WFIEREAS, adverse action was taken against the Sidewalk Contractor license held by Opus
Northwest Construction, LLC d!b!a Opus Nor[hwest Construction LLC (License ID#19980000539) for
the City of Saint Paul by Notice of Intent to 5uspend License dated February 12, 201Q alleging licensee
failed to pay delfnquent license and late fees of $267.00 and submit cunent insurance and bond
information; and
7 WHEREAS, the licensee did respond to the Notice of Intent to Suspend License to submit current
8 insurance and bond information but failed to pay the delinquent license and late fees; and

10 WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to pay the
11 delinquent license and late fees by February 22, 2Q1Q, that the matter would be placed on the consent
12 agenda to impose the recommended penalty; now, therefore, be it
13
14 RESOLVED, that the Sidewalk Contractor license held by Opus Northwest Construction, LLC
15 dJbla Opus Northwest Construction LLC is hereby suspended for failure to pay delinquent license and late
16 fees.

Dear Mr. McKenzie:
The Department of Safety and Inspections (DSI} has recommended suspension of the Sidewalk Contractor
license held by Opus Northwest Construction, LLC dlb/a Opus Northwest Construcrion LLC for the City of Saint
Paul. The basis for the recommendation is as follows:
On December 10, 2009, you were sent a tetter and RENEWAL INVOICE from the
Department of Safety and Inspections (DSI) stating that your Sidewalk Contractor
license expired as of September 1, 2009. You now owe $267.00 in delinquent license and
tate fees. You were also asked to submit current insurance and bond informaHon.
You were given until December 31, 2009 to respond with the payment and information.
On December 15, 2009, DSI records show that you submitted the requested
information, but as of today's date, payment of the delinquent license and late fees has
not been received.
At this ume, you have three options on how to proceed:
You can pay the $267.00 in delinquent license and late fees. If this is your choice, you should send the
payment direcfly to the Department of Safety and Inspections, at 375 Jackson Street, Ste. 220, St. Paul,
Minnesota 55101-1806 no later than Monday, February 22, 2010. Information should be directed to the
attention of Christine Rozek. A self-addressed envelope is enclosed for your convenience. Payment of the
delinquent ]icense and late fees will be considered to be a waiver of the hearing to which you aze en6tled.

2. If you wish to admit the facts but contest the penalty, you may have a public hearing before the Saint
Pau] City Council, you will need to send me a letter with a statement admitting the facts and
requesting a public hearing. We will need to receive your letter by Monday, February 22, 2010.
The matter will then be scheduled before the Ciry Council for a public hearing to determine whether
to suspend your license. You will have an opportunity to appear before the Council and make a
statement on your own behalf.
If you no longer wish to do business in the City of Saint Paul, you will need to send a written statement to
that effect to the Department of Safety and Inspections, at 375 Jackson Street, Ste, 220, St. Paul,
Minnesota 55]01-1806 no later than Monday, Fehruary 22, 2010. Informauon should be directed to the
attention of Christine Rozek.
If you have not contacted me by that date, I will assume that you do not contest the suspension of
your license. In that case, the matter will be placed on the City Council Consent Agenda for approval of the
recommended penalty.
