Appeal of Earline Cyrus to a Notice of Condemnation and Order to Vacate property at 228 Edmund Avenue, Unit #1. Earline Cyrus, appellant/tenant, appeared. Carl Harris, friend of Ms. Cyrus also appeared. Leanna Shaff, Inspector Supervisor, DSI — Fire, appeared on behalf of the department. The property owner, Alvena and Norman Farrar, were not present at the hearing. Ms. Shaff stated Inspector Cummings received a referral from the St. Paul Police Department on February 5, 2010 concerning nuisance activities and scheduled an inspection of the property. The property owner attempted to cancel the appointment scheduled for February 17, 2010 and failed to show up indicating that the property was in foreclosure and both tenants had been served eviction notices. The tenants were present and allowed enhy to the building and numerous deficiencies were found. On March 2, 2010, the property was re-inspected and no one showed up far the scheduled appointment. Due to the number of life/safety issues noted, Inspector Cummings placarded the building revoking the C of O with a vacation date of March 12. Upon the first inspection of the building, Inspector Cummings found that the tenants were using the ovens to heat the units, there were missing smoke detectors, no carbon monoxide detectors, and the furnace had holes in the duct work. Inspector Cummings also noted that the sidewalk was not being maintained and she had faIlen on the icy sidewalk. It appeared that since the owners were in foreclosure, they had no intention of making any of the repairs. Ms. Cyrus stated that the tenants in unit 2 had the police issues and were using the oven to heat their unit. 3he said she did not use her oven to heat her unit as her unit was very wann and the heat would only kick on when the thermostat was set at 70. She said she had been looking far another place to live since receiving the eviction notice from the landlord, but did not believe she was being given enough time to look for a place and did not have the money to move. She said she had been current on her rent payments with the exception of the payment for Mazch given the condemnation and order to vacate. The landlord told her that the upstairs tenant was supposed to move out at the end of January; however, they were still there. She requested an extension of 60 days to vacate the building. Ms. Shaff and Ms. Moermond asked Ms. Cyrus whether she had legal representation. Ms. Cyrus responded that she did not. Ms. Moermond referred her to SMRLS concerning landlord/tenant issues particularly since she had not paid the March rent and suggested they may be able to assist her. Ms. Moermond recommended denying the appeal and granting an extension to April 15, 2010 to vacate unit # 1 of the building. She indicated to Ms. Cyrus that this only applied to the city enforcement of a vacate date and that the property owner could have her removed through other actions prior to April 15. She suggested she find another place to live beginning April 1 which would then give her time to move her belongings.
