This is in the matter of the appeal of P. W. Manson to establish a new front
building line on lot 12 - block 15 - St. Anthony Park North Addition. This
property is located adjacent to the east side of Hythe Street between Hendon
and Buford. The zoning is "A" residence.
The property is presently vacant and has a frontage of 50' on Hythe and extends
east a.depth of 150' . The applicant proposes to construct a single-family home.
' In conjunction this proposal he is asking the Council for permission to con-
3 struct his hom- 40' •ack from Hythe Street instead of the 53' required by present
regulations.
- —The applicant's proposal is outlined in detail in his letter of July 23, 1956 and
is illustrated on a map of this block, copies of which are attached to this file.
Briefly, the applicant is proposing to construct a house which is rather long in
relationship to its average width thus producing a substantial side yard on the
southerly side of this 50' lot. If the type of building contemplated is constructed
53' back from Hythe, a large oak tree at the rear of his lot would have to be
removed. As an alternative, the applicant is asking to be allowed to construct his
home 40' from Hythe. The neighbors on either side of the property in question have
recorded their approval of this proposal in' a letter dated July 23, 1956 addressed
to Mayor Dillon.
The Zoning Board finds that the granting of this appeal would substantially secure
the intent and purpose of the zoning ordinance in establishing set-back lines and.
would not materially affect the rights and interests of abutting property owners.
' The property under consideration is approximately 10' above street grade and, if
the plan contemplated is pursued, the open and spacious quality of this neighbor-
hood will certainly be maintained. The Board further finds that the actual change
in the building line which would be produced would, from the standpoint of the
visual effects produced on the ground, not be material. In fact, the Board has •
noted in similar circumstances a minor transition of one building line to another
within a block often produces architectu 1 variety which is more pleasing than a
simple row of houses arranged in a straig t line.
In consideration of these factors, the ing Board recommends that this appeal
be granted.

Herewith I am requesting permission to set the "back line" of my new home which
is to be located at 1470 Hythe Street, a distance of 40 or 41 feet back from
the west sidewalk as noted on the attached sheet.
The sketch will show the "back line" location of all homes on the west side of
the block. The Roehrich, Koller and Hayes homes were built prior to 1922. The
Roehrich home faces north on a double-size lot. The lots in this block are
50 feet wide and 150 feet long.
The Koller and the Hayes homes were built approximately 47 and 49 feet back from
street sidewalk because of the steep topographic features on the west ends of
their lots. The Koller home has heavy, concrete steps on the front of their home
that extend some 6 feet in front of their home. These steps are now about 3i
feet above a filled-in grade.
If my house is placed in line with the Koller's, it will be necessary to remove
a large and beautiful 2 to 3-foot oak tree. The possible removal of this tree
has truly disturbed neighbors in my block. It is therefore my hope that I will
be permitted to locate the house about 40 feet back from the sidewalk on approx-
imate line with the lower step of the concrete steps on the front of the Koller
home.
The University of Minnesota Forestry Department recommend an $ to 10 foot distance
between the foundation and the tree.
I might add that the building of this home as described on the blue prints will
greatly improve the view to the west of all homes concerned. At present the
vacant lot has a hedge on the west and north sides that has grown to a height of
15 feet and which really obstructs the view.
I have discussed the above described "back line" proposal with my neighbors and
to date have received no objections. In fact, I have received encouragement to
approach the Council with this plan.
If you need more information, I will be most happy to appear before the Council
to further explain the problem. +,
