This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: . ,I)ti Section 1. That permission and authority are hereby granted to Bisanz Bros. Construction Company to construct a sewer, at its own expense, in Worcester Avenue from Return Court to Cleveland Avenue; in Morgan Avenue from Return Court to 110 feet east of Cleveland Avenue and from Morgan Avenue to i)- Worcester Avenue in a ten foot wide easement (deeded to the City of Saint Paul by Bisanz Bros. Construction Company by warranty. deed dated June 29, 1956) , said easement being described as the westerly 5 feet of Lots 4 and 26 and the easterly 5 feet of Lots 1, 2 and 3, all in Block 8 of Bisanz Highland Plains No. 2, according to the plat thereof on file and of record in the office of the Register of Deeds in and for Ramsey County, Minnesota. Section 2. The Commissioner of Public Works is hereby authorized to issue a permit to Bisanz Bros. Construction Company for the construction of said sewer, upon its compliance with the following conditions, viz: 1. Said permittee shall construct said sewer entirely at its own expense, under the supervision and to the satisfaction of the Commissioner of Public Works, and in accordance with the plans and specifications approved by the Chief Engineer of the City of Saint Paul. 2. Said permittee shall pay the cost of engi- neering and inspection of said work, and for the O, .'c(% publication of this ordinance. ` 3. Said permittee, after the inception of said work, shall prosecute same continuously, with diligence, and fully complete said work, to the satisfaction and approval of said Commissioner, on or before January 1, 1957. 5. Said permittee shall furnish a bond to the City of Saint Paul in the sum of $10,000, conditioned to comply with all the terms of this ordinance, and to indemnify and save harmless said City from all liability, charges, loss, judgments, suits, costs or expense that may accrue to persons or property occasioned by the making of said improvement or arising out of the same. 6. Said permittee shall, within ten days after the passage of this ordinance, file a written acceptance thereof with the City Clerk. Section 3. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 4. Construction Company to construct a sewer in Worcester Avenue from Return Court to Cleveland Avenue; in Morgan Avenue from Return Court to 110 ft. east of Cleveland Avenue and from Morgan Avenue to Worcester Avenue in a 10 ft. wide easement(to be deeded to the City of St.Paul), said easement being described as the Westerly 5 ft. of Lots 4 and 26 and the Easterly 5 ft. of Lots 1,2 and 3, all in Block 8 of Bisans Highland Plains No.2, according to the plat thereof on file and of record in the Office of the Register of Deeds in and for Ramsey County, Minnesbta. This work shall be done in accordance with the plans and specifications approved by the Chief Engineer of the City of St.Paul. Any cost for the engineering and inspection incurred by the City in this connection is to be paid for by Bisans Bros. Construction Company. A bond in the amount of $10,000 will be required, and this ordinance shall be drawn as an emergency ordinance. Time of completion shall be January 1st, 1957. Attached hereto please find a Warranty Deed for the easement mentioned in the proposed ordinance.
