_Pil,rt An ordinance granting permission to Thorne Coal & Oil Company
to construct, at its own expense, a public sewer on Carroll
Avenue from Pascal Street to approximately 248 feet east of
Pascal Street. This is an emergency ordinance rendered
necessary for the preservation of the public peace, health and
safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That permission and authority are hereby granted
to Thorne Coal & Oil Company to construct a public sewer, at its
own expense, on Carroll Avenue from Pascal Street to approximately
248 feet east of Pascal Street, said sewer being for the purpose
of serving the following tract of land:
That part of a portion of Lot 15, Auditor' s
Subdivision No. 27 (Kittsondale) that is north
of a line parallel to the south line of Carroll
Avenue (produced) and 130 feet south of said
south line of Carroll Avenue, the aforesaid
portion of said Lot 15 being described as follows: .
Beginning at the southwest corner of Lot
15, Auditor's Subdivision No. 27 (Kittsondale) ;
thence east along the north line of Marshall
Avenue a distance of 114 feet; thence north at
right angle to Marshall Avenue a distance of
114 feet; thence west at right angles to the

thence northeasterly on a line parallel with and
2 4.35 feet northwesterly at right angles from the
center line of the spur track to a point on the
north line of and 264.13 feet from the northwest
corner of said Lot 15; thence to the said northwest

Section 2. The Commissioner of Public Works is hereby
authorized to issue a permit tosaid Thorne Coal & Oil Company
for the construction of said sewer upon compliance with the
following conditions, viz:
1. Said permittee shall construct said sewer
entirely at its own expense, under the supervision
and to the satisfaction of the Commissioner of
Public Works and in accordance with plans and speci-
-- f ications to be prepared by the Department of Public
Works. The construction work shall be done by a
licensed house sewer contractor and shall be performed
under the direction of the said Commissioner and the
Chief Engineer of the City of Saint Paul.

No bond in addition to the sewer contractorts
regular annual bond will be required.
2. Said permittee shall pay the cost of
engineering and inspection of said work, and
the cost of publication of this ordinance.
3. Said permittee and said contractor
shall properly protect all excavations made
in the street, both day and night, so as to
avoid all damage or injury to person or
property; shall properly fill and tamp said
street to avoid settling, and shall restore
said street to its original condition}:
4. Said permittee and said contractor,
after the inception of said work, shall
prosecute same continuously, with diligence,
and fully complete said work, to the stisfaction
and approval of said Commissioner and said
Chief Engineer on or before January 1, 1957.
5. Said permittee shall, within ten days
after the passage and publication of this
ordinance, file a written acceptance thereof
with the City Clerk.
Section 3. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of
the public peace, health and safety.
Section 4. This ordinance shall take effect and be in
force upon its passage, approval and publication.
