July 18, 1956 Mr. Joseph Okoneski City Clerk Building bo Dear Sir: it■ 1QrrIs^ This is in the matter oft,Josepb Kielsa to re-zone from "A" residence to "Commercial" lots 6, 7, 8, 9 and 10 - block 14, Beaver Lake Weights addition. This property is located adjacent to the southeast corner of Jordan and Stillwater. The petition has been certified as sufficient by the Commissioner of Finance. There are presently two single-family homes which front on Stillwater on this site, the remainder of the land is vacant. The property has a frontage of 150' on Stillwater and extends southerly approximately 230' along Jordan. This is an irregular tract of ground with an area of 32,905 sq. ft. or .75 acres. The applicant proposes to expand an existing commercial shopping center which is located to the east in the vicinity of Stillwater and Iriquois, by adding to the site the area contemplated in the present re-zoning. The general site plan filed by the applicant June 5, 1956 shows the approximate nature of the relationships to be established. Briefly, a building running parallel to Stillwater Avenue set back adjacent to the south property line, with parking in the front or adjacent to the northerly site of the building, is contemplated. The general arrangement of the traffic facilities into this proposed plan have been approved by the Traffic Engineer. Studies on the part of the Zoning Board have indicated that there is a demon- strated need for a neighborhood shopping center at this point and that the area would actually benefit from the facility contemplated provided that certain measures are taken to protect the public interest in general and adjacent property in particular. In considering the conditions under which this proposal could be approved, the Zoning Board feels: (1) The detailed plans for the development should be reviewed by the appropri- ate city agencies at such time as they are developed and, (2) A minimum parking ratio of one-to-one be maintained, (3) That any buildings be set back a distance of 20' along Jordan and set back from adjacent property to the south a distance of 4' . Re: J. Kielsa As a practical matter, the applicant will have to request an explicit permit from the City Council to establish a parking lot and it will be also necessary to file an appeal for a change in building line along Jordan before be can proceed with his plans. Therefore, the Zoning Board is confident that an ample opportunity will be afforded for the review of the detailed plan which was mentioned above. Pursuant to the conditions mentioned above and in the light of the fact that there is a need for additional shopping facilities in this part of the community and that the applicant's plans actually contemplate a westerly expansion and enlargement of an existing shopping center, the Zoning Board finds that this petition to re-classify the property under consideration is a proper one and recommends that it be granted.
