An ordinance authorizing the issuance of a permit
to First National Bank of St. Paul, a corporation, to c nstruct
and install a 36" diameter reinforced concrete pipe tunnel or
conduit across Fourth Street from a point on the south side of
Fourth Street 162 feet east of the east line of Minnesota Street
to a point 146 feet east of the east line of Minnesota Street on
the north side of Fourth Street, at a depth of 15 feet 0 inches
from the surface of the paving on the center line of Fourth Strut
to the top of the tunnel. This is an emergency ordinance rendered
necessary for the preservation of the public peace, heath and
safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That upon compliance with the conditions
hereinafter set out, the Commissioner of Public Works is author-
ized to issue a permit to First National Bank of St. Paul, a
corporation, to construct and install a 36" diameter reinforced
concrete pipe tunnel or conduit across Fourth Street from a point
on the south side of Fourth Street 162 feet east of the east line
of Minnesota Street to a point 146 feet east of the east line of
Minnesota Street on the north side of Fourth Street, at a depth
of 15 feet 6 inches from the surface of the paving on the center
line of Fourth Street to the top of the tunnel, as shown, together
with other details, on Sheet 15 of the plans, Job No. 5607, as
prepared by Bettenburg, Townsend, Stolte and Comb, Architects and
Engineers. The conditions are as follows:
1. Permittee shall file plans and specifications
for said work with the Commissioner of Public Works,
which plans and specifications shall be approved by
said Commissioner and the Chief Engineer of the City,
and said construction shall be subject to supervision
and inspection by said Commissioner and said Chief
Engineer. Permittee shall pay the cost of inspection,
if any.
C ' , 2. Permittee shall take special care in the con-
u) struction of the aforesaid tunnel to prevent loss of ground
and consequent subsidence of Fourth Street at the tunnel

other public construction within the limits of the

3. Said permittee shall properly protect all exca
vations made in the street both day and night so as to

with diligence, and fully complete said
work, to the satisfaction and approval of
said Commissioner, on or before July 1, 1957.
5. Permittee shall furnish a bond of
$10,000 to the City of Saint Paul, conditioned
to save said City harmless from any and all
liability, judgments, suits, costs, charges,
damage or expense accruing to person or
property, arising out of the construction,
maintenance, use, presence, or removal of said
tunnel. Said bond shall be satisfactory to
the Commissioner of Finance as to surety, to
the Corporation Counsel as to form and execution,
and shall be filed with the City Comptroller.
6. Permittee shall pay the cost of the
publication of this ordinance.
7. Permittee shall, within ten days after
the publication of this ordinance, file a
written acceptance thereof with the City Clerk.
8. This permit may be revoked by the
Council at any time, and thereupon permittee
shall remove said tunnel: ,.
Section 2. This ordinance is hereby declared to be
an emergency ordinance rendered necessary for the preservation
of the public peace, health and safety.
Section 3. This ordinance shall take effect and be
in force upon its passage, aproval and publication.
