COLEMAN, Deputy Commissioner °WOO August 8, 1956 To the Mayor and Council of the City of St. Paul Gentlemen: Over a period of several years lands which forfeited for nonpayment of taxes lying in the Phalen Creek Valley and the adjacent bluffs were acquired by the City of St. Paul for possible development as a municipal recreation area. All of the lands contained in paragraphs (a), (b), and (c) were conveyed to the city for a municipal recrea- tion area under the following state deed numbers and dates: Paragraph (a) - State Deed No. 49391 - dated April 2, 1945 Paragraph (b) - State Deed No. 86644 - dated December 27, 1949 Paragraph (c) - State Deed No. 98672 - dated September 10, 1953. The parcel described in paragraph (d) was acquired for public park purposes under State Deed No. 64410, dated June 15, 1946. Although the public purpose stated in this conveyance varies from the other conveyances, this parcel actually controls the entrance to the tun- nel which is the only vehicular means of access to the valley. Recent complaints indicate that these parcels in the valley may be- come a drain on the funds of this department, which are insufficient at this time to maintain our present parks and playgrounds. Devel- opment of the valley for a municipal recreation area would involve an outlay of funds which under current budget limitations will not be available in the foreseeable future. I, therefore, recommend that all of the parcels described in the at- tached resolution be re-conveyed to the State of Minnesota in trust, as provided by Minnesota Statutes Annotated, Section 281.25.
