WHEREAS, In the matter of Comptroller's Contr= t L-573 '
fqr the Resurfacing of So. Robert Street from Conc. • St. t , King
St., etc. , E.J. Pennig Co. " contractor, the specif d date f
completion is June 15, 1956 and
WHEREAS, the contractor has prosecuted the wo dilige tly
but due to the discovery of extensive voids under a pavem rat on
So. Robert St. between Concord and King Sts. and t subseq ent
work done by the State Highway Department in filli these oids
caused a delay in the completion of the project, b and the cdntrol
of the contractor, it was not posBible to complete he cone act
until August 12, 1956, therefore, be it
RESOLVED, That the proper City officials be a, they e
hereby authorized and directed to execute an amen t to s id con-
tract extending the time of completion to August 1 1956, provided
however, that this resolution shall have no force effect unless
the sureties on the contractor's bond consent ther o and f le such
consent in writing with the City Comptg�ller, and e it
FURTHER RESOLVED, That the City of St. Paul h eby waifes all
claim for liquidated damages and that no engineeri and in pection
costs on this project will be charged by the City accoun of
such extended period.

WHEREAS, In the matter of Comptroller's Contract L-5735
for the Resurfacing of So. Robert Street from Concord St. to King
St. , etc. , E.J. Pennig Co. contractor, the specified date of
completion is June 15, 1956 and
WHEREAS, the contractor has prosecuted the work diligently
but due to the discovery of extensive voids under the pavement on
So. Robert St. between Concord acid King Sts. and the subsequent
work done by the State Highway Department in filling these voids
caused a delay in the completion of the project, beyond the control
of the contractor, it was not possible to complete the contract
until August 12, 1956, therefore, be it
RESOLVED, That the proper City officials be and they are
hereby authorized and directed to execute an amendment to said con-
tract extending the time of completion to August 12, 1956, provided
however, that this resolution shall have no force or effect unless
the sureties on the contractor's bond consent thereto and file such
consent in writing with the City Comptoriler, and be it
FURTHER RESOLVED, That the City of St. Paul hereby waives all
claim for liquidated damages and that no engineering and inspection
costs on this project will be charged by the City on account of
such extended period
