The rehabilitation or demolition of Yhe structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, April 21, 2010 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 766 FULLER AVENUE. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). 3. That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition ha�e not been corrected. 6. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. 7. That this building has been routine]y monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. �'� ' The Saint Paul City Council hereby makes the following order: 19-411 86 87 88 89 90 91 92 93 94 95 96 97 98 99 100 101 102 103 104 105 106 107 108 The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure and correcting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition and removal of the structure must be completed within fifteen (15) days after the date of the Council Hearing. 2. If the above corrective action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fi11 the site and charge the costs incurred against the Subjeat Property pursilant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since February 17, 2005. The current property owner is An Roan, per AMANDA and Ramsey County Property records. The city has had to board this building to secure it from trespass. There have been twenty-three (23) SUMMARY ABATEMENT NOTICES since 2005. There ha�e been thirty-six (36) WORK ORDER(S) issued for: - Boarding/Securing - Iznproperly stored refuse, garbage and misc debris - Removal of tall grass and weeds - Removal of snow and ice - Other - Exterior On December 1Q 2009, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. Remove any surface bolts. I I. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc. as necessary. 12. Provide storms and screens complete and in good repair for all door and window openings. 13. Where wall and ceiling covering is removed, attic, replace doors and windows, (insulaYion, glass, weather stripping, ete.} shall meet new energy code standards. 14. Prepare and paint interior and exterior as necessary (take the necessary precautions if lead base paintis present). 15. Any framing members that do not meet code (where wall and ceiling covering is removed, members that are over-spanned, over-spaced, not being carried properly, door and window openings that are not headered, etc.) are to be reconstnzcted as per code. 16. Habitable rooms with new usage, replaced windows shall hava glass area equa] to 8% of floor area, or a minimum of 8 sq. ft., one-half of which shall operate and all bedroom windows shal] meet emergency egress requirements (20° wide minimum, 24" high minimum but not less than 5.7 sq. ft. overall). 17. Install exfension ring and cover plate on 7-box on basement ceiling. 5. Re-instal] new smoke detector to Code. 6. Electrical work requires a Permit and inspections. PLUMBING 1. Correct water piping and gas contro] valve parts at water heater. 2. The water heater was not fired or in service at the time of the inspection. 3. Provide the proper water pipe sizing. 4. Provide backflow assembly or device for water piping. 5. RPZ valve needs tesfing or service. 6. Soil and waste piping has no soil stack base cleanout. 7. Soil and waste piping has unplugged piping; backpitched piping. 8. Soil and waste piping has improper connections, transiYions, fitting or pipe usage. 9. Correct waste and vent at laundry tub. 10. Correct waste and vent at basement shower. 11. Provide a backflow assembly or device for lawn hydrants. HEATING 10-411 l. Clean and Orsat boiler burner. Check all controls for proper operation. Submit report. 2. Provide thirty (30) inches of ciearance in front of boiler for service. 3. Recommend adequate combustion air. 4. Provide support for gas lines to Code. Plug, cap and/or remove all disconnected gas lines. 5. Provide heat in every habitable room and bafhrooms. 6. Provide back flow preventer on city water fill line to hot water/steam heating system. 7. Patch chimney in basement as needed. ZONING 1. This property was inspected as being a sin�le family residence. NOTES I. Most of the roof coverin� could not be properly inspected from �rade. All items noted as recommended do not have to be completed for code compliance but should be completed at a later date. Possible purchasers of property shall be made aware of these items. As owner, agent or responsible party, you are hereby notified that if ihese deficiencies and the resulting nuisance condition is not corrected by February 22, 2010 begin a substantial abaCement process to demolish and remove the building(s). The costs of this action, inchidin� admuiistrative costs and demolition costs will be assessed against the property taxes as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-8989. This inspection will identify specific defects, necessary repairs and legal requirements to carrect tl��s nuisance condition. If thzs b�dlding is located in a historic district or site (noted above, just below the property address) then you must contact Heritage Preservation (APC) staff to discuss your proposal for the repairs required by this order and compliance with preservahon guidelines. Copies of the guidelines and design review appiicarion and forms are available from the Department of Safety and Inspections web site (see letterhead) and from the HPC staff: No permits will be issued without HPC review and approvaL HPC staff also can be reached by calling 651-266-9078 As an owner or responsible party, you are required by law to provide full and complete disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and any subsequent owners. The property shall not be sold, transfen'ed ar conveyed in any manner until the Nuisance Conditions have been abaYed and the Cerhficate of Code Compliance or Certi ficate of Occupancy has been issued. The Enforcement Officer is required by law fo post a placard on this property which declares it to be a"nuisance condition", subject to demolition and removal by the City. This placard shall not be removed without the written authority of the Department of Safety and Inspechons, Drvision of Code Enforcement. The department is further required to file a copy of this °Order to Abate" with the City Clerk's Office. lf corrective action is not taken within the time specified in this order, the Enforcement Officer will notify the City Counci] that abatement action is necessary. The City Clerk will then schedule dates for Public Hearings before the City Council at which time testimony will be l�eard from interested parties. After this hearing the City Council will adopt a resolution stating what action if any, it deems appropriate. If tl�e resolution calls for abatement action the Council may either arder the City to take the abatement action or fix a time within which this nuisance must be abated in accordance witli tlte provisions of Chapter 33 of the Saint Paui Legislative Code and provide that if corrective act�on is not taken within the specified time, the City shall abate this nuisance. The property owner of record, An Roan, did not appear. No other parties of interest appeared. Mr. Magner stated the buildang was a one and one-half story, wood frame, single-family dwelling on a lot of 4,356 square feet and had been vacant since February 17, 2005. A code compliance inspection had not been done, the vacant building registxation fees in the amount of $1,100 went to assessment on March 18, 2010, and the $5,000 performance bond had not been posted. On December 10, 2009, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on January 22, 2010 with a compliance date of February 22, 2010. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $18,200 and the building to be $66,500. Real estate taxes for 2006-2009 were delinquent in the amount of $18,485.70, plus penalty and interest. Code Enforcement estimates the cost to repair the building to exceed $75,000. The cost for demolition was estimated to exceed $10,000. There had also been 23 summary abatements isued to this property since 2005, 36 of wbich went to work order: to secure the building and the City had to board the building to secure it from trespass, xemove improperly stored refuse and debris, boardinglsecuring, cut tall grass and weeds, remove snow and ice, and other exterior violations. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner noted that this property had previously been through the Legislative Hearing process on March 11 and 25, 2008 and the recommendation to the City Council was to remove the building witt�in 15 days. On Apri124, 2008, the City Council adopted that resolution. He presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1916 and was a bungalow-style building. The block faces were intact with no vacant lots and although there was some infill housing, the homes were all similar in style. The property was located outside of the potential Frogtown historic district, it had not been surveyed and although it did not have any historic potential on its own, she strongly encouraged rehab of the building. She noted that this property was located in an Invest St. Paul neighborhood. Ms. Moermond recommended continuing the hearing to Apri1 13 in order to see where this property was at in the tax forfeiture process; if it were to become the possession of the county in the very ne� future, possibly the HRA may have interest in purchasing the properiy for rehabilitation. 10-411 April 13, 2010 Minutes of the Legislative Hearing Page 3 Ordering the owner to remove or repair the building(s) at 766 Fuller Avenue within fifteen (15) days from adoption ofresolution. (Continued from March 23) Mr. Magner stated that according to a memo from Ms. Vang, she contacted Ramsey County and the property is subject to tas forfeiture on May 3, 2010 with the property owner having the right to redeem the property by August 2, 2010 by paying all delinquent taYes for the years 2006-2009. The property owner also qualifies for a 10-year Confession of Judgment. He said this has been a vacant building since February 2005 and this was the second round through the legislative hearing process. It appeared the mortgage company had written this property off as a total loss or he believed they would have paid the property taxes. Ms Moermond stated that unless the ARA was interested in the property, she recommended the building be removed or repaired within 15 days.
