The City of Saint Paul, Department of Department of Safety and Inspections has inspected the
above referenced properiy on February Ol, 2010 and has determined that the following
deficiencies exist in violation of the Saint Paul Legislative Code'
The structare is a registered vacant building and must have a Code Compliance Certificate
before the structure may be occupied. Immediately vacate the structure or obtain a Code
Compliance Certificate from DSI You may contact Jim Seeger at DSI for code compliance
inspection, permits, and issuance of Code Compliance Ceftificate. Under Chapter 33.03 of the
Saint Paul Legislative Code, failure to obtain a Code Compliance Certificate or to vacate the
structure may result in issuance of criminal summonses.
You are hereby notified to correct these deficiencies in accordance with the appropriate codes.
The Enfarcement Officer will reinspect these premises on or after February 08, 2010, by which
dz±e the violaYions noted r!mus± be cor!�ected. Failure to correct thesz deficiencies may result in
the issuance of criminal charges andfor a civil lawsuit, and possible abatement(assessment by
the City. All repairs and new installations must be made in accordance with the appropriate
codes. Permits may be obtained by calling 651-266-9090.
You may file an appeal to this notice by contacting the City Clerk's Office at 651-266-&688. Any
appeal must be made in writing within 10 days of this notice. (You must submit a copy o£ this
Notice when you appeal, and pay a filing fee.)

10. Appeal of Raymond Hessler to a Correction Notice far property at 614 Edmund Avenue.
Appellant Raymond Hessler (P.O. Box 7419, St. Paul, MN 55107) appeared.
Mr. Domfeld gave a staff report. He stated that a vacant building file had been opened on March
19, 2009, and Scott Murray, the property owner at that time, had asked for and been granted two 90-
day extensions of the Category 1 status and waiver of the vacant building fee. He said that Mr.
Murray requested an additional extension and was granted 30 days on the condition the C of O be
reinstated in that time. He said Inspector Martin did not grant the C of O and the property was
referred back as a Category 2. The denial of the C of O was verbally appealed by Mr. Hessler, and
Mr. Urmann re-inspected with Inspector Martin and confirmed the Category 2 recommendation.
Ms. Moermond reviewed the building permit history online. She asked Mr. Hessler about his
involvement in the situation.
Mr. Hessler said he had acquired the property in December from Scott Murray. He said it had taken
too long to complete the work and they had failed to do basic things like pull a permit for the
asbestos removal, but the only remaining issues were exterior. He said that Inspector Martin had
sent the orders to Mr. Munay who was in Florida and not responding. He knew that Inspector
Martin had found only minor problems and she had not mentioned to him that there was a problem
with the asbestos, so he thought everything on the list had been addressed. After Inspector Urmann
had denied the C of O because of the asbestos removal, a licensed contractor had looked at the work
and hadn't seen anything wrong. He said Mr. Murray had done some work without a permit but
that he (Mr. Hessler) had immediately hired licensed contractors. He said he had just discovered
that the plumber had not pulled a permit, but he had receipts to show the work was done. He said it
was not a Category 2 building, and reiterated that the work was all done except for some exterior
things which he was working on. He submitted receipts for the work that had been done and
documentation of the delays in getting a check from the insurance company.
Ms. Moermond asked Mr. Hessler when he had acquired the property from Mr. Murray. Mr.
Hessler said Mr. Murray had signed a Quit Claim Deed in December but it hadn't been filed. He
reiterated that all of the work was done and he had receipts to document it.
Mr. Ubi noted that there was not a plumbing permit or inspection. Mr. Hessler referred Mr. Ubl to
Cities Plumbing and Heating receipts he had submitted. He said a shower-tub valve, a new toilet
and other minor things were done. Ms. Moermond stated that if a permit hadn't been pulled, as far
as she was concerned, the work wasn't done. Mr. Ubl said he was looking for the work to be done
by a licensed plumber. He said Mr. Hessler should pull a permit and have the work inspected or
have the contractor contact the inspector. Ms. Moermond reiterated that she would treat it like it
wasn't done until it was signed off.
Inspector Urmann stated that the Category 2 had continued because the work had not been done
under permit and could not be approved. Ms. Moermond asked how it had happened that a there
was January 29 condemnation revoking the C of O when a C of O had not been issued. Mr.
Urmann responded that the property had been condemned since March 2009 and the C of O was
never reinstated. Mr. Hessler noted that the property was a Category 1 at that time.

Ms. Moermond said there were still a lot of arders outstanding and asked whether February 1 was
the most recent inspection. Mr. Hessler stated that the last inspection was January 17. Mr. Urmann
said the last letter sent was January 29, 2010; he said the letters were being sent to the owner of
record. Mr. Hessler said he didn't know what orders were being referred to, and the last bit of
information he had was regarding the asbestos and that was done.
Ms. Moermond asked when the property was rented. Mr. Hessler stated that the building was
occupied but not rented; he said he had made it available to an elderly couple who would have been
homeless otherwise. Ms. Moermond noted that there was no C of O or clear ownership, and that as
an experienced property owner, Mr. Hessler should know better. Mr. Hessler said the residents
hadn't moved in until after the final inspection and that he was an agent for Mr. Murray. Ms.
Moermond said the plumbing had not yet been inspected. Mr. Hessler said Inspector Martin had
told him that a receipt was adequate documentation that the work had been done. Inspector Urmann
said that was not accurate.
Mr. Ubl reviewed the documentation provided by Mr. Hessler. He said plumbing and gas lines had
not been inspected, and the building was not safe for occupancy. Mr. Hessler said he was honestly
under the impression that having receipts frotn a certified licensed contractor was adequate. He
recalled that the plumber had tried to pull a permit but there had been a c3ouble flag. Ms. Moermond
clarified that when a permit was pulled after the work had been done there is a double fee. Mr.
Heesler said he had paid the plumber in full and the permit should have been pulled, and would be
pulled.
Ms. Moermond said she would recommend that the appeal be denied and the building remain as a
Category 2. She stated that the plumbing could not be considered complete because it had not been
done under permit; a full code compliance inspection and vacant building fee payment would be
required. She asked the effective date ofthe vacant building fee. Mr. Domfeld responded that it
had been assessed.
Mr. Hessler said he didn't understand why when the work was done and the plumbers had been paid
in full to pull a permit and do the work; he asked that the building should become a Category 2
because of the plumbing. Ms. Moermond said her decision was that the building should continue to
be a Category 2 and if the plumbing had been done under permit, there might haue been the
possibility for a conversation. Since the plumbing wasn't done under permit, she wasn't as
confident about the other things that needed to be done, and she wanted to see a complete code
compliance inspection. She acknowledged that the code compliance meant a significant
expenditure of money and said she would set the matter up for a public hearing so Mr. Hessler
could make his case to the City Council on March 17.
Mr. Hessler reiterated his objections and frustrations with the decision. He said the plumber had
been paid to pull a permit and the property should not become a Category 2 because of the
plumbing. Mr. Ubl said the plumbing work included gas lines. Ms. Moermond stated that the
house already was a Category 2 because it had not met the fire exemption requirements and her
decision was not causing the property to become a Category 2. She said the house must be vacated
by March 19.
Mr. Dornfeld noted that Mr. Hessler and Mr, Murray had been tagged for allowing occupancy of a
registered vacant building.
