PA t ''etiw 1.7( art '•` J r�, COUNCIL NO_ 5 t fl)14 ..., OFFICE OF THE CITY CLERK NCIL RESOLUTION-GENERAL FORM BY COMM SSDIONE A L DATE P /IWf/iF RESOLVED, By the Cou it of the City of Saint Paul, that it satisfac- torily appears from the p nent joint reports by the Commissioner of Public //"" Works and the Commissioner of Public Utilities, addressed to the Council under1the date of the 12th day of December, 1955, and upon the Council's consideration of said joint report and its due investigation otherwise in the premises, the Council finds that The St. Paul City Railway Company in connection therewith and as part of its operations in the conversion of its street railway system from electric streetcar to motor bus common carrier mode of passenger trans- portation, in full compliance with all obligations therefor imposed upon said Company by law in the premises and at said Company's own cost and expense, removed or caused to be removed all of said Company's street railway rails, ties, poles, wires and appurtenances (to the extent required by the City of Saint Paul), therefrom and restored or caused to be restored, as respects the surface conditions of the same, the following sections of paved public streets, particularly within the portions of said sections of public streets heretofore allocated to said Company for street railway right-of-way purposes, within the corporate limits of said City of Saint Paul, and in respect thereto said Company hereby is released by City of Saint Paul from any further requirement for the removal of street railway rails, ties, poles, wires and appurtenances therefrom and for the restoration of the surface conditions of said sections of public streets, respectively, heretofore imposed upon said Company for the same or any of the same by any ordinance or resolution of this Council, any statute of the State of Minnesota, and :or any agreement by and between said City and Company, such sections of public streets being those hereinafter listed under the title "Paved Streets", to-wits PAVED STREETS Como Avenue from Snelling Avenue to Raymond Avenue Como Avenue from Rice Street to Dale Street Concord Street from Robert Street to Curtice Street Fourth Street from Kellogg Boulevard to Broadway Street Payne Avenue from Omaha Bridge to York Avenue Robert Street from Kellogg Boulevard to Concord Street Seventh Street E. from Minnehaha Avenue to Johnson Parkway Seventh Street from Kellogg Boulevard to Sibley Street Smith Street from George Street to Annapolis Street COUNCILMEN Adopted by the Council 195_ Yeas Nays DeCourcy Holland Approved 195_ Marzitelli b -fin Favor Peterson Mayor Rosen Against Mr.President, Dillon 5M 6-56 00P02 To The City Council -2- December 1, 1955 It is consequently recommended that the City Council, by resolu- tion, release the St. Paul City Railway Company from further require- ments for the removal of street railway rails, ties, poles and appurten- ances and restoration of the surface conditions for the aforesaid public streets. It is further recommended that the City of St. Paul accept a Bill of Sale dated November 28, 1955 for such track and paving items as remain, but not including underground power cable ducts, manholes and manhole frames, covers and power cables contained therein. F. 178865, approved July 20, 1956, on account of said City's removals of said company's street railway rails, ties, poles, wires and appurtenances therefrom and said City's restorations as respects to surface conditions of the same in said street railway right of way portions of the several sections of public streets specified in said prior resolution for and at the instance of said company and pursuant to an agreement theretofore made by and between them and now subsisting and mentioned therein, said prior resolution being hereby incorporated herein and made part and parcel hereof with the same intent, purpose and effect as if said prior resolution were set forth herein verbatim. The above description of tracks and paving is not intended to include underground power cable ducts, moles, manhole frames and covers and power cables contained therein, within the limits of the above specified locations.
