WHEREAS; the 1955 contract for the construction of and repair of side-
walks in the City of St. Paul, Comptroller's Contract I- 5590 Pederson
brothers, contractors, has been completed, said completion having been
delayed until late 1956 by causes beyond the control of the contractor,,
and
WHEREAS: Said contractor requests that a portion of the five percent (5%)
retained from estimates for work done under this contract during 1955 and
1956 be paid in advance of the final payment of the contract, and
WHEREAS: The Commissioner of Public Works and the Chief Enginee of said
department approve the payment at this time of $3,000.00 of the 3,535.92
retained percentage for the aforesaid contract; therefore be it i
RESOLVED, That the proper City officers be and they are hereby authorized
to pay an estimate in the amount of $3,000.00 from the retained percentage
of $3,535.92 to said contractor; and be it
FURTHER RESOLVED; That this resolution shall have no force or effect un-
less the sureties on the contractor's bond consent thereto in writing and
file such consent with the City Gomptroller.
