A public hearing having been had upon the above improvement upon due notice, and the Council
having heard all persons, objections and recommendations relative thereto, and having fully considered
the same; therefore, be it
RESOLVED, By the Council of the City of St. Paul that the precise nature, extent and kind of im-
provement to be made by the said City is curb northeasterly side of Frontenac Place from
Curfew Street to Eustis Street,
and the Council hereby orders said improvement to be made.
RESOLVED FURTHER, That the Commissioner of Public Works be and is hereby instructed and
directed to prepare plans and specifications for said improvement, and submit same to the Council for
approval; that upon said approval, the proper city officials are hereby authorized and directed to pro-
ceed with the making of said improvement in accordance therewith.

Enclosed is a petition requesting a rehearing on Preliminary
Order 178520. Reasons for this request are included in the petition.
On Sept. 4th, Mrs. DeCourcey gave her verbal consent to such a re-
hearing; and Commissioner Marzitelli, contacted by phone on Sept.
5th, stated he would not object to a rehearing. We sincerely hope
that Mayor Dillon and the other members of our Council will find
no objections to a rehearing on this matter,

We, the undersigned, respectfully petition the St. Paul City Council
for a rehearing on Preliminary Order 178520 which proposes to curb
the northeasterly side of Frontenac Place from Curfew St. to Eustis
St.
We ask for a rehearing on this petition since the original hearing took
place on Sept. 4th, the opening date of some of our St. Paul schools;
and a day following a holiday. This prevented some members of the
opposition from being present.
Also, since the original petition was signed in June 1956, the following
information has been brought to our attention which would make such
curbing impracticable.
1. Due to the peat line which lies beneath the surface of Frontenac
Place and cross the northeasterly property line, curbing would not
be a permanent improvement In this area. According to the St. Paul's
City Engineer's Office, the substructure of the soil would not long
support curbing. Curbing to be permanent would need deep gravel foot-
ings. This type of construction would far exceed fn cost the $4. 1
per front foot which was estimated.
2. Curbing, resting on this peat base, would need constant repair and
watchful attention.
3. The same peat condition prevails on Desnoyer Street, one block west
of Frontenac Pl. , and a pLtition for curbing on this street was
rejected because of the impracticability of such construction.
4. Only three property owners on the northeasterly side of Frontenac
Place still wish for this curbing. Therefore, an unwanted expend.
iture of $4.21 per front foot would be an unfair assessment on the
property of the seven other owners who are opposed to this con-
struction.
5. All property owners on the northeasterly side of Frontenac Place
were not asked to sign this petition. Owners of two undeveloped.
lots were unaware of it until informed of the Council hearing
of Sept. 4th by Mrs. DeCourcey.
6. The petition requests curbing only on the northeasterly side of
Frontenac Place. Property owners on the opposite side of the street
were not to sign, or informed of this petition. Installation of
curbing on one side of the street only would give the block an
off balance appearance.
7. The petition's legal description is inaccurate. As yet construction
of Curfew Street, crossing the northeasterly side of Frontenac P1.
has hat been started and will not be started for at least another
year. At present, and at the time the petition was drawn, Curfew
St. did not, and does not exist
8. Furthermore, the proposed site of Curfew St. would bisect Frontenac
Place, which would mean that curbing would run for only one half
block. This again would create an unbalanced structural appearance.
uu'bing to be effective, should extend from Eustis St. to St.
Anthony St. on Frontenac Pl. The property from the proposed site
of Curfew to St. Anthony is owned by Mr. Larry Bentson who is very
opposed to such curbing on his property and will gladly appear before
our Council to state his views.

The Commissioner of Public Works, having had under consideration the preliminary order of the
Council, known as Council File No. 178520 approved June 26 19 56 relative to
Curbing Northeasterly Side of Frontenac Place from Curfew Street to
Runtime Street
and having investigated the matters and things referred to therein, hereby reports:

1. Said improvement is necessary and (or) desirable. Inspection 45.52
2. The estimated cost thereof is $ 2,458.29 and the total cost thereof is $
