RESOLVED, By the Cou it of the City of Saint Paul, that it satisfac-
torily appears from the p nent joint reports by the Commissioner of Public //""
Works and the Commissioner of Public Utilities, addressed to the Council under1the
date of the 12th day of December, 1955, and upon the Council's consideration
of said joint report and its due investigation otherwise in the premises, the
Council finds that The St. Paul City Railway Company in connection therewith
and as part of its operations in the conversion of its street railway system
from electric streetcar to motor bus common carrier mode of passenger trans-
portation, in full compliance with all obligations therefor imposed upon said
Company by law in the premises and at said Company's own cost and expense,
removed or caused to be removed all of said Company's street railway rails,
ties, poles, wires and appurtenances (to the extent required by the City of
Saint Paul), therefrom and restored or caused to be restored, as respects the
surface conditions of the same, the following sections of paved public streets,
particularly within the portions of said sections of public streets heretofore
allocated to said Company for street railway right-of-way purposes, within
the corporate limits of said City of Saint Paul, and in respect thereto said
Company hereby is released by City of Saint Paul from any further requirement
for the removal of street railway rails, ties, poles, wires and appurtenances
therefrom and for the restoration of the surface conditions of said sections
of public streets, respectively, heretofore imposed upon said Company for
the same or any of the same by any ordinance or resolution of this Council,
any statute of the State of Minnesota, and :or any agreement by and between
said City and Company, such sections of public streets being those hereinafter
listed under the title "Paved Streets", to-wits

It is consequently recommended that the City Council, by resolu-
tion, release the St. Paul City Railway Company from further require-
ments for the removal of street railway rails, ties, poles and appurten-
ances and restoration of the surface conditions for the aforesaid public
streets.
It is further recommended that the City of St. Paul accept a
Bill of Sale dated November 28, 1955 for such track and paving items
as remain, but not including underground power cable ducts, manholes
and manhole frames, covers and power cables contained therein.

Gentlemen:
We beg leave to report that in connection with and as part
of the necessary operations in the conversion of the St. Paul public
transportation system from electric streetcar to the motor bus common
carrier, the St. Paul City Railway Company has complied with all ob-
ligations imposed upon said Company in connection with the removal of
street railway rails and ties, pales, wires and appurtenances, to the
extent required by the City of St. Paul, on the following paved public
streets, particularly within the portions of said sections of public
streets heretofore allocated to said Company for street railway right-
of-way purposes:

RESOLVED FURTHER, That the proper City officers hereby are authorized
to make and deliver in behalf of the City of Saint Paul, any agreement or other
instrument of acquittance by and between said City and said Company conformable
to this resolution and approved as to form and execution by the Corporation
Counsel; provided, nevertheless, that said City reserves that certain claim
in the aggregate sum of $45,606.43, against said company set forth and defined
in the prior resolution of this Council, C. F. 178865, approved July 20, 1956,
on account of said City's removals of said company's street railway rails,
ties, poles, wires and appurtenances therefrom and said City's restorations
as respects to surface conditions of the same in said street railway right
of way portions of the several sections of public streets specified in said
prior resolution for and at the instance of said company and pursuant to
an agreement theretofore made by and between them and now subsisting and
mentioned therein, said prior resolution being hereby incorporated herein
and made part and parcel hereof with the same intent, purpose and effect
as if said prior resolution were set forth herein verbatim.
RESOLVED FURTHER, That said company's full payment to said City of the
latter's said claim as set forth in said prior resolution, in the aggregate
sum of $45,606.43, shall be a condition precedent to the making and delivery

Sale made and executed by said Company, as vendor, to and in favor of said City,
as vendee, hereby is in all things authorized, ratified and confirmed, such
Bill of Sale, for a mere nominal consideration having4im0e provision therefor
and effected the grant and conveyance by said Company unto said City, of
all the following described personal proppety, to-wits
(a) All railways tracks located in the following streets in
St. Paul, fey County, Minnesota, to-wits

(b) All the track structure, within the aforesaid locations,
consisting of straight and special tracks constructed
rails, frogs, switches, mates, crossings, rail joint
splices, ties, screw and standard spikes, tie plates, tie rods,
cast steel track drain frames and covers with concrete basins
and tile pipes, gravel or crushed stone ballast, paving and
paving foundation between the rails and two (2) feet outside
the outside rails of the tracks.
The above description of tracks and paving is not intended to
include underground power cable ducts, moles, manhole frames
and covers and power cables contained therein, within the limits
of the above specified locations.
