RESOLVED, that Lanka Drugs, Inc. be permitted to install
and operate a customer parking lot on the north side of Selby
Avenue between Western and Arundel, being 397-403 Selby Avenue,
on Lots 25, and 26, Block 2, Kern's Addition, subject to a
later approval by the City Council of zoning appeals for relax-
ing the yard area requirements of the Zoning Ordinance and the
extension of the Commercial use of the entire tract, and subject
to compliance with the provisions of all ordinances governing
the operation of parking lots and to the further condition
that sidewalks abutting said premises be kept clean and free
•
of ice and snow at all times.

The Council requested that you prepare a resolution granting the attached
application of Laska Drugs, Inc. for permit to install and operate a customers'
parking lot on the north side of Selby Ave., between Western and Arundel,
being 397-403 Selby Ave., on Lots 25, 26, Block 2, Kern's Addition, subject
to a later approval by the City Council of zoning appeals for relaxing the
yard area requirements of the Zoning Ordinance and the extension of the Commercial
use to the entire tract.

This is in the matter ofALaska Drugs Inc. for a permit to install and operate
a customers' parking lot at 397 - 403 Selby. This property is on the north
side of Selby between Western and Arundel. It is described as lots 25 and
26 - block 2 - Kern's Addition.
A portion of this property is presently vacant. There is a vacant home on
the property and there is an existing small grocery store on the property.

It has a frontage of 80' on Selby and extends northerly to a depth of approxi-
mately 116.5' .
Field investigation discloses no objection to a parking lot at this point from
the standpoint of adjacent land use or traffic.
The Zoning Board, in reviewing the applicant's plans finds that the carrying
out of the applicant's plans would necessitate the granting of an appeal by
the City Council to relax the yard requirements of the Zoning Ordinance.
The Zoning Board also finds that the applicants contemplate using a portion
of the site for parking which is presently zoned "B" residence. Inasmuch as
this parking is to be incident to a commercial use the Zoning Board feels
that the applicants should file an appeal requesting that the Council extend
the commercial use to cover all of lots 25 and 26 so as to permit parking on
the northerly 16' of these two lots.
In consideration of these factors, the Zoning Board recommends this permit be
granted subject to the favorable consideration by the Council of the necessary
appeals to relax the yard area requirements of the Zoning Ordinance and to .
extend the commercial zoning so as to permit parking on the entire area of lots
25 and 26. The determination of this question should be conditioned upon the
filing of revised plans showing the relationships described in this e•ort.
