ANDERSON,License Inspector July 24, 1956 Honorable Mayor and City Council Saint Paul, Minnesota Gentlemen and Madam: In response to Mr. Godfrey's reference to the City Charter and the Laws of 1885, which further prohibit any such places, even though outside of the patrol limits, from being within a half-mile of any school or college, in his letter of June 27, 1956, the following is quoted. In an opinion given by the Corporation Counsel, dated October 29, 1953, the following was given, "Under Chapter 78, Section 2 of Session Laws of 1935, now Minnesota Statutes Annotated, Section 340.58, this half mile limitation has been changed to 1500 feet of any academy, college, or university of higher education within any of the aforementioned tracts." Snelling Avenu City of Saint Paul, Minnesota, Gentlemen and Madam: We wish to make objection to the issuing of a liquor license for the premises 138 North Snelling Avenue, St. Paul, Minnesota. It appears from signs in the window of the Park Liquors Inc, Arthur P. Bendel, president, at 168 No. Snelling Avenue, next to the corner of Selby Avenue, that they have in mind moving to the new address, at 138 No. Snelling Avenue. So far as is known, there does not appear to have been any hearing on such issuance of license, or transfer to, such premises at 138 No. Snelling Avenue. Calvary Evangelical United Brethern Church, at 1Z3 No. Saratoga Street, and extending toward Snelling on Laurel Avenue, is less than a block from the location in question, diagonally thru the block, from Snelling, near Hague. Macalester College is on the southwest corner of Summit and Snelling, and its two girls dormitories are on the southeast corner. Immaculate Heart of Mary Church is in the middle of the block, on south side of Summit, just east of Snelling. Its residence buildingj, on the north side of Summit Avenue, near Snelling are still closer to the location in question. St. Faults Church on the Hill, is on the southwest corner of Summit and Saratoga, extending to the west toward Snelling Avenue. Macalester Collegets Woods Kindergarten School is on the north side of Summit Avenue, a short distance west of Snelling Avenue. Attention is called to the fact that this part of the 11th Ward is in the patrol district, in which no liquor of malt beverages are allowed to be sold, under the City Charter and the Laws of 1885, which further prohibit any such places, even though outside the patrol limits, from being within a half-mile of any school or college. It is requested, respectfully, that any application when made, for issuance or, or #transfer of, a license for sale of any liquors or malt beverages at 138 N.Snelli ve ,be denied.
