1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one and one-half story, wood frame, single family dwelling and its detached
4 two-stall, unapproved carriage house/garage located on property hereinafter refened to as the
5 "Subject Property" and commonly lmown as 1318 POINT DOUGLAS ROAD SOUTH and
6 removal of a one-story, wood frame, concrete block single family dwelling located on property
7 and commonly l�own as 1296 POINT DOUGLAS ROAD SOUTH. This property is legally

WHEItEAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before October 7, 2009, the
following are the now known interested or responsible parties for the Subject Property: Bruce
and Supenn Harrison, 5709 Pleasant Avenue S, Minneapolis, MN 55419; Ocwen Federal Bank
FSB, 12650 Ingenuity Drive, Orlando, FL 32826-2703; Shapiro, Nordmeyer & Zielke, 12550
West Frontage Road, #200, Bumsville, MN 55337; Ocwen Loan Services, c/o Brian Anfinson,
CB Burnett, 5516 Lyndale Ave S, Minneapolis, MN 55419; District 1 Community Council.
WHERP,AS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Buildings" dated August 5, 2009; and
WHEREAS, this order informed the then Irnown interested ar responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order inforxned the interested or responsible parties that they must repair
ar demolish the structure located on the Subject Property by August 20, 2009; and
WHEIZEAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, December 8, 2009 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to arder the

interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfaze and remove its blighting influence on the community by
demolishing and removing the structures in accordance with all applicable codes and ordinances.
The demolition of the structures to be completed within fifteen (15) days after the date of the
Council Hearing; and
WIIEREAS, a hearing was held before the Saint Paul CiTy Council on Wednesday,
January 6, 2010 and the testnnony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1318 and 1296 POINT DOUGLAS ROAD SOUTH.
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of these buildings is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subj ect Property.
4. That an Order to Abate Nuisance Buildings was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
buildings.
5. That the deficiencies causing this nuisance condition have not been corrected.

That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subj ect to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.

That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fizlfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by demolishing and removing the shuctures in
accordance with all applicable codes and ordinances. The demolition and removal of the
structures must be completed within fifteen (15) days after the date of the Council
Hearing.
If the above corrective action is not completed within this period of time Depariment of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove these structures, fill the site and charge the costs incurred against
the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul
Legislative Code.
In the event the buildings are to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resohition be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The 1296 building is a one story, concrete block, single-family dwelling. The 1318 building is
a one story, wood frame, single-family dwelling, both of which are on a lot of 182,952 square
feet.
According to our files, they have been vacant buildings since October 1, 2007.
The current property owner is Khon Jai Boon LLC, per AMANDA and Ramsey County
property records. (A vacant building registration form was filled out on June 10, 2009 stating
Bruce and Supenn Harrison as owners)
The City of St. Pau1 has boarded these buildings to secure from trespass.
There have been eight (8) SUMMARY ABATEMENT NOTICES since 2007.
There have been seven (7) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Boarding
- Removal of tail grass and weeds
On March 2, 2009, an inspection of the building for 1318 Pt. Douglas Rd was conducted and
on March 23, 2009, an inspection of the building for 1296 Pt. Douglas Rd was conducted,
there were lists of deficiencies which constitute nuisance conditions were developed and
photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on
July 30, 2009 with a compliance date of August 20, 2009. As of this date the properties remain
in a condition which comprises a nuisance as defined by the legislative code.
The Vacant Building registration fees aze paid.
Taxation has placed an estimated market value of $443,600 on the land and $3,000 on the
buildings.
As of December 3, 2009, the $5,000.00 performance bond has not been posted.
As of May 19, 2009, Code Compliance inspections have been completed.
Real Estate taxes are current.

Code Enforcement Officers estimate the cost to repair the shucture at 1296 to exceed $85,�Q0
and the siructure at 1318 is $60,000 to $70,000. The estimated cost to demolish structure at 1296
is $8,000 to 10,000 and at 1318 is $10,000 to $12,000.00.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

Inspections, Division of Code Enforcement, hereby declares the premises located at:

45.Q2, and subject to demolition under authority of Chapter 45.11.
On 7uly 30, 2009, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of de�ciencies is not necessarily all the deficiencies present at this time. This
building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall
not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Ocwpancy has been issued. All repairs must be in accordance with
appropriate codes. Changes or additions to the electrical system, mechanical system, or
the plumbing system may necessitate updating or upgrading the systems involved.

Repair floor in northeast comer bedroom, main level.
Remove moldy and damaged wall coverings in basement.
Remove and replace split, dry rotted beam in basement. Beam located at north end of
basement directly above a single 6"x6 "support post adjacent to laundry/mechanical
area. Beam runs east and west and rests upon a beam that runs north and south.
Provide guardrail at stairs to upper level that is the conect height — 36" minimum height.
Patch hole in roof on east side at vent stack opening.
Repair flooring damaged or gone.
Replace floor covering in front porch.
Remove and replace porch sub-floor at entry where rotted and damaged.

18. Install floor covering in the bathroom and kitchen that is impervious to water.
19. Provide thumb type dead bolts for all entry doors. Remove any surface bolts.
20. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc.
as necessary.
21. Provide complete storms and screens, in good repair, for all doar and window openings.
22. Re-level structure as much as is practical.
23. Where wall and ceiling covering is removed install full-thiclrness or code-specified
insulation.
24. Prepare and paint interior and exterior as necessary. Observe necessary abatement
procedure if lead base paint is present (See St. Paul Legislarive Code, Chap. 34 for
additional information).
25. Habitable rooms with new usage and replaced windows shall have giass area equal to
8% of floor area, or a minimum of 8 sq. ft, one-half of which shall operate; and all
bedroom windows shall meet emergency egress requirements (20" minimum width, 24"
minimum height, but not less than 5.7 sq. ft. overall openable area; minimum 5.0 sq. ft.
openable area if sili height is within 44 inches of grade).
26. Provide smoke detectors per the Minnesota Building Code and carbon monoxide
detectors per State law.
27. Repair siding, soffit, fascia, trim, etc. as necessary.

As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by August 20, 2009 the Department of Safety and
Tnspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-8989. This
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condirion.
If this building is located in a historic dishict or site (noterl above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservation guidelines. Copies of the
guidelines and design review application and forms are available from the Deparhnent of Safety
and Inspections web site (see letterhead) and from the HPC staff. No permits will be issued
without HPC review and approval. HPC staff also can be reached by calling 651-266-9078.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate° to all interested parties, all present or subsequent renters and
any subsequent owners. The property shall not be sold, transferred or conveyed in any manner
unfil the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", sub3ect to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The deparirnent is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either arder the City to take the
abatement action or fix a rime within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if correcrive action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, includang administrative costs will be assessed against the proper[y as a special
assessment in accordance with law.

6. Ordering the owner to remove or repair the building(s) at 1318 and 1296 Point Douglas
Road South within fifteen (15) days from adoption ofresolution.
Tim Montgomery appeared on behalf of the new property owners, Bruce and Supenn Harrison.
According to Ramsey County property records, Khon Jai Boon LLC was the listed owner of record.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated that the first building,
1296, was a one-stary, concrete block, single-family dwelling. The second building, 1318, was a
one-story, wood frame, single-family dwelling both on a lot of 182,952 square feet and had been
vacant since October 1, 2007. A code compliance inspection had been done on May 19, 2009, the
vacant building registration fees were current, and the $5,000 performance bond had not been
posted. The 1318 building had been inspected on March 2, 2009; the 1296 building was inspected
on March 23, 2009 and a list of deficiencies which constitute a nuisance condition was developed.
An order to abate a nuisance building was posted on July 30, 2009 with a compliance date of
August 20, 2009. To date, the property remained in a condition which comprised a nuisance as
defined by the Legislative Code. Ramsey County Tasation estimated the market value of the land
to be approximately $443,600 and the buildings to be $3,000. Real estate taxes were current. Code
Enforcement estimates the cost to repair 1296 to exceed $85,000 with an estimated cost for
demolition to be approximately $8,000 to $10,000. The estimated cost to repair 131$ was
approximately $60,000 to $70,000 with an estimated cost for demolition to be approximately
$10,000 to $12,000. There had also been eight summary abatements issued to this property since
2007, seven of which went to work order: to secure the building and the City had to board the
building to secure it from trespass, remove improperly stored refuse and debris, boarding/securing,
and cut tall grass and weeds. Code Enforcement recommends the building be repaired or removed
within 15 days. Mr. Magner presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that there were originally
three shuctures on this parcel with 1322 considered a garage/carriage house which had been
illegally occupied. There were no original permits for this property and it could not be identified on
the Sanborn map. There was a potential historic district, Burlington Heights, identified where some
of the properties had been surveyed. This particular property had not been surveyed and in
reviewing the photographs, she did not believe demolition would have an adverse effect to the area.
Mr. Montgomery stated that his wife was interested in this property and her former employer,
Supenn Harrison, had assisted in financing the purchase of the property. The intent was to allow the
city to demolish the buildings and build a new sriucture which would house monks.
Ms. Moermond asked about the zoning of the property. Mr. Magner responded that it was zoned
RL2 which would allow for such a proposed development.
Ms. Moermond recommended the buildings be removed within 15 days with no option for repair.
She told Mr. Montgomery that if the owner did decide to demolish they buildings themselves, to
contact Mr. It�Iagner.
