and removal of a tcvo-story, wood frame house and its wood frame shed located on property
hereinafter referred to as the "Subject Property" and commonly known as 389 CLINTON
A'VENUE and a two-story wood frame house Irnown as 393 CLINTON AVENUE. This
property is legally described as follows, to wit:
WEST ST PAUL BLKS 1 THRU 94 LOT 7 BLK 21
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before June 7, 2009, the
following are the now known interested or responsible parties for the Subject Property: LNV
Corparation c/o MGC Mortgage Inc, 7195 Dallas Pazkway, Plano, TX 75024; Shapiro,
Nardmeyer & Zielke, 12550 West Frontage Rd, Ste 200, Burnsville, MN 55337; Steven Charles
Martin, 715 East 32" Street, Minneapolis, MN 55407-1530; West Side Citizens Organization &
West Side Safe Neighborhood Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated August 31, 2009; and
WHEREAS, this order informed the then lrnown interested or responsible parties that the
structures located on the Subject Property are nuisance buildings pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by September 30, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring these buildings to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislarive Hearing Officer of the Saint Paul
City Council on Tuesday, December 8, 2009 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to order the
interested or responsible parties to make the Subject Property safe and not detrimental to the

public peace, health, safety and welfare and remove its blightmg influence on the community by

The demolition of the sh to be completed within fdteen (15) days after the date of the
Council Hearing; and
WI�REAS, a hearing was held before the Saint Paul City Council on Wednesday,
January 6, 2010 and the testimony and evidence including the action taken by the Legislarive
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order conceming the Subject Property at 389 CLINTON AVENUE and 393 CLINTON
AVENUE.

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of these buildings is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Buildings was sent to the then lrnown
responsible parties to correct the deficiencies or to demolish and remove the
buildings.

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, VacantfNuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilied.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by demolishing and removing the structures in
accordance with all applicable codes and ordinances. The demolition and removal of the
shuctures must be completed within fifteen (15) days after the date of the Council
Hearing.
2. If the above corrective action is not completed within this period of time Deparhnent of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
104 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested

The Department of Safety and Inspections has declared this building(s) to consritute a"nuisance"
as defined by Legislativa Code, Chapter 45. The Deparhnent of Safety and Inspecrions has
issued an order to the then known responsible parties to eliminate this nuisance condition by
correcting the deficiencies ar by razing and removing this building(s).
The praperty was re-inspected on September 30, 2009. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the biighting influence
of this property. It is the recommendation of the Depaztment of Safety and Inspections that the
City Council pass a resolution ordering the responsible parties to either repair, oz demolish and
remove this building in a timely manner, and failing that, authorize the Deparlment of Safety and
Inspecrions to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taees.

The front building (aka 393 Clinton) is a two story, wood frame, duplex. T`he rear building (aka
389 Clinton) is a two story, wood frame, single-family dwelling with a wood frame shed, both of
which aze on a lot of 7,405 square feet.
According to our files, they have been vacant buildings since January 21, 2009.
The current property owner is Lnv Corporation/Co Mgc Mortgage Inc, per AMANDA and
Ramsey County Property records.
The city has had to board these buildings to secure it from trespass.
There have been six (6) SUMMARY ABATEMENT NOTICES since 2009.
There have been six (6) WORK ORDER(S) issued for:
- Boarding/Securing
- Improperly stored refuse, garbage and misc debris
- Removal of tall grass and weeds
On August 12, 2009, an inspection of the buildings was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NiTISANCE BUILDING was posted on August 31, 2009 with a compliance date of
September 30, 2009. As of this date these properties remain in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid. (assessed on 3-27-09)
Taxation has placed an estimated market value of $40,400 on the land and $204,500 on the
buildings.
As of December 3, 2009, a Code Compliance Inspection has not been completed.
As of December 3, 2009, the $5,000.00 performance bond has not been posted.
Real Estate taYes for 2009 are delinquent in the amount of $6,296.72, plus penalty and interest.
Code Enforcement Officers estimate the cost to repair 393 Clinton is $15,000 to $20,000.

The Vacant(Nuisance Buildings Unit, Department of the Department of Safety and Inspections, Division
of Code Enforcernent, hereby declares the premises located at:

This list of de6ciencies is not necessarily all the deficiencies present at this time. This building(s) is
subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall not again be used for

The building was found to be unsafe, unfit for human habitation, a public nuisance, a hazard to the public
welfare or otherwise dangerous to human life. A Condemnation Placazd has been posted on the building.
The following deficiency list must be completed immediately ar the building vacated.
A reinspection will be made on January ]8, 2008 at 11:30am.
CONDEMNATION OF THE BUILDTNG REVOKES THE FIRE CERTIFICATE OF OCCUPANCY.
Failure to complete the corrections may result in a criminal citation. The Saint Paul Legislative Code requires
that no building be occupied without a Fire Certificate of Occupancy.

where missing.

between 120 degrees F and 130 degrees F.

between 34 and 38 inches above the treads and run the entire length of the stair.
13. HALLWAY - SPLC 34.10 (7), 3433 (6) - Repair and maintain the walls in an approved manner.
14. HALLWAY - MSFC 315.2.5 - Fueled equipment, including but not limited to motorcycles, mopeds,
lawn-care equipment and portable cooking equipment, shall not be stored, operatar or repaired within a
building.
15. UPPER UNIT - MSFC 603.7 - Immediately cease using the stove or oven for heating.
16. UPPER UNIT - SPLC 34.11 (6) - Provide and maintain a minimum of 68 degrees F in all habitabie
rooms at all times.
17. WATER HEATER -1V1FGC 501.2 - Provide, repair or replace the fuel equipment vent or vent liner to
develop a positive flow adequate to convey a11 products of combustion to the outside. This work may require a
permit(s). Call LIEP at (651) 266-9090.
18. SPLC 39.02(c) - Complete and sign the provided smoke detector affidavit and return it to this office.
19. Provide the inspector with a completed and signed Residential Occupancy Affidavit.

You have the right to appeal these orders to the Legislative Hearing Officer. Applications for appeals may be
obtained at the City Clerks Office, Room 310, (651-266-8688), and must be filed within 10 days of the date of
the original orders.

ORDER:
Reaair the structure to a habitable condition.
This structure is a registered vacant building that must have a Code Compliance CertiTicate before the
structure may be occupied.
Obtain a Code Compliance Certificate from the Department of Safety and Inspections. You may contact Jim
Seeger at 651-266-9046, for a code compliance inspection, permits, and issuance of the Code Compliance
Certificate.
Under Chapter 33.03 of the Saint Paul Legislative Code, failure to obtain a Code Compliance Certificate before
occupying the structure may result in issuance of criminal summonses.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting
nuisance condirion is not corrected by September 30, 2009 the Deparhnent of Safety and Inspections,
Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the
building(s). The costs of this action, including administrative costs and demolition costs will be
assessed against the property taxes as a special assessment in accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the Building
Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-8989. This inspection will
identify specific defects, necessary repairs and legal requirements to correct this nuisance condition.
If this building is located in a historic district or site (noted above, just below the property address) then
you must contact Heritage Preservation (HPC) staff to discuss your proposal for the repairs required by
this order and compliance with preservation guidelines. Copies of the guidelines and design review
applicarion and forms are a�ailable from the Department of Safety and Inspections web site (see
letterhead) and from the HPC staff. No permits will be issued without HPC review and approval. HPC
staff also can be reached by calling 651-266-9078.
As an owner or responsible parky, you aze required by law to provide full and complete disclosure of this
"Order to Abate" to all interested parties, all present or subsequent renters and any subsequent owners.
The property shail not be sold, transferred or conveyed in any manner until the Nuisance Conditions
have been abated and the Certificate of Code Compliance or Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placard on this property which declares it to be a
"nuisance condition", subject to demolition and removal by the City. This placard shall not be removed

without the written authority of the Department of Safety and Tnspections, Division of Code
Enforcement. The department is further required to file a copy of this "Order to Abate" with the City
Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer will
notify the City Council that abatement action is necessary. The City Clerk will then schedule dates for
Public Hearings before the City Council at which time testimony will be heazd from interested parties.
After this hearing the City Council will adopt a resolution staring what action if any, it deems
appropriate.
If the resolution ca11s for abatement action the Council may eiYher arder the City to take the abatement
action or fix a tnne within which this nuisance must be abated in accordance with the provisions of
Chapter 33 of the 5aint Paul Legislative Code and provide that if conective action is not taken within
the specified time, the City shall abate this nuisance. The costs of this action, including administrative
costs will be assessed against the property as a special assessment in accordance with law.

5. Ordering the owner to remove or repair the building(s) at 389 Clinton Avenue and 393
Clinton Avenue within fifteen (15) days from adoption of resolution.
The property owner of record, LNV Corporation/co MGC Mortgage Inc, did not appear. No other
parties of interest appeared.
Mr. Ma�er stated that the front building (393 Clinton) was a two-story, wood frame duplex. The
rear building (389 Clinton) was a two-story, wood frame, single-family dwelling with wood frame
shed, both on a lot of 7,405 squaze feet and had been vacant since January 21, 2009. A code
compliance inspection had not been done, the vacant building registration fees in the amount of
$1,000 went to assessment on Mazch 27, 2009, and the $5,000 perforxnance bond had not been
posted. On August 12, 2009, an inspection of the building was done and a list of deficiencies which
constitute a nuisance condition was developed. An order to abate a nuisance building was posted on
August 31, 2009 with a compliance date of September 30, 2009. To date, the property remained in
a condirion which comprised a nuisance as defined by the Legislative Code. Ramsey County
Taacation estimated the market value of the land to be approximately $40,400 and the building to be
$204,500. Real estate taxes for 2009 were delinquent in the amount of $6,296.72, plus penalty and
interest. Code Enforcement estimates the cost to repair 393 Clinton to be approximately $15,000 to
$20,000 with an estimated cost for demolition to be approximately $9,000 to $10,000. The
estimated cost to repair 389 Clinton was approximately $50,000 to $60,000 with an estimated cost
for demolition to be approximately $8,000 to $9,000. There had also been six summary abatements
issued to this property since 2009, all of which went to work order: to secure the building and the
City had to board the building to secure it from trespass, remove improperly stored refuse and
debris, boarding/securing, and cut tall grass and weeds. Code Enforcement recommends the
building be repaired or removed within 15 days. Mr. Magner presented photographs of the
property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1904 as worker's-style housing. The building had been severely altered with no defining features ar
characteristics. She did not believe demolition would have an adverse effect on the neighborhood.
Ms. Moermond stated that the building was a legal, non-conforming duplex which would need to be
deconverted if it were to be rehabbed. Since the property appeared to have been abandoned, she
recommended the buildings be removed within 15 days with no option for repair.
