The basis for this determinatlon is as follows: - On March 2, 2009, a DSI Inspector contacted you regarding a complaint seceived concernfng license condition violations at your esta6dishment. You stated at that time, that an inspector had already been out to your property on February 26, 2009 and he spoke to you about the violations and took several photographs. The inspector on the phone stated that he would be sending written orders to correct the violations and he would be back to take additional photographs. On March 3, 2009, you were sent a letter with the following written orders from the Department of Safety and Inspections based on the complaint received and the February 26, 2009 photographs: 1) A site plan was required whea you first applied for the iicense and it was never submitted. This is a violation of license condition #1 which states: `:411 customer and employee vehicles (one space shall be designated and marked for Handicap parking) must be parked in the area designated on the approved site on fite with LdEF (submit site plan immediutely)." 10-284 Pazkway Auto Body, Inc. May 5, 2009 Page 2 2) There were numerous vehicles with ma,jor parts cttissing and no licenses. This is a violarion to license coadition #2 which states: "All vehicles parked ouEctoors must appear to be completely assembled with no major body paRs missing." 3) It appeared to the inspector that there were cars purchased for salvage which is a violation of license condition #3 which states: "Vehicle saCvage u sot permitted " 4) You had tires piled in several locations around the lot and in the beds of pickups. There were vehicle parts stored on top of or next to other vehicles. There were chairs, plastic sheeting and boards that should been in a covered dumpster. This is a violation to license condition #4 which states: "Vehicle parts, tires, oil or similar items wzll not be stored outdoors, Trash will be stored in a covered dumpster." 5) Based on the condition of the lpt, the inspector believed that many of the veriicles appeared to have been parked longer than 10 days on the premises. This is a violation to license condition #8 which states: "Customer vehicles may not be parked longer than IO days on fhe premises. " In the letter, you were given until March 31, 2Q09 to wrrect the violafions. On March 31, 2009, a DSI Ynspector came to your establishment and took several photographs showing the property in the same condition as when the photographs were first taken on February 26, 2009. Therefore, the violations had not been corrected by the stated deadline. Based on the numerous violations to your license conditions and your failure to comply with the written orders, per Saint Paul Legislative Code §310.05 (m) (1) the licensing office will recommend a$500.00 matrix penalty. At this time, you have three options on how to proceed: You can pay the $500.00 matrix penalty. If this is your choice, you will need to send your payment to the Department of Safety and Inspections at 375 Jackson Street, Ste. 220, St. Paul, Minnesota 55101-1806 no later than Friday, May 15, 2009. Information should be directed to the attention of Christine Rozek. A self-addressed envelope is enclosed for your convenience. Payment of the $500.00 matrix penalty will be considered a waiver of the heazing to which you are entitled. 2. If you wish to admit the facts but contest the penalty, you may have a public heazing before the Saint Paui Ciry Cauncil, you will need to send me a letYer with a statement admitting the facts and requesting a gublic hearing. We will need to receive your letter by Friday, May 15, 2009. The matter will then be scheduled before the City Council for a public hearing to determine whether to impose the $5�0.00 matrix penalty. At that hearing both you and the City will be able to appeaz and present witnesses, evidence and cross-examine each othei s wimesses. The St. Paul City Council will ultimately decide the case. If this is your choice, please advise me no later than Friday, May 15, 2009, and I will take the necessary steps to schedule the administrative hearing. If you have not contacted me by that date, I will assume that you do not contest the imposition of the $500.00 matrix penalty. In that case, the matter wil{ be placed on the City Council Consent Agenda for approval of the recommended penalty. All repair work must be done inside the building. At the time of my inspection there was an employee working on a Mercedes with no plates. Condition 6, No General auto repair is allowed Auto Body repair and painting only. As stated above the work being done on the outside on the lot did not appeaz to be auto body work. Condition 8, Customer vehicles may not be pazked longer ihan 1� days on the premises. From the condition of the lot many of the vehicles appeaz to have been parked longer than 10 days. The basis for this determinarion is as follows: On November 4, 2009, you received a letter from the Department oF Safety and Inspections (DSI) listing numerous violations to the conditions of your license based on an inspection performed on October 29, 2009: i. A site plan was never submitted in violation of license condition #1 which states: "All customer and employee vehicles (one space shal[be designated and marked for Handicapped parking) must be parked in the area designated on the approved site plan on file with LZEP (submit site plan immediufely)." 2. This is a violation of license condition #4 which states: "VehicZe parts, tires, oil or similar items will not be stored outdoors. Trash will be stored in a covered dumpster." 5. At the time of inspection there was an employee working on a Mercedes with no plates in violation of license condition #5 which states: `°No repair of vehicles is allowed on the lot. All repair wark must be done inside the shop." and license condition #6 which states: "No gener¢l ¢uto repair is al[owed; auto body and painting on[y." 6. The condition of the lot indicated that many of the vehicles appeared to have been parked longer than ten (10) days in violation of license condition #8 which states: "Customer vehicies may not be parked longer than ID days on the premises." You were given until November 28, 2009 to correct the violations and hring your establishment into compliance. On December 2, 2009, the inspector returned and documented many of the same license condition violations that were detailed in the November 4, 2009 letter. The purpose of this section is to establish a standard by which the city council determines the amount of fines, the length of license suspensions and the propriety ofi revocations, and shall apply to all license types, except that in the case of a violation involving a liquor license § 409.26 shail apply where a specific violation is listed. In the case of an adverse action fifed for a violation of chapter 331A the licensee shall be given a fine for each individual violation of § 331A. The total fine amount for violations of § 331A may exceed the maximum fine outlined below due to multipfe violations in one (1) appearance. All penaliy recommendations for chapter 331A violations shall be based on the food penalty guideline referred to in chapter 331A. These penalties are presumed to be appropriate for every case; however the council may deviate therefrom in an individual case where the council finds and determines that there exist substantial and compelling reasons making it more appropriate to do so. When deviating from these standards, the council shaff provide written reasons that specify why the penalty selected was more appropriate. Notwithstanding the provisions of section 310.05(c), a licensee who would be making a f+rst or second appearance before the council may efect to pay the fine to the Department of Safefy and {nspections without a council hearing, unless the notice of violation has indicated that a hearing is required because of circumstances which may warrant deviation from the presumptive fine amount. Payment of the recommended fine will be considered to be a waiver of the hearing to which the licensee is entitled, and wil! be considered an "appearance" for the purpose of determining presumptive penalties for subsequent violations. B. For adverse action initiated under Chapter 331A of this Code, a fine may be paid without a hearing regardless of how many prior appearances that licensee has made before the Council. The above council hearing requirement applies to violations under Chapter 331A unless the fine recommended by the Department of Safety and Inspections is equal to or less than the fine amount outlined in the above matrix. Payment of the recommended fine will 6e considered to be a waiver of the hearing to which the licensee is entitled, and will be considered an "appearance" for the purpose of determining presumptive penalties for subsequent violations. A non-critical violation under chapter 331A shail not be considered an "appearance" for purposes of determining presumptive penalties for non-331A violations. A council hearing is required if the Department of Safety and inspections recommends a fine that is an upward departure for the amount outlined above. (ii) Multiple violations. At a licensee's first appearance before the city cou�cil, the council shall consider and act upon all the violations that have been alleged and/or incorporated in the notices sent to the licensee under the administrative procedures act up to and including the formal notice of hearing. The council in that case shall consider the presumptive penalty for each such violation under the "1st Appearance" column in paragraph (b) above. The occurrence of muliipie violations shall be grounds for departure from such penalties in the council's d+scretion. (iii} Violations occurring after the date of the notice of hearing. Viofations occurring after the date of the notice of hearing that are brought to the attention of the ciiy attorney prior to the hearing date before an administrative law judge (or before the council in an uncontested facts hearing) may be added to the notice(s) by stipulation if the licensee admits to the facts, and shall in that case be treated as though part of the "1st Appearance." In ali other cases, violations occurring after the date of the formai notice of hearing shall be the subject of a separate proceeding a�d deaft with as a"2nd Appearance" before the cou�cil. The same procedures shall apply to a second, third or fourth appearance before the council. (iv) Subsequent appearances. Upon a second, third or fourth appearance before the councii by a particular licensee, the council shail impose the presumptive penalty for the violation or violations giving rise to the subsequent appearance without regard to the particular violation or violations that were the subject of the first or prior appearance, However, non-critical violations of Chapter 331A shafl not be counted as an "appearance" before the Councii in relation to any violation other than another viofation of Chapter 331A. (v) Computation of trme. (1) if a licensee appears before the council for any violation in paragraph (m) where that violation has occurred within twelve (12) calendar months after the first appearance of the same licensee for a violation listed in paragraph (m) above or section 409.26, the current appearance shafl be treated as a second appearance for the purpose of determining the presumptive penalty. (2) Ifi a licensee has appeared before the councii on two (2) previous occasions Chapter 310. Uniform Licens °rocedures 10 Page 3 of 3 for violations listed in paragraph (m) or section 40926, and if said Iicensee again appears before the council for a violation listed in paragraph (m), and if the current violation occurs within eighteen (18) calendar months of the violation that gave rise to the first appearance before the council, then the current appearance shall be treated as a third appearance for the purpose of determining presumptive penalty. (3) If a ficensee has appeared before the council on three (3) previous occasions, each for violations listed in paragraph (m) or section 40926, and if said licensee again appears before the council for a violation contained in paragraph (m), and if the current violation occurred within twenty-four (24) cafendar months of the violation that gave rise to the first appearance, then the current appearance shall be treated as a fourth appearance for the purpose of determining the presumptive penalty. (4) Any appearance not covered by subsections (1), (2) or (3) above shall be treated as a first appeara�ce. In case of multiple violat+ons in any appearance, the date to be used to measure whether twefve (12), eighteen (18), or twenty-four (24) months have elapsed shall be the date of the violation fast in time at the first appearance, and the date of the violation first in time at any subsequent appearance.
