission. The
commissioners have two resolutions for their considerafion, one to be used for recommeuding
approval of the rezoning and the othez to be used for-denial of the rezoning.
Commissioner Kramer stated he did not vote in fawr of the rezoning because he thought that it
was inconsistent with the 2405 Rice Street Plan, which had a very specific recommettdation
against rezoning for more industrial on Rice Street.

Cowmissioner Alton said that flus is a very small pazcel of land that was all zoned industrial for
many, many yeazs. It was rezoned to B3 after Dairy Queen was establisfied on the corner. If is
surrounded by industrial-zoned property. The applicaat has established a good business and they
need this additional space for the operation of their business. Fxcluding the other industrially
zoned properiy, the applicant's pzoperty is about 3�/z acres of land, and the site proposed for
rezoning is about 7% of tlus toYal azea. It makes more sense to have tUis poztion zoned the same
as the surrounding zoning on that lot. He stated that the commission should not base its decision .
solely on a statement in the Rice Street Plan that says the plan does not recommend additional
iadustrial land uses. The plan does not prolabit it, it just doesn't recommead it.
Commissioner Wazd spoke against approving the rezoning. He stated that the pazcel was zoned
B3 and has always been B3. Commissioner Ward presented a copy of the Rice Srieet Small Area
P1an and 40 acxe study with a map that shows the previous uses all along that interseclion as well
as the changes that were made.
Commissioner Ward said that the B3 zoning restricts auto use businesses to a certain degree, If
all of the applicanYs parcels become Il, the neighbors and neighborhood aze concemed that the
code states tfiat if it is a11 Il anydung can go thexe. It could become a used caz lot or a check
cashing piace - there aze lots of different uses permittad in Il that don't have to go before the
neighborhood. If it stays B3 a variance or conditional use permit would be needed. If it gets
changed to veIucuIar pazldng, tfien Yhere cau be condirions puf on that proper[y.
Commi ssioner Schertler asked for stafP s reasoning for the recommendalion to support the
rezoning.
Patdcia James, PID staff, said that it is a very small property; that Ace Anto owns this pazcel and
they want to use it for pazldng. She stated this is not a slam dunk issue. There aze policies in the
Comprehensive Plan that support the rezoning and there aze Comprehensive Plan poficies that
would say no. Long range, staff thought that it was better to have that liitle section consistent
with the zoning azound it
Commissioner Wencl said that the size of ihis parcel is 12, 500 square feet, which is a small area
of that enUre block so in her reasoning it is better if tbis becomes a cohesive block zezoned to Il. •

Commissioner Nelson stated that they were told by Peter Wazner, Assistant City Attorney, that
the burden of proof in a case like this is on the properry owner, the person seeking the rezoning.
With as much potential confiicting land use issues going on here, it still is the burden of the
propeuy owner, and he will vote against this motion.
Commissioner Connolly asked Commissioner Ward about Dishict 6's vision for that block.
Commissioner Wazd said foz that particular comer the vision is to completely redevelop. limted
Froducts, the business to the west, has plans to make their site their corporate warehouse show
case azea. They want to move in between 30-40 employees and bring employment into the area.
Commissioner Young wanted clarification as to the property owner's intentions for the building
on the site.
Commissioner Kramer said that the owner had indicated that they would try to lease the e�sting
b�ilding. But failing that he wanted to consider other options, which might entail tearing it dov✓n.
VOTE: The motion to approve the rezoning failed on a voice vote.
MOTION: Commisszoner Kramer moved the resolution to deny the rezoning. Commissioner
Ward seconded the motion. `
• Chair ponnelly-Cohen called for a roll call vote, and reminded Commissioners voting in favor of
the motion for denial to state theu reasons, which could be the zeasons provided in the resolution
andlor otherreasons.

Commissioner Kramer announced the items on the agenda for the next Zoning Committee
meering on Thursday, March 4, 201Q.
VI. Comprebensive Planning Committee
Amendment to the Redevelo�ment Plan foi the Saint Paul Nei�hborhood Redevelopment Proiect
Area — State law requires that amendments to a redevelopment plan must be submitted to the
planning agency of the City for its review and for a written opinion that the redevelopment plan
conforms to the City's Comprehensive Plan. This amendment is needed to allow the expenditure
of funds from existing tas increment districts for Central Corridor improvements.
Amy Filice, PED staff, said that tlus resolution is a piece of the citywide effort to get Centrai
Corridor funded and built. Passage of these amendments by the HRA will allow them to spend
money from some of the TIF districts to improve the streetscape and provide other betterments
along the Conidor. The Metropolitan Council and the Federal government have approved certain
basic streetscape improvements along the entire corridor as part of the project, but the City would
Like a higher standazd of improvements. In looking at the various ways to finance these
"betterments" costing around 17-18 million dollazs, a variety of sources were considered. One of
• The sources wlll be proceeds from three (3) of the TIF districts; Snelling/University, Spruce Tree
and Scatteied Site. In order to use these funds the pro}ect area must be expanded. Among other

Patricia James presented the stafF report with a recommendation of approva{ for the Rezoning.
Patricia James also stated District 6 recommended denial, and there was 1 letter_ in support, and
2 letters in opposition.
• Marcus Weyandt, the applicant, expiained that Aoe Auto Parts redeveloped and expanded their
building due to a fire in 20�5 and now additiona! parking is needed. They have been working to
acquire the vaca�t Dairy Queen site for. awhile and tried to include it at the time of remodefing,
but if didn't work out. He further explained that they are trying to increase fheir revenue and
need additional room for customer parking, and the area is aiready surrounded by 11 and 12
industrial zones.
Upon questtons of the Commissioners, Mr. Weyandt stated fhat there would be about 25
parking spaces, without demolishing the vacant Dairy Queen, as a resulY of the rezoning. He
explained they would Iike lease out the vacanf buiiding and have shared parking, but if they are
not able to lease it out they would most likely tear it down. He also stated he hadn't planned or
changing the ingress/egress to the site because he believes there won't be as much trafiic as
when the Dairy Queen was operafing.
No one spoke in support.
Rodney Albers, 110 Sycamore Street, spoke in opposition. He explained he is all for improving
ihe property, but he would fike to see a p(an. He explained he has no problem if it is only going
to be used for additional parking; his concerns are with the ingress and egress. He sfated there
are too many vacant buildings on Rice Street.
Kerry Antrim, District 6 Planning Council, reviewed fhe concems of the Council in tti`e letter
submifted by fhe Districf Councif (see attached).

At the North End Business Association meeting, February 3, 2010 District 6 requested the membership .
weigh in on this rezone. There was littfe discussion surrounding the above points brought forth, and
District 6 understands that NEBA's priority may be for business expansion, but there is overwhelming
concerns regarding adding additional zoned industrial sites on Rice Street. District 6 does not dispute the
fact that Ace Auto is for the most part a good business and District 6 supports business expansion,
however as stated above there are too many variables and unanswered questions for the Land Use Task
Force to support the rezone. It simply is unreasonable to garner support for an application to rezone a
parcel to a less restrictive use when there are no firm development plans in place.
The task force will support a rezone to VP or a more restrictive use so the site can be used for parking, as
the applicant has stated and the Task Force requests a site plan that addresses landscaping, lighting,
fencing, and i�gress and egress. At this time the task force is unable to recommend a rezone from 83 to
Il and the task torce respectfuiiy requests you take into consideration the concerns stated a�d attempt
to get more facts about any future use of the site.

At the regularly scheduled meeting of the NEBA on 2/3/2010, Ace Auto requested our support for the requested
rezoning from the floor. The stated purpose was to correct the immediate need for off street parking to
accommodate both employee and customer needs during peak business hours. We were informed that this
parking was not a permitted use on the parcel in question now owned by Ace. Hence, the request.
Most discussion from the floor centered on the long business tenure, quality operation and physical presence of
Ace Auto by the owners. The membership was aware that D6 had delayed recommending for or against the
request pending discussion by NEBA.
A motion was made, seconded and approved by the membership to support the request made by Ace Auto.

E. ZQNING CODE CITATION: § 66.512 identifies the intent of the 11 district, § 66.521 lists the uses
permitted in the 11 district; §61.&01(b) provides for changes to the zoning of property initiated by the
property owner.
F. HISTORY/DISCUSSION: In 1953 a permit was approved for "Drive-in Refreshment" at this focation
(Fife # 2761). There is no other zoning history for the 780 Rice property (Dairy Queen site). The
property has been purchased by the appiicant, DMB, LLC, who also owns the motor vehicle salvage
business to the south.
(n 20Q5 a site pian and nonconforming use permit were approved for the motor vehicle salvage
business, Ace Auto Parts (Z.F. #s 05-138612 and 05-141662). These approvals allowed
reconstruction and enlargement of the retail portion of the business after the previous building was
damaged by fire. The reconstruction also inciuded expansion of the business onto the adjacent
parcel to its north. This parcel, formerly owned by Twin Cities Roofing, wraps around the southern
and eastern sides of the Dairy Queen parcel. This parcel has split zoning: the portion of the parcel
south of the Dairy Queen site is zoned 11, while the portion to the east is zoned B3. This B3 portion
is used for access to the motor vehicle salvage business and is legafly nonconforming.
G. DISTRICT COUNCIL RECOMMENDATION: District 6 had not provided a recommendation by the
time the staff report was prepared.
H. FINDfNGS:
1. The applicant seeks to re�one the parcel formeriy occupied by a Dairy Queen resfaurant from B3
to 11. 7he appiicant states that the purpose of the rezoning is to provide additional parking for the
• adjacent auto salvage business. In addition, the access drive from Sycamore Street to the auto
parts business is also located in the B3 district, and the rezoning of this portion of the property to
11 is also being requested.
Recent discussions between the applicant and staff in the Department of Safety and Inspections
clarified that the applicant could not display cars for sale or use the Dairy Queen site for ofif-

street parking for the motor vehicle salvage business because the zoning code, in Sec. •
63.304(b), specifies that parking must be located in the same or a less resfrictive district. The
Dairy Queen sife is in a more restrictive zoning disfrict (B3).
Z. The proposed zoning is consiste�t with the way this area has developed. Sycamore Street in
this location acfs as a boundary befween fhe predominanf(y indusfrial uses on the south side and
the residentiai and planned pedestrian-oriented redevelopment on the north side. The properties
proposed for rezoning to 11 are the onty ones on the south s+de of Sycamore thaf do not ha�e !1
zoning.
3. The proposed zoning is, on balance, consistent wifh the Comprehensive Plan. The current
Comprehensive Plan Summary and General Policy document establishes as a general goal:
To ensure a welcoming and supportive environment in fhe city for new and existing businesses.
Ftezoning the property would support an existing business. The Land Use Plan identifies this
.area as part of the Great Northern Corridor, with a goal of providing household-supporting jobs
(Objective 6.6). Further, Policy 6.6.1 sfates: The City and the PortAuthorify shoutd supporf ands
work fo impfement the Great Northern Corridor Community Vision of 9997 and should support
further redevelopment planning formore sites along the corridor_... In the City's revision of the
Comprehertsive Plan, which has now been approved by the Metropofitan Cauncil and is awaiting
final adoption by the City Council, the Land Use Chapter identifies this area as an °Opportunity
Site on Figure LU-B. Policy 1.54 states: Identify opportunity sifes for future
development...either as mixed-use development or as employment centers.... The North End-
South Como Plan Summary, adopted by the Cify Council in 2005, recommends that industrial
uses ...be consolidated over time, and appropriately buffered, in the Great Northern Corridor and
the Jackson-Ar/ington lndusfria( Park. Phased out would be industrial uses in the lower Trout
Brook corridor and the margina/ auto-relafed uses sou€h of Oakland Cemetery (east of Rice �
Street). The adopted Rice Street Small Area Plan Summary (2005) policy 4 states: The Plan
does not recommend additional industrialland uses on Rice Street. Due to their unique
geography, lack of visibility and limited access, areas near the railroad tracks are appropriate for
existing indusfrial uses to remain.
The area proposed for rezoning is within the Great Northem Corridor, and, while located on Rice
Street, would be much more easily redeveloped if the zoning were consisfenf with adjoining
properties so it could become part of a larger site. In addition, eonsolidating the split-zoned
parcel into common 11 zoning would be consistent with City policy discouraging split zoning and
wouid put the driveway in the same zoning classification as the property for which it provides
access. Whife fhe currenf proposed use of 4he property is parking, rezoning these parceis to 11
wouid facilitate eventual redevelopment that would meet the goaf of providing industrial jobs as
envisioned in the comprehensive plans of fhe City of Saint Paul.
4. The proposed parking and driveway access is compatible with other adjacent parking and
industrial uses. Rezoning the access drive to 11 will eliminate split zoning or3 a pa�cel. Rezoning
the Dairy Queen site to 11 would allow parking accessory to the motor vehicle saivage use. 1�
would also allow auto sales as a permitted use, M altemative, rezoning the Dairy Queerr s'�`e to
VP Vehicular Paricing, would only allow ofF-street parking and would preclude any other use of
the site. The propefty would need an additional change of zoning before it could accommodate
the type of redevelopment envisioned by the exisfing and proposed Comprehensive Pfan.
STAFF RECOMMENDATIOPI: Based on the above findings, staff recommends approvai of the
rezoning of 768 and 780 Rice St. (parcefs 302922330130 and 302922330241) from B3 General

My name is Jeffrey Wick owner of Guardian Pest Solutions, Inc. located at
345 Atwater, Saint Paul, MN.
I am located about 5 blocks from the subject property's rezoning request.
I would like to express my support to rezone the property located at 780
Rice Street, from B-3 to I-1, which is contiguous to the owners 1-1 zoning.
This Saint Paul recycling company has operated at 754 Rice Street since
1929.
The KloekMleyandt family has operated ACE AUTO PARTS since 1965.
They have built a beautiful new building 2005, increasing the looks and
safety of the entire neighborhood.
I am confident that they will continue to enhance the neighborhood's
appearance and safety.
The City of Saint Paul should support the rezoning the 780 Rice Street for
an excelleM community employer.

The Planning Commission was correct to recommend denial of the proposed
zoning which is, on balance, not consistent with the Comprehensive Plan.
Although many components of the Comprehensive Plan are supportive of the
rezoning application, the adopted Rice Street Small Area Plan Summary
{2005} policy 4 states: The P/an does not recommend additional industrial
land uses on Rice Street. Due to their unique geography, lack of visibility and
limited access, areas near the railroad tracks are appropriate for existing
industrial uses to remain. Contrary to this policy, rezoning this parcel to 11
would extend the industrial zoning directly to the intersection of Rice and
Sycamore streets, while the current B3 zoning serves as a land use buffer for
the intersection; and
No plan for the proposed reuse of the site has been presented; and
Rezoning the lot to VP Vehicular Parking, an alternative brought up in the
Planning Commission resolution, would permit the applicant to use the lot for
employee and customer parking, the applicanYs stated intended use, until
such time as a new development consistent with the stated goals of the

WHEREAS, the Zoning Committee of fhe Planning Gommission, on February 11, 20'10, held a public
hearing af which all persons present were given an opportunify fo be heard pursuant to said
application in accordance with the requirements of § 61.303 ofi the Saint Paul Legislative Code; and
WHEREAS, fhe Saint Paul Planning Commission, based on the evidence presented to its Zoning
Committee at the public hearing as subsfanfially reflected in the minutes, made the following findings
of fact:
1. The applicant seeks to rezone the parcel formerly occupied by a Dairy Queen restaurant from B3
� fo li. The applicant states that #he purpose of the rezoning is to provide additionai parking fior the
adjacent auto salvage business. In addition, the access drive from Sycamore Street to the auto
parts business is also located in the B3 disfrict, and the rezo�ing of this portion of the'property to 11
is also being requested.
Recent discussions between the applicant a�d staff in the Department of Safety and Inspecfions
clarified that the applicant could nof display cars for sale or use the Dairy Queen site for off-street
parking for the motor vehicle salvage business because the zoning code, in Sec. 63.304(b),
specifies that parking must be locafed in fhe same or a less restrictive district. The Dairy Queen
site is in a more restrictive zoning district (63).
2. The proposed zoning is consistent with the way this area has developed. Sycamore Street in fhis
location acts as a boundary between the predorriinantly industrial uses on the south side and the
residential and p4anned pedestrian-oriented redevelopment on the north side. The properties
proposed for rezoning to 11 are the only ones on the south side of Sycamore that do not have 11
zoning.
3. The proposed zoning is, on balance, nat consistent with the Camprehensive Plan. Although many

4. The proposed parking and driveway access is compatible with ofher adjacent parking and
indusfrial uses. Rezoning fhe access drive fo 11 wilf eliminafe sptit zoning on a parcel. Rezonirtg
the Dairy Queen site to 11 would aliow parking accessory to the mofor vehicle salvage use. It
would also allow auto sales as a permitfed use. An altemative, rezoning the Dairy Queen site to
VP Vehicular Parkirtg, would onty allow off-sfreef perking and would preclude any,other use of the
sife. The property would need an additionai change of zoning before it could accommodate fhe
type of redevelopment envisioned by the eicisfing and proposed Comprehensive Plan.

Chair ponnelly-Cohen announced that the orange colored papers given to the commissioners aze
the Planning Commission coznmittee assignments, their confidential contact information used for

Planning Director's Announcements
Donna Drummond reported that on February 10, 2010 the City Council approved the Downtown
Station Area Plan. Also on Febmary 17, 2010 the City Council approved a resolution
recommending/directing establishment of a transpoftation committee of the Planning
Commission. Councilmember Stazk, the author of the resolution, sent out a letter to the Planning
Commission explaining the reasons he proposed it. The resolufion was approved at City Council
unanimously and a copy was distributed to the commissioners today.

Ms. Drummond announced that the Steering Committee met today right before the Planning
Commission meeting and they discussed tYris proposal and how they would start to implement it.
This will require a by-law change by the Planning Commission, which the Steering Committee
will consider at one of its next meetings.

Commissioner Kramer said that the Zoning Committee was split on the proposed rezoning with a
3-3 vote, and therefore has no recommendation for the Planning Commission. The
commissioners have two resolutions for their considerafion, one to be used for recommeuding
approval of the rezoning and the othez to be used for-denial of the rezoning.
Commissioner Kramer stated he did not vote in fawr of the rezoning because he thought that it
was inconsistent with the 2405 Rice Street Plan, which had a very specific recommettdation
against rezoning for more industrial on Rice Street.

Cowmissioner Alton said that flus is a very small pazcel of land that was all zoned industrial for
many, many yeazs. It was rezoned to B3 after Dairy Queen was establisfied on the corner. If is
surrounded by industrial-zoned property. The applicaat has established a good business and they
need this additional space for the operation of their business. Fxcluding the other industrially
zoned properiy, the applicant's pzoperty is about 3�/z acres of land, and the site proposed for
rezoning is about 7% of tlus toYal azea. It makes more sense to have tUis poztion zoned the same
as the surrounding zoning on that lot. He stated that the commission should not base its decision .
solely on a statement in the Rice Street Plan that says the plan does not recommend additional
iadustrial land uses. The plan does not prolabit it, it just doesn't recommead it.
Commissioner Wazd spoke against approving the rezoning. He stated that the pazcel was zoned
B3 and has always been B3. Commissioner Ward presented a copy of the Rice Srieet Small Area
P1an and 40 acxe study with a map that shows the previous uses all along that interseclion as well
as the changes that were made.
Commissioner Ward said that the B3 zoning restricts auto use businesses to a certain degree, If
all of the applicanYs parcels become Il, the neighbors and neighborhood aze concemed that the
code states tfiat if it is a11 Il anydung can go thexe. It could become a used caz lot or a check
cashing piace - there aze lots of different uses permittad in Il that don't have to go before the
neighborhood. If it stays B3 a variance or conditional use permit would be needed. If it gets
changed to veIucuIar pazldng, tfien Yhere cau be condirions puf on that proper[y.
Commi ssioner Schertler asked for stafP s reasoning for the recommendalion to support the
rezoning.
Patdcia James, PID staff, said that it is a very small property; that Ace Anto owns this pazcel and
they want to use it for pazldng. She stated this is not a slam dunk issue. There aze policies in the
Comprehensive Plan that support the rezoning and there aze Comprehensive Plan poficies that
would say no. Long range, staff thought that it was better to have that liitle section consistent
with the zoning azound it
Commissioner Wencl said that the size of ihis parcel is 12, 500 square feet, which is a small area
of that enUre block so in her reasoning it is better if tbis becomes a cohesive block zezoned to Il. •

Commissioner Nelson stated that they were told by Peter Wazner, Assistant City Attorney, that
the burden of proof in a case like this is on the properry owner, the person seeking the rezoning.
With as much potential confiicting land use issues going on here, it still is the burden of the
propeuy owner, and he will vote against this motion.
Commissioner Connolly asked Commissioner Ward about Dishict 6's vision for that block.
Commissioner Wazd said foz that particular comer the vision is to completely redevelop. limted
Froducts, the business to the west, has plans to make their site their corporate warehouse show
case azea. They want to move in between 30-40 employees and bring employment into the area.
Commissioner Young wanted clarification as to the property owner's intentions for the building
on the site.
Commissioner Kramer said that the owner had indicated that they would try to lease the e�sting
b�ilding. But failing that he wanted to consider other options, which might entail tearing it dov✓n.
VOTE: The motion to approve the rezoning failed on a voice vote.
MOTION: Commisszoner Kramer moved the resolution to deny the rezoning. Commissioner
Ward seconded the motion. `

the motion for denial to state theu reasons, which could be the zeasons provided in the resolution
andlor otherreasons.

Commissioner Kramer announced the items on the agenda for the next Zoning Committee
meering on Thursday, March 4, 201Q.
VI. Comprebensive Planning Committee
Amendment to the Redevelo�ment Plan foi the Saint Paul Nei�hborhood Redevelopment Proiect
Area — State law requires that amendments to a redevelopment plan must be submitted to the
planning agency of the City for its review and for a written opinion that the redevelopment plan
conforms to the City's Comprehensive Plan. This amendment is needed to allow the expenditure
of funds from existing tas increment districts for Central Corridor improvements.
Amy Filice, PED staff, said that tlus resolution is a piece of the citywide effort to get Centrai
Corridor funded and built. Passage of these amendments by the HRA will allow them to spend
money from some of the TIF districts to improve the streetscape and provide other betterments
along the Conidor. The Metropolitan Council and the Federal government have approved certain
basic streetscape improvements along the entire corridor as part of the project, but the City would
Like a higher standazd of improvements. In looking at the various ways to finance these
"betterments" costing around 17-18 million dollazs, a variety of sources were considered. One of
• The sources wlll be proceeds from three (3) of the TIF districts; Snelling/University, Spruce Tree
and Scatteied Site. In order to use these funds the pro}ect area must be expanded. Among other

Patricia James presented the stafF report with a recommendation of approva{ for the Rezoning.
Patricia James also stated District 6 recommended denial, and there was 1 letter_ in support, and
2 letters in opposition.
• Marcus Weyandt, the applicant, expiained that Aoe Auto Parts redeveloped and expanded their
building due to a fire in 20�5 and now additiona! parking is needed. They have been working to
acquire the vaca�t Dairy Queen site for. awhile and tried to include it at the time of remodefing,
but if didn't work out. He further explained that they are trying to increase fheir revenue and
need additional room for customer parking, and the area is aiready surrounded by 11 and 12
industrial zones.
Upon questtons of the Commissioners, Mr. Weyandt stated fhat there would be about 25
parking spaces, without demolishing the vacant Dairy Queen, as a resulY of the rezoning. He
explained they would Iike lease out the vacanf buiiding and have shared parking, but if they are
not able to lease it out they would most likely tear it down. He also stated he hadn't planned or
changing the ingress/egress to the site because he believes there won't be as much trafiic as
when the Dairy Queen was operafing.
No one spoke in support.
Rodney Albers, 110 Sycamore Street, spoke in opposition. He explained he is all for improving
ihe property, but he would fike to see a p(an. He explained he has no problem if it is only going
to be used for additional parking; his concerns are with the ingress and egress. He sfated there
are too many vacant buildings on Rice Street.
Kerry Antrim, District 6 Planning Council, reviewed fhe concems of the Council in tti`e letter
submifted by fhe Districf Councif (see attached).

and Kerry Anfrim.

the Saint Paul Pianning Commission's Zoning Committee on February 11, 2010, the
Commission voted to recommend denial of your request on February 19, 201'0.
� The Planning Commission's recommendation is being forwarded to the City Council for their
action. Minnesota Statutes 15.99 requires that ail city action on zoning appiications be
completed within 60 days of the date the application is made, but a{lows the City to extend this

District 6 Planning Council's Land Use Task Force has the following concerns;

If in fact, as the applicant has indicated, he simply wants to use tHis site for parking, then the Task Force
questions why it cannot be rezoned to VP that allows parking or if not VP then a use that would be more
restrictive than 11. Also, the fact that the applicant was using the site to sell cars triggered complaints
and was the impetus that began this process.
At the North End Business Association meeting, February 3, 2010 District 6 requested the membership .
weigh in on this rezone. There was littfe discussion surrounding the above points brought forth, and
District 6 understands that NEBA's priority may be for business expansion, but there is overwhelming
concerns regarding adding additional zoned industrial sites on Rice Street. District 6 does not dispute the
fact that Ace Auto is for the most part a good business and District 6 supports business expansion,
however as stated above there are too many variables and unanswered questions for the Land Use Task
Force to support the rezone. It simply is unreasonable to garner support for an application to rezone a
parcel to a less restrictive use when there are no firm development plans in place.
The task force will support a rezone to VP or a more restrictive use so the site can be used for parking, as
the applicant has stated and the Task Force requests a site plan that addresses landscaping, lighting,
fencing, and i�gress and egress. At this time the task force is unable to recommend a rezone from 83 to
Il and the task torce respectfuiiy requests you take into consideration the concerns stated a�d attempt
to get more facts about any future use of the site.

Sirs:
At the regularly scheduled meeting of the NEBA on 2/3/2010, Ace Auto requested our support for the requested
rezoning from the floor. The stated purpose was to correct the immediate need for off street parking to
accommodate both employee and customer needs during peak business hours. We were informed that this
parking was not a permitted use on the parcel in question now owned by Ace. Hence, the request.
Most discussion from the floor centered on the long business tenure, quality operation and physical presence of
Ace Auto by the owners. The membership was aware that D6 had delayed recommending for or against the
request pending discussion by NEBA.
A motion was made, seconded and approved by the membership to support the request made by Ace Auto.

E. ZQNING CODE CITATION: § 66.512 identifies the intent of the 11 district, § 66.521 lists the uses
permitted in the 11 district; §61.&01(b) provides for changes to the zoning of property initiated by the
property owner.
F. HISTORY/DISCUSSION: In 1953 a permit was approved for "Drive-in Refreshment" at this focation
(Fife # 2761). There is no other zoning history for the 780 Rice property (Dairy Queen site). The
property has been purchased by the appiicant, DMB, LLC, who also owns the motor vehicle salvage
business to the south.
(n 20Q5 a site pian and nonconforming use permit were approved for the motor vehicle salvage
business, Ace Auto Parts (Z.F. #s 05-138612 and 05-141662). These approvals allowed
reconstruction and enlargement of the retail portion of the business after the previous building was
damaged by fire. The reconstruction also inciuded expansion of the business onto the adjacent
parcel to its north. This parcel, formerly owned by Twin Cities Roofing, wraps around the southern
and eastern sides of the Dairy Queen parcel. This parcel has split zoning: the portion of the parcel
south of the Dairy Queen site is zoned 11, while the portion to the east is zoned B3. This B3 portion
is used for access to the motor vehicle salvage business and is legafly nonconforming.
G. DISTRICT COUNCIL RECOMMENDATION: District 6 had not provided a recommendation by the
time the staff report was prepared.
H. FINDfNGS:
1. The applicant seeks to re�one the parcel formeriy occupied by a Dairy Queen resfaurant from B3
to 11. 7he appiicant states that the purpose of the rezoning is to provide additional parking for the
• adjacent auto salvage business. In addition, the access drive from Sycamore Street to the auto
parts business is also located in the B3 district, and the rezoning of this portion of the property to
11 is also being requested.
Recent discussions between the applicant and staff in the Department of Safety and Inspections
clarified that the applicant could not display cars for sale or use the Dairy Queen site for ofif-

street parking for the motor vehicle salvage business because the zoning code, in Sec. •
63.304(b), specifies that parking must be located in the same or a less resfrictive district. The
Dairy Queen sife is in a more restrictive zoning disfrict (B3).
Z. The proposed zoning is consiste�t with the way this area has developed. Sycamore Street in
this location acfs as a boundary befween fhe predominanf(y indusfrial uses on the south side and
the residentiai and planned pedestrian-oriented redevelopment on the north side. The properties
proposed for rezoning to 11 are the onty ones on the south s+de of Sycamore thaf do not ha�e !1
zoning.
3. The proposed zoning is, on balance, consistent wifh the Comprehensive Plan. The current
Comprehensive Plan Summary and General Policy document establishes as a general goal:
To ensure a welcoming and supportive environment in fhe city for new and existing businesses.
Ftezoning the property would support an existing business. The Land Use Plan identifies this
.area as part of the Great Northern Corridor, with a goal of providing household-supporting jobs
(Objective 6.6). Further, Policy 6.6.1 sfates: The City and the PortAuthorify shoutd supporf ands
work fo impfement the Great Northern Corridor Community Vision of 9997 and should support
further redevelopment planning formore sites along the corridor_... In the City's revision of the
Comprehertsive Plan, which has now been approved by the Metropofitan Cauncil and is awaiting
final adoption by the City Council, the Land Use Chapter identifies this area as an °Opportunity
Site on Figure LU-B. Policy 1.54 states: Identify opportunity sifes for future
development...either as mixed-use development or as employment centers.... The North End-
South Como Plan Summary, adopted by the Cify Council in 2005, recommends that industrial
uses ...be consolidated over time, and appropriately buffered, in the Great Northern Corridor and
the Jackson-Ar/ington lndusfria( Park. Phased out would be industrial uses in the lower Trout
Brook corridor and the margina/ auto-relafed uses sou€h of Oakland Cemetery (east of Rice �
Street). The adopted Rice Street Small Area Plan Summary (2005) policy 4 states: The Plan
does not recommend additional industrialland uses on Rice Street. Due to their unique
geography, lack of visibility and limited access, areas near the railroad tracks are appropriate for
existing indusfrial uses to remain.
The area proposed for rezoning is within the Great Northem Corridor, and, while located on Rice
Street, would be much more easily redeveloped if the zoning were consisfenf with adjoining
properties so it could become part of a larger site. In addition, eonsolidating the split-zoned
parcel into common 11 zoning would be consistent with City policy discouraging split zoning and
wouid put the driveway in the same zoning classification as the property for which it provides
access. Whife fhe currenf proposed use of 4he property is parking, rezoning these parceis to 11
wouid facilitate eventual redevelopment that would meet the goaf of providing industrial jobs as
envisioned in the comprehensive plans of fhe City of Saint Paul.
4. The proposed parking and driveway access is compatible with other adjacent parking and
industrial uses. Rezoning the access drive to 11 will eliminate split zoning or3 a pa�cel. Rezoning
the Dairy Queen site to 11 would allow parking accessory to the motor vehicle saivage use. 1�
would also allow auto sales as a permitted use, M altemative, rezoning the Dairy Queerr s'�`e to
VP Vehicular Paricing, would only allow ofF-street parking and would preclude any other use of
the site. The propefty would need an additional change of zoning before it could accommodate
the type of redevelopment envisioned by the exisfing and proposed Comprehensive Pfan.
STAFF RECOMMENDATIOPI: Based on the above findings, staff recommends approvai of the
rezoning of 768 and 780 Rice St. (parcefs 302922330130 and 302922330241) from B3 General
Business to 11 Industrial. �

My name is Jeffrey Wick owner of Guardian Pest Solutions, Inc. located at
345 Atwater, Saint Paul, MN.
I am located about 5 blocks from the subject property's rezoning request.
I would like to express my support to rezone the property located at 780
Rice Street, from B-3 to I-1, which is contiguous to the owners 1-1 zoning.
This Saint Paul recycling company has operated at 754 Rice Street since
1929.
The KloekMleyandt family has operated ACE AUTO PARTS since 1965.
They have built a beautiful new building 2005, increasing the looks and
safety of the entire neighborhood.
I am confident that they will continue to enhance the neighborhood's
appearance and safety.
The City of Saint Paul should support the rezoning the 780 Rice Street for
an excelleM community employer.

The Planning Commission was correct to recommend denial of the proposed
zoning which is, on balance, not consistent with the Comprehensive Plan.
Although many components of the Comprehensive Plan are supportive of the
rezoning application, the adopted Rice Street Small Area Plan Summary
{2005} policy 4 states: The P/an does not recommend additional industrial
land uses on Rice Street. Due to their unique geography, lack of visibility and
limited access, areas near the railroad tracks are appropriate for existing
industrial uses to remain. Contrary to this policy, rezoning this parcel to 11
would extend the industrial zoning directly to the intersection of Rice and
Sycamore streets, while the current B3 zoning serves as a land use buffer for
the intersection; and
No plan for the proposed reuse of the site has been presented; and
Rezoning the lot to VP Vehicular Parking, an alternative brought up in the
Planning Commission resolution, would permit the applicant to use the lot for
employee and customer parking, the applicanYs stated intended use, until
such time as a new development consistent with the stated goals of the

302922330241, legally described as GREENS ADDITION TO THE CITY OF ST. PAUL W 25 FT OF
LOTS 16,17,18,19,20 & 21 & ALL OF LOTS 6& LOT 7 BLK 1; and
WHEREAS, the Zoning Committee of fhe Planning Gommission, on February 11, 20'10, held a public
hearing af which all persons present were given an opportunify fo be heard pursuant to said
application in accordance with the requirements of § 61.303 ofi the Saint Paul Legislative Code; and
WHEREAS, fhe Saint Paul Planning Commission, based on the evidence presented to its Zoning
Committee at the public hearing as subsfanfially reflected in the minutes, made the following findings
of fact:
1. The applicant seeks to rezone the parcel formerly occupied by a Dairy Queen restaurant from B3
� fo li. The applicant states that #he purpose of the rezoning is to provide additionai parking fior the
adjacent auto salvage business. In addition, the access drive from Sycamore Street to the auto
parts business is also located in the B3 disfrict, and the rezo�ing of this portion of the'property to 11
is also being requested.
Recent discussions between the applicant a�d staff in the Department of Safety and Inspecfions
clarified that the applicant could nof display cars for sale or use the Dairy Queen site for off-street
parking for the motor vehicle salvage business because the zoning code, in Sec. 63.304(b),
specifies that parking must be locafed in fhe same or a less restrictive district. The Dairy Queen
site is in a more restrictive zoning district (63).
2. The proposed zoning is consistent with the way this area has developed. Sycamore Street in fhis
location acts as a boundary between the predorriinantly industrial uses on the south side and the
residential and p4anned pedestrian-oriented redevelopment on the north side. The properties
proposed for rezoning to 11 are the only ones on the south side of Sycamore that do not have 11
zoning.
3. The proposed zoning is, on balance, nat consistent with the Camprehensive Plan. Although many

4. The proposed parking and driveway access is compatible with ofher adjacent parking and
indusfrial uses. Rezoning fhe access drive fo 11 wilf eliminafe sptit zoning on a parcel. Rezonirtg
the Dairy Queen site to 11 would aliow parking accessory to the mofor vehicle salvage use. It
would also allow auto sales as a permitfed use. An altemative, rezoning the Dairy Queen site to
VP Vehicular Parkirtg, would onty allow off-sfreef perking and would preclude any,other use of the
sife. The property would need an additionai change of zoning before it could accommodate fhe
type of redevelopment envisioned by the eicisfing and proposed Comprehensive Plan.
N.OW, THEREFORE, BE !7 RESOLVED, that fhe Saint Paul Planning Commission recommends to

Chair ponnelly-Cohen announced that the orange colored papers given to the commissioners aze
the Planning Commission coznmittee assignments, their confidential contact information used for

Planning Director's Announcements
Donna Drummond reported that on February 10, 2010 the City Council approved the Downtown
Station Area Plan. Also on Febmary 17, 2010 the City Council approved a resolution
recommending/directing establishment of a transpoftation committee of the Planning
Commission. Councilmember Stazk, the author of the resolution, sent out a letter to the Planning
Commission explaining the reasons he proposed it. The resolufion was approved at City Council
unanimously and a copy was distributed to the commissioners today.

Ms. Drummond announced that the Steering Committee met today right before the Planning
Commission meeting and they discussed tYris proposal and how they would start to implement it.
This will require a by-law change by the Planning Commission, which the Steering Committee
will consider at one of its next meetings.

Commissioner Kramer said that the Zoning Committee was split on the proposed rezoning with a
3-3 vote, and therefore has no recommendation for the Planning Commission. The
commissioners have two resolutions for their considerafion, one to be used for recommeuding
approval of the rezoning and the othez to be used for-denial of the rezoning.
Commissioner Kramer stated he did not vote in fawr of the rezoning because he thought that it
was inconsistent with the 2405 Rice Street Plan, which had a very specific recommettdation
against rezoning for more industrial on Rice Street.

Cowmissioner Alton said that flus is a very small pazcel of land that was all zoned industrial for
many, many yeazs. It was rezoned to B3 after Dairy Queen was establisfied on the corner. If is
surrounded by industrial-zoned property. The applicaat has established a good business and they
need this additional space for the operation of their business. Fxcluding the other industrially
zoned properiy, the applicant's pzoperty is about 3�/z acres of land, and the site proposed for
rezoning is about 7% of tlus toYal azea. It makes more sense to have tUis poztion zoned the same
as the surrounding zoning on that lot. He stated that the commission should not base its decision .
solely on a statement in the Rice Street Plan that says the plan does not recommend additional
iadustrial land uses. The plan does not prolabit it, it just doesn't recommead it.
Commissioner Wazd spoke against approving the rezoning. He stated that the pazcel was zoned
B3 and has always been B3. Commissioner Ward presented a copy of the Rice Srieet Small Area
P1an and 40 acxe study with a map that shows the previous uses all along that interseclion as well
as the changes that were made.
Commissioner Ward said that the B3 zoning restricts auto use businesses to a certain degree, If
all of the applicanYs parcels become Il, the neighbors and neighborhood aze concemed that the
code states tfiat if it is a11 Il anydung can go thexe. It could become a used caz lot or a check
cashing piace - there aze lots of different uses permittad in Il that don't have to go before the
neighborhood. If it stays B3 a variance or conditional use permit would be needed. If it gets
changed to veIucuIar pazldng, tfien Yhere cau be condirions puf on that proper[y.
Commi ssioner Schertler asked for stafP s reasoning for the recommendalion to support the
rezoning.

Commissioner Nelson stated that they were told by Peter Wazner, Assistant City Attorney, that
the burden of proof in a case like this is on the properry owner, the person seeking the rezoning.
With as much potential confiicting land use issues going on here, it still is the burden of the
propeuy owner, and he will vote against this motion.
Commissioner Connolly asked Commissioner Ward about Dishict 6's vision for that block.
Commissioner Wazd said foz that particular comer the vision is to completely redevelop. limted
Froducts, the business to the west, has plans to make their site their corporate warehouse show
case azea. They want to move in between 30-40 employees and bring employment into the area.
Commissioner Young wanted clarification as to the property owner's intentions for the building
on the site.
Commissioner Kramer said that the owner had indicated that they would try to lease the e�sting
b�ilding. But failing that he wanted to consider other options, which might entail tearing it dov✓n.
VOTE: The motion to approve the rezoning failed on a voice vote.

Amendment to the Redevelo�ment Plan foi the Saint Paul Nei�hborhood Redevelopment Proiect
Area — State law requires that amendments to a redevelopment plan must be submitted to the
planning agency of the City for its review and for a written opinion that the redevelopment plan
conforms to the City's Comprehensive Plan. This amendment is needed to allow the expenditure
of funds from existing tas increment districts for Central Corridor improvements.
Amy Filice, PED staff, said that tlus resolution is a piece of the citywide effort to get Centrai
Corridor funded and built. Passage of these amendments by the HRA will allow them to spend
money from some of the TIF districts to improve the streetscape and provide other betterments
along the Conidor. The Metropolitan Council and the Federal government have approved certain
basic streetscape improvements along the entire corridor as part of the project, but the City would
Like a higher standazd of improvements. In looking at the various ways to finance these
"betterments" costing around 17-18 million dollazs, a variety of sources were considered. One of

• Marcus Weyandt, the applicant, expiained that Aoe Auto Parts redeveloped and expanded their
building due to a fire in 20�5 and now additiona! parking is needed. They have been working to
acquire the vaca�t Dairy Queen site for. awhile and tried to include it at the time of remodefing,
but if didn't work out. He further explained that they are trying to increase fheir revenue and
need additional room for customer parking, and the area is aiready surrounded by 11 and 12
industrial zones.
Upon questtons of the Commissioners, Mr. Weyandt stated fhat there would be about 25
parking spaces, without demolishing the vacant Dairy Queen, as a resulY of the rezoning. He
explained they would Iike lease out the vacanf buiiding and have shared parking, but if they are
not able to lease it out they would most likely tear it down. He also stated he hadn't planned or
changing the ingress/egress to the site because he believes there won't be as much trafiic as
when the Dairy Queen was operafing.
No one spoke in support.
Rodney Albers, 110 Sycamore Street, spoke in opposition. He explained he is all for improving
ihe property, but he would fike to see a p(an. He explained he has no problem if it is only going
to be used for additional parking; his concerns are with the ingress and egress. He sfated there
are too many vacant buildings on Rice Street.

At the North End Business Association meeting, February 3, 2010 District 6 requested the membership .
weigh in on this rezone. There was littfe discussion surrounding the above points brought forth, and
District 6 understands that NEBA's priority may be for business expansion, but there is overwhelming
concerns regarding adding additional zoned industrial sites on Rice Street. District 6 does not dispute the
fact that Ace Auto is for the most part a good business and District 6 supports business expansion,
however as stated above there are too many variables and unanswered questions for the Land Use Task
Force to support the rezone. It simply is unreasonable to garner support for an application to rezone a
parcel to a less restrictive use when there are no firm development plans in place.
The task force will support a rezone to VP or a more restrictive use so the site can be used for parking, as
the applicant has stated and the Task Force requests a site plan that addresses landscaping, lighting,
fencing, and i�gress and egress. At this time the task force is unable to recommend a rezone from 83 to
Il and the task torce respectfuiiy requests you take into consideration the concerns stated a�d attempt
to get more facts about any future use of the site.

At the regularly scheduled meeting of the NEBA on 2/3/2010, Ace Auto requested our support for the requested
rezoning from the floor. The stated purpose was to correct the immediate need for off street parking to
accommodate both employee and customer needs during peak business hours. We were informed that this
parking was not a permitted use on the parcel in question now owned by Ace. Hence, the request.
Most discussion from the floor centered on the long business tenure, quality operation and physical presence of
Ace Auto by the owners. The membership was aware that D6 had delayed recommending for or against the
request pending discussion by NEBA.
A motion was made, seconded and approved by the membership to support the request made by Ace Auto.

F. HISTORY/DISCUSSION: In 1953 a permit was approved for "Drive-in Refreshment" at this focation
(Fife # 2761). There is no other zoning history for the 780 Rice property (Dairy Queen site). The
property has been purchased by the appiicant, DMB, LLC, who also owns the motor vehicle salvage
business to the south.
(n 20Q5 a site pian and nonconforming use permit were approved for the motor vehicle salvage
business, Ace Auto Parts (Z.F. #s 05-138612 and 05-141662). These approvals allowed
reconstruction and enlargement of the retail portion of the business after the previous building was
damaged by fire. The reconstruction also inciuded expansion of the business onto the adjacent
parcel to its north. This parcel, formerly owned by Twin Cities Roofing, wraps around the southern
and eastern sides of the Dairy Queen parcel. This parcel has split zoning: the portion of the parcel
south of the Dairy Queen site is zoned 11, while the portion to the east is zoned B3. This B3 portion
is used for access to the motor vehicle salvage business and is legafly nonconforming.
G. DISTRICT COUNCIL RECOMMENDATION: District 6 had not provided a recommendation by the
time the staff report was prepared.
H. FINDfNGS:
1. The applicant seeks to re�one the parcel formeriy occupied by a Dairy Queen resfaurant from B3
to 11. 7he appiicant states that the purpose of the rezoning is to provide additional parking for the
• adjacent auto salvage business. In addition, the access drive from Sycamore Street to the auto
parts business is also located in the B3 district, and the rezoning of this portion of the property to
11 is also being requested.
Recent discussions between the applicant and staff in the Department of Safety and Inspections
clarified that the applicant could not display cars for sale or use the Dairy Queen site for ofif-

street parking for the motor vehicle salvage business because the zoning code, in Sec. •
63.304(b), specifies that parking must be located in the same or a less resfrictive district. The
Dairy Queen sife is in a more restrictive zoning disfrict (B3).
Z. The proposed zoning is consiste�t with the way this area has developed. Sycamore Street in
this location acfs as a boundary befween fhe predominanf(y indusfrial uses on the south side and
the residentiai and planned pedestrian-oriented redevelopment on the north side. The properties
proposed for rezoning to 11 are the onty ones on the south s+de of Sycamore thaf do not ha�e !1
zoning.
3. The proposed zoning is, on balance, consistent wifh the Comprehensive Plan. The current
Comprehensive Plan Summary and General Policy document establishes as a general goal:
To ensure a welcoming and supportive environment in fhe city for new and existing businesses.
Ftezoning the property would support an existing business. The Land Use Plan identifies this
.area as part of the Great Northern Corridor, with a goal of providing household-supporting jobs
(Objective 6.6). Further, Policy 6.6.1 sfates: The City and the PortAuthorify shoutd supporf ands
work fo impfement the Great Northern Corridor Community Vision of 9997 and should support
further redevelopment planning formore sites along the corridor_... In the City's revision of the
Comprehertsive Plan, which has now been approved by the Metropofitan Cauncil and is awaiting
final adoption by the City Council, the Land Use Chapter identifies this area as an °Opportunity
Site on Figure LU-B. Policy 1.54 states: Identify opportunity sifes for future
development...either as mixed-use development or as employment centers.... The North End-
South Como Plan Summary, adopted by the Cify Council in 2005, recommends that industrial
uses ...be consolidated over time, and appropriately buffered, in the Great Northern Corridor and
the Jackson-Ar/ington lndusfria( Park. Phased out would be industrial uses in the lower Trout
Brook corridor and the margina/ auto-relafed uses sou€h of Oakland Cemetery (east of Rice �
Street). The adopted Rice Street Small Area Plan Summary (2005) policy 4 states: The Plan
does not recommend additional industrialland uses on Rice Street. Due to their unique
geography, lack of visibility and limited access, areas near the railroad tracks are appropriate for
existing indusfrial uses to remain.
The area proposed for rezoning is within the Great Northem Corridor, and, while located on Rice
Street, would be much more easily redeveloped if the zoning were consisfenf with adjoining
properties so it could become part of a larger site. In addition, eonsolidating the split-zoned
parcel into common 11 zoning would be consistent with City policy discouraging split zoning and
wouid put the driveway in the same zoning classification as the property for which it provides
access. Whife fhe currenf proposed use of 4he property is parking, rezoning these parceis to 11
wouid facilitate eventual redevelopment that would meet the goaf of providing industrial jobs as
envisioned in the comprehensive plans of fhe City of Saint Paul.
4. The proposed parking and driveway access is compatible with other adjacent parking and
industrial uses. Rezoning the access drive to 11 will eliminate split zoning or3 a pa�cel. Rezoning
the Dairy Queen site to 11 would allow parking accessory to the motor vehicle saivage use. 1�
would also allow auto sales as a permitted use, M altemative, rezoning the Dairy Queerr s'�`e to
VP Vehicular Paricing, would only allow ofF-street parking and would preclude any other use of
the site. The propefty would need an additional change of zoning before it could accommodate
the type of redevelopment envisioned by the exisfing and proposed Comprehensive Pfan.
STAFF RECOMMENDATIOPI: Based on the above findings, staff recommends approvai of the
rezoning of 768 and 780 Rice St. (parcefs 302922330130 and 302922330241) from B3 General
Business to 11 Industrial. �

My name is Jeffrey Wick owner of Guardian Pest Solutions, Inc. located at
345 Atwater, Saint Paul, MN.
I am located about 5 blocks from the subject property's rezoning request.
I would like to express my support to rezone the property located at 780
Rice Street, from B-3 to I-1, which is contiguous to the owners 1-1 zoning.
This Saint Paul recycling company has operated at 754 Rice Street since
1929.
The KloekMleyandt family has operated ACE AUTO PARTS since 1965.
They have built a beautiful new building 2005, increasing the looks and
safety of the entire neighborhood.
I am confident that they will continue to enhance the neighborhood's
appearance and safety.
The City of Saint Paul should support the rezoning the 780 Rice Street for
an excelleM community employer.
