Presented by
WHEREAS, Department of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a one-story, wood frame single family dwelling located on property hereina8er
referred to as the "Subject Property" and commonly known as 1005 IGLEHART AVENUE.
This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before October 5, 2009, the
following are the now known interested or responsible parties for the Subject Property: Hilliard
Taylor/Mildred Taylor, 1005 Iglehart Ave, St Paul MN 5 5 1 04-5429; Brenda A Taylor-Adams,
872 Carroll Ave, St Paul MN 55104-5400; Beneficial Loan & Thrift Co, 395 N Robert Street,
Ste 102, St Paul MN 55101; Summit-University, District 8, Planning Council; and

WHEREA3, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated January 22, 2010; and
WHEREAS, this order informed the then lrnown interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by February 22, 2010; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Pau]
City Council on Tuesday, March 23, 2010 to hear testimony and evidence, and after receiving
testimony and evidence, made the recommendation to approve the request to order the interested

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by demolishing
the structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition of the shucture to be completed within fifteen (15) days after the date of the Council
Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
Apri121, 2010 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul Ciry Council hereby adopts the following Findings and
Order concerning the Subject Property at 1005 IGLEHART AVENUE.
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolifion.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition and removal of the
sriucture must be completed within fifteen (15) days after the date of the Council
Hearing.
2. If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal properiy is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The Department of Safety and Inspections has declared this hui]ding(s) to constitute a"nuisance"
as defined by Legislative Code, Chapter 45. The Department of Safety and Inspections has
issued an order to the then known responsible parties to eliminate this nuisance condition by
correcting the deficiencies or by razing and removing this building{s).
The property was re-inspected on February 22, 2010. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the blighting influence
of this property. Tt is the recommendation of the Department of Safety and Inspections that the
Ciiy Cotmcil pass a resolution ordering the responsible parties to either repair, or demolish and
remove this building in a timeiy manner, and failing that, authorize the Department of Safety and
laspections to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taxes.

The building is a one story, wood frame, single-family dwelling on a lot of 6,534 square feet.
According to our files, it has been a vacant building since July 28, 2004.
The current property owner is Hilliard Taylor/Mildred Taylor, per AMANDA and Ramsey
County Property records.
The city has had to board this building to secure it from irespass.
There have been three (3) SUMMARY ABATEMENT NOTICES since 2009.
There have been six (6) WORK ORDER(S) issued for:
- Boarding/Securing
- Improperly stored refuse, garbage and misc debris
- Removal of tall grass and weeds
On December l, 2009, an inspection of the building was conducted, a list of deficiencies wtuch
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on January 22, 2010 with a compliance date of
February 22 2010. As of this date this property remains in a condition which comprises a

INTERIOR
1. The bathroom floor covering is deteriorated or inadequate. Provide floor covering
which is impervious to water and easily cleanable throughout the bathroom and seal
around the edges and fixtures.

2. Infestation of Cockroaches. Exterminate and eliminate all cockroaches throughout tl�e
entire building. Provide this office with a copy of the extermination report from a
licensed professional Pest Control Operator, and follow their recommendations to
eradicate these pests.
3. Lacking deadbolt door locks. Provide one-inch throw deadbolt locks for all entry doors
to dwelling unit(s).
4. Due to the number of deficiencies, a Code Compliance Inspecfion will be required
before a Placard Lift will be issued.
5. Lack of Electricity. Immediately restore electrical service. Failure to provide proper
electrical service will result in these premises being declared Unfit for Human
Habifation and ordered vacated for lack of this basic facilaty. Use of candles, fuel
operated lighting or extension cord wiring is not permitted while the power is off.
6. FURNACE: Have a licensed heating contractor service and clean the furnace ar boiler
and make any necessary repairs. Perform a C/O test on the heating plant. Then, send
the aCtached form back to the Inspector. Repair of gas fired appliances requires a pennit.
7. Lack of Natural Gas Service. Immediately restore natural gas service. Failure to
provide natural gas service will result in these premises being declared Unfit for Human
Habitation and ardered vacated £or lack of this basic facility.
8. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit May Be
Raquired.
9. The interior ceilings are defective. Repair a11 ceiling defects and finish in a professional
manner.
10. The interior walls are defective. Repair all wall defects and finish in a professional
manner.
ll. Smoke Detector: Lack of properly installed and operable smoke detector. Provide
functioning smoke detectors in accordance with the attached requirement, within 24
hours.
12. Lack of Water Service. Immediately restare water service. Failure to provide water
service will result in these premises bein� deciared linfit for Human Habitation and
ordered vacated for lack of this basic facility.
EXTERIOR
The chimney is defective, deteriorated or in a state of disrepair. Replace all missino or
defective bricks, tuckpoint as needed to restore the chimney to a professionat state of
maintenance and repair. Permit may be required.

2. The eaves and soffits are in a state of disrepair or deteriaration. Repair all defects, holes,
breaks, loose or rotting boards, Yo a professional sfate of maintenance. Pern�it may be
required.
3. The exterior walls and/or trim of the house and/or garage has defective, peeled, flal<ed,
scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint to effeci a
sound condition in a professional manner.
4. The exterior walls and/or trim of the house has defective, peeled, flalced, scaled or
chalking paint or has unpainted w�od surfaces. Scrape and repaint to effect a sow�d
condition in a professional manner.
5. The foundation is deteriorated, defective or in a state of disrepair. Repair all foundation
defecis in a professional manner to a weaYher-tight, water-tight and rodent-proof
condition. Permit may be required.
6. There are missing or defeetive guardrails. Provide all stairways, porches, decks or steps
which are mare than 30" high with guardrails and intermediate rails with openings in the
guardrail no more than four {4) inches apart and in accardance with the State Buildiug
Code.
7. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace the roof
covering to a sound, tight and watar impervious condition. Permit may be required.
8. The exterior walls of the house and/or garage are defective. Repair all holes, brealcs,
loose Qr rotting siding, to a professional state of maintenance.
9. The exterior walls of the house axe defective. Repair all holes, breaks, loose or rotting
siding, to a professional state of maintenance.
10. STORM DOOR(S): The storm door(s) are in disrepair; repair or replace the door(s).
11. The window and/or door screens are missing, defective or in a state of disrepair.
Provide proper window and door screens for all openable windows and doors. Screens
must be tight-fitting and securely fastened to the frames.
12. The windows andlor storm windows are in a state of disrepair. Replace all missing or
broken window glass. Make ali necessary zepairs to frames, sashes, hardware and
associated trim in a professional mannet. Permit tnay be required.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by February 22, 2010 the Department of Safety
and Inspections, Division of Code Enforcement, wi11 begin a substantial abatetnent process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Buiidms Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-8989. This
inspect�on wil] identify specific defects, necessary repairs and legal requirements to correct th�s
nuisance condirion.
If th�s building is located in a historic district or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for

the repairs required by this order and compliance with preservation guidelines. Copies of tl�e
gwdelines and design review application and forms are available from the DepartmenC of Safety
and Inspections web site (see letterhead) and from the HPC staff: No permits will be issued
without HPC review and approval. HPC staff also can be reached by calling 651-266-9078.
As an owner or responsible party, you are required by 1aw to provide fuil and complete
disclosure of this "Order to Abate" to all interested parties, ail present or subsequent renters and
any subsequent owners. The property shall not be sold, transferred or conveyed in any manner
until the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a piacard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authoriYy of the Departsnent of Safety and Inspections,
D�vision of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" w�th the City Clerk's Office.
If corxective action is not tal:en within the rime specified in this arder, the Enforcement Officer
wi Il notify the City Council that abatement action is necessary. The City Clerk will theu
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from intexested parties. After this hearing the City Council will adopt a resolution statmg
what action if any, it deems appropriate.
If the resolution calls for abatement actioii Che Counci] may either order the City to take the
abatement action or fix a time within which this nuisance must be abaCed in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

4. Ordering the owner to remove or repair the building(s) at 1005 Iglehart Avenue within
fifteen (15) days from adoption of resolution.
The property owners of record, Hilliard Taylor and Mildred Taylor, did not appear. No other
parties of interest appeared.
Mr. Magner stated the building was a one story, wood frame, single-family dwelling on a lot of
6,534 square feet and had been vacant since July 28, 2009. A code compliance inspection had not
been done, the vacant building registration fees in the amount of $1,000 went to assessment on
October l, 2009, and the $5,000 performance bond had not been posted. On December 1, 2009, an
inspection of the building was done and a list of deficiencies which constitute a nuisance condition
was developed. An order to abate a nuisance building was posted on 7anuary 22, 2010 with a
compliance date of February 22, 2010. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the
market value of the land to be approximately $70,200 and the building to be $27,200. Real estate
taxes for 2206-2009 were delinquent in the amount of $8,333.90, plus penalty and interest. Code
Enforcement estimates the cost to repair the building to exceed $75,000. The cost for demolition
was estimated to $10,000. There had also been three summary abatements issued to this property
since 2009, six of which went to work order: to secure the building and the City had to board the
building to secure it from trespass, remove improperly stored refuse and debris, boarding/securing,
and cut tall grass and weeds. Code Enforcement recommends the building be repaired ar removed
within 15 days. Mr. Magner stated that he had met with a representative of the property who
indicated that the property owners were deceased and the daughter of the couple was requesting the
city demolish the building. He also said the photographs could not be downloaded into the system
and if they could not be retrieved, new photographs would be taken for submission.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1928, which was post-Sanborn maps, and was a stucco cottage. There was a loss context in the two
block faces with many large open lots. This property was not located in any potential historic
district and she did not believe demolition would have an adverse effect on the neighborhood.
Ms. Moermond recommended continuing the hearing to April 13 to review the photographs.
